Minutes of the Taringa Anihana Whanau Hui Held at the Otara Leisure Centre, Newbury St Otara 25 August 2012,

The agenda and information for the hui had been pre-circulated. The hui commenced at 9:30 am. The hui facilitator was Sam Napia

1. 4. Taringa Anihana Whanau Trust Discussion on and review of the question-and-answer information sheet for Whanau Trusts and Form 23 Application to Form Whanau Trust. This information was pre-circulated on 1 August 2012, and then reviewed again at the hui. Moved: Shauna Goble Seconded: Georgina Thompson That an application be made to the Maori Land Court to form the Taringa Ani Anihana Nehua-Bryers Whanau Trust That the shares of Annie Anderson (also known as Taringa Ani Anihana Nehua-Bryers) in Waihou A2A1 be vested in the Taringa Ani Anihana Nehua-Bryers Whanau Trust That the proposed trustees of the Taringa Ani Anihana Nehua-Bryers Whanau Trust are: o Clenella Tuala o Anne Thompson o Sam Napia o Maraea Turketo o Patty Hikuroa o Martin Bryers o David Nom o Aaron Bryers o Chris Thompson

5. Other business: Applications for Occupation Orders: discussion and decision as to a response (if any) to the proposed applications. a. The meeting noted that Anna Anderson had made application in 2006. Maori Land Court minutes from 2006/2007 had been pre-circulated and were reviewed in respect of hearings held on: i. 31 August 2006 before Judge Ambler; ii. 12 March 2007 before Judge Ambler; and, iii. 12 September 2007 before Judge Spencer. b. It is clear that the Court encouraged the whanau to connect the issue of occupation with a consideration of the establishment of an Ahu Whenua Trust. Judge Spencer, in particular, was strong on this point. Stopping short of making specific directions, Judge Spencer nonetheless strongly encouraged whanau to make an application for an Ahu Whenua Trust be made (see 34 Akld MB 152,153). Sadly, Paul Anderson, who accepted the assignment to bring an application before the Court, passed away a relatively short time after the September 2007 hearing. Thus, an application was not made as anticipated. c. The hui considered that, if anything, current circumstances are more compelling than ever before for an Ahu Whenua Trust to be established. d. These current circumstances include:

i. A dwelling has been erected on the site without building consent from the Far North District Council. In the context of the Building Act, this is an illegal building for which owners of Waihou A2A1- amongst other parties including the building owner and builder(s) - have potential liability. ii. The Far North District Plan provides for only one dwelling on the block "as of right". Any additional dwelling(s) would likely require resource consent. iii. Anna Anderson successfully applied for rates remission in March 2011. However, despite the clear explanation of the statutory declaration that must accompany such an application, the information provided by Anna to the Far North District Council was not true and correct in all respects, as required and declared. For example, Anna has declared that the block is landlocked; but, this is clearly not the case. Such a false declaration (that the block is landlocked) would likely have been material to the decision to remit rates. Knowingly giving false information by statutory declaration is perjury, within the meaning of the Oaths and Declarations Act 1957. This hui does not pass judgement or make any assumption that such is the case here. At the same time however, this hui would not want our Grandmother Taringa and other tupuna associated with perceptions of, or potential allegations of, serious dishonesty. iv. Anna Anderson, on behalf of a (proposed) Whanau Trust has notified an intention to again apply for an occupation order. This year, Anna instigated two hui to provide for whanau consultation over the proposal. The latter hui, held on 30 June 2012, resolved not to support occupation order application. Rather, that 30 June 2012 hui favoured further consideration of creating an Ahu Whenua Trust to administer the block and appropriately provide for utilisation (including occupation). Since that 30 June 2012 decision was made, despite being asked a number of times, Anna has not yet provided the record and minutes of that 30 June 2012 meeting.

Ahu Whenua Trust: discussion and decision as to whether such a trust should be established. o Further to the forgoing minuted discussion on the matter, the hui also noted the expressed support from the Nellie Anderson whanau and the Nukutawhiti Anderson whanau for the establishment of an Ahu Whenua Trust. Marama Pritchard arrived at 12 noon. Na Wally Thompson te mihi hakatau i to tatou whanaunga a Marama. o Following much discussion, and having particular regard to

the history of the subject of Ahu Whenua Trust for Waihou A2A1, the hui determined that an application should be brought before the Court.

Moved: Shauna Goble Seconded: Christopher Murphy That an application be made to the Maori Land Court to establish the Waihou A2A1 Ahu Whenua Trust as administrator of Waihou A2A1 under section 354 of Te Ture Whenua Maori Act. That the following be appointed as Responsible Trustees of the Waihou A2A1 Ahu Whenua Trust: o Maria Murphy o Luella Donaldson o Valerie Pritchard o Sam Napia o Mokena Peeni That Marama Pritchard and Tametame Anderson be appointed as Advisory Trustees of the Waihou A2A1 Ahu Whenua Trust. Carried.
