TRIAL MEMORANDUM

I.

Statement of the Case:

Melissa, an academically excellent student, died at the tender age of 12 due to school bullying. She chose to take her life rather than continue with the miserable life at school caused by her bully classmates who inflicted not only physical pain upon her but also emotional suffering due to threats of bodily harm, and threats that they would ruin her reputation within the school. At the time of her death, she was apparently reading an email from one of the bullies in her school telling her to commit suicide instead because they will not stop doing the things they are doing to her. The parents of Melissa, instituted the present case for damages asking for retribution from the courts, for the wrong committed to their daughter, the persistent bullying which prompted her to commit suicide which caused her untimely demise. The action is against the Parents of X,Y,Z (the bully classmates) for the damages caused by their minor children who live in their company; Teachers of X,Y,Z for failure to supervise their pupils and prevent the persistent bullying that had occurred for so long, which ultimately caused the suicide incident; and Magarang Exclusive School in Metro Manila where they (Melissa, X, Y and Z) studied and where the bullying started and continued without any action on the part of the school to prevent and stop the bullying of the young and helpless, grade-school student under their care.

II.

Parties: 1. Petitioners Parents of Melissa, are of legal age, Filipino citizens, and residents of

AA Metro Manila, where they can be served with notices and other court processes of this Honorable Court.
