Sylvia and Terri, Legal advice sought. Please guide me on preparation of the City Clerk Certificate for the Quality of Life Voters Initiative Petition. Attached are examples of what I have sent out before. The first was for a recall election petition that was insufficient, so the reference to the ordinance in this situation would not be the same. Also, I am attaching the City Clerk Certificates where I found the first Transmountain Initiative Petitions to be insufficient. They had submitted two different ones, neither of which contained the requisite number of signatures. There were 148 pages of this initiative petition submitted. The petition was filed on July 31,2012. We have verified 1423 signatures and we have completed the verification. I would like to issue the certificate. Please would you prepare it for me? I can do it myself, too, if you'd prefer, with your recommendations. I am attaching the first page of the petition so you can quote the language if you do prepare it. Thanks, Richarda
Whereas on July 31, 2006, a notice of intent to file a recall petition pertaining to Susannah M. Byrd, District II Representative, was received by the City Clerk; Whereas on September 27, 2006, a recall petition consisting of 109 pages was received by the City Clerk; Whereas, Ordinance 008066 passed and approved by City Council on June 5, 1984, provides for the procedures and form for the recall of City officers in addition to the requirements of the City Charter and application of State law; and Whereas after examination of such recall petition, the City Clerk makes the following findings and certification: The recall petition is insufficient. Only 879 signers on the 109 page petition can properly be counted toward the total number of qualified electors required to sign the recall petition. Each one of the signers not counted was for the reason that their entry contained one or more defects or lacked one or more of the elements required under State law, the El Paso City Charter, or City Ordinance 008066.

Incorrect info. There is no legal requirement for a notary on the initiative petitions. They may be providing one, but it is not required. Also incorrect on the recollection about the petition from Jaime Perez. That was not the reason, as I recall it.

FYI - I sent this e-mail to Ann and then forwarded to Debbie. We can beat these petition things by nailing them on the Notary Public's certification. I accidentally signed this document thinking it was a sign in sheet - so deceiving. So I scratched my name off and ultimately kept the sheet. I read my Notary rules today and a Notary must actually witness each and every signature. So passing these around in a room or at different places with no Notary present to witness the signatures is in violation of the law (as I read the rules). City ought to go after this. I remember years ago Jaime Perez brought in a petition and I think it had the correct number of signatures - but the notary he used lost his nerve and admitted publicly that he never witnessed each person signing and the petition was thrown out. Ask Richarda about that. It may have been before you even came to EI Paso.
So last night this petition was being circulated and some of us thought it was a sign in sheet. We removed our

. names, but I kept one sheet. Look at the bottom where the notary has to sign. Read my other attachment on prohibited acts by notaries. Every signature on a petition must be physically signed in front of a notary. If a notary certifies this petition and did not see these people sign then they are breaking the law. I have to ask - does Richarda get any kind of affidavit from the notary that signs petition to prove they actually witnessed these people signing? I don't think so. This is a way to throw out each and every petition that comes to the City. I am going to ask Jim Tolbert who notarized his petitions and did a notary stand there and witness each and every signature.

David, They need 1548 signatures of registered voters. There also could be a host of other legal issues with the petition that I can not anticipate. City Council is scheduled to call for the Nov election on August 21. The petitioners need to turn in petitions to me well before then to give me time to verify the signatures. I can not tell you how long that will take my office, so I can not specify a specific deadline. The Charter gives me 20 working days. You can consult Section 3.11 of the Charter. I have pasted it in below. 3.11 INITIA TIVE. Whenever a number of registered voters equal to at least five percent of the voters who voted in the last general City election sign a petition setting forth the precise content of an ordinance desired by the signers, the Council must place that ordinance on the agenda of a Council meeting to be held within thirty working days of the receipt, by the City Clerk, of the petition bearing the authenticated names and addresses of the petitioners. Such an item shall be treated by the Council exactly as any other proposed ordinance. Should an ordinance proposed by such petition not be enacted by the Council, or should it be enacted in an amended form, a second petition, signed by a number of registered voters equal to at least five percent of the voters who voted in the last general City election, may be submitted to the City Clerk and that official shall have twenty working days in which to authenticate the signatures and thereafter must place the reproposed ordinance on the ballot at the next general election specified in State law, if the proposal received the favorable vote of a majority of those voting in that election it shall thereupon become a City ordinance. The Council is not obliged to consider the same ordinance initiated by petition, or one that is substantially the same, more often than once in two years.
