PROFESSIONAL REGULATION COMMISSION (PRC) Hand in hand with the Board of Nursing in the regulation of the nursing profession is the Professional Regulation Commission (PRC). The PRC is charged with multifarious duties and functions pertaining to the regulation of the legally established professions and occupations in the Philippines. A description of its duties and functions, in so far as they relate to the professions and occupations, is as follows: 1. Enforcement of regulatory policies. The Commission administers, implements, and enforces the regulatory policies of the National Government in: a. The regulation of the legally established professions and occupations under the jurisdiction of the different licensing boards; b. The registration of practitioners of said professions and occupations; and c. The maintenance of requisite professional and ethical standards in the practice of said professions and occupations.

2. Recommendation of nominees for Board membership. The Commission is vested with authority to recommend to the President nominees for appointment as members of the licensing Boards. The recommendation nominees are selected by the Commission from among those nominated by the respective bona fide professional organizations accredited by the Commission. 3. Supervision of Board members. The Commission exercises general supervision over the members of the licensing Boards. This function of general supervision, however, is to be distinguished from the power of direct supervision and control of the President of the Philippines the licensing Boards, as provided by their respective laws. 4. Review and approval of acts of Boards. The Commission has the authority to review, coordinate, integrate, and approve the policies, resolutions, and rules and regulations adopted, and the orders or decisions promulgated, by the licensing Boards under their respective laws. The official approval of the Commission is required for every report and release of the results of the examinations given by the Boards and for resolutions of the Boards granting certificates of registration, with or without examination, to foreign applicants for the practice of their professions or occupations on the basis of reciprocity. The Commission is also empowered to review decisions of the Board on administrative cases appealed to it for final ruling. 5. Fixing of examination and registration fee. The Commission is authorized to determine, fix and collect the fees or amounts to be charged for the examination given by the various Boards, registration of successful examinees, registration without examination of applicants for the practice of professions, certified statements, surcharge (extra amount added to the usual charge), and fees other than those specified by Republic Act No. 6511. The Commission is further authorized to the approval of the Office of the President, to amend the rates of fees or charges specified by Republic Act No. 6511. 6. Prescribing of professional courses. The Commission, together with the respective licensing Boards and the Minister of Education and Culture or his representative, is authorized to prescribe collegiate courses requisite for the practice of the legally established professions. 7. Supervision of aliens authorized to practice their professions. The Commission has general supervision over foreign nationals authorized and granted special permits to practice their professions in the Philippines temporarily. In the discharge of this function, the Commission also sees to it that the terms and conditions for the employment of such aliens are strictly observed and adhered to. 8. Discretionary function. Aside from the substantive duties allocated to it by Presidential Decree No. 223, the Commission also performs ministerial functions for the various licensing Boards, as follows: a. To determine and fix places and dates of examinations to be given by the licensing Boards; b. To administer and conduct the examinations given by the Boards according to the rules and regulations promulgated by it;

c. To procure and appoint supervisors (proctors) and watchers to assist in the conduct of the said examinations; d. To help and maintain registers of candidates and granted certificates of registration for the practice of the professions and occupations; e. To release certificates of registration issued by the licensing Boards after such certificates are signed by all the members of the respective Boards and the Commissioner (Chairman of the Professional Regulation Commission) and authenticated by the official seals of the respective Boards; and f. To have custody of all the records of the licensing Boards, namely: all extra copies of examination questions, examination papers; reports of examination results, and all papers pertinent there to; minutes of meetings of the Boards; records of the proceedings and deliberations of the Boards; records of administrative cases and investigations handled by the Board and all of the records pertaining to the licensing Board. BRIEF HISTORY The Professional Regulation Commission was first created as a national government agency by Presidential Decree (P.D.) No. 223 dated June 22, 1973 signed by then President Ferdinand E. Marcos. It was previously called the Office of the Boards of Examiners created by Republic Act No. 546 on June 17, 1950 under the Civil Service Commission (CSC). The PRC became operational on January 4, 1974 with the assumption into office of the first set of appointed Commissioners and Associate Commissioners. The Implementing Rules and Regulations of P.D. No. 223 are promulgated on December 9, 1974. Under P.D. 223, professional regulation is standardized for the thirty-three (33) professions then under the PRC. The CSC building at P. Paredes Street in Sampaloc, Manila becomes the PRC Main Building on February 12. In 1992, Atty. Hermogenes P. Pobre assumes office as Commissioner. President Fidel Ramos issued the Executive Order No. 266 on July 25, 1995 institutionalizing CPE and making it mandatory for the renewal of professional license. Administrative Order No. 260 is issued in March further strengthening the CPE Councils by attaching them to the PRBs and providing for their personnel complement and Trust Fund. The Office of the CPE Councils is inaugurated on September 11. The CPE was fully implemented for all professions with the issuance of Executive Order No. 266. In 1999, PRC launches its website in tie-up an application service provider. Information dissemination campaign on CPE, licensure examinations, and test questions data banking system is conducted. The year 2000 saw the approval of the PRC Modernization Act. Hon. Antonieta Fortuna-Ibe assumes office as the first lady Chairperson on August 1. The Commission set new Thrusts and Priorities in 2001: Customer-Focused Service, Modernization through Full Computerization and Restructuring, Integrity of Licensure Examinations, Good Governance, Protection and Promotion of Filipino Professionals and Support to National Development Priorities. In 2006, the CPE is re-institutionalized while the PRC Hymn is adopted.

Investigates cases against erring examinees and professionals. Its decisions have the force and effect of the decisions of a court of law, with the same level of authority as a Regional Trial Court. After the lapse of the period within which to file an appeal, Commission decisions become final and executory. B. Quasi-Legislative Formulates rules and policies on professional regulation. When published in the official gazette, these rules have the force and effect of law. C. CONTINUING PROFESSIONAL EDUCATION (CPE) Continuing education (called further education in the United Kingdom and the Republic of Ireland) is an all-encompassing term within a broad spectrum of post-secondary learning activities and programs. The term is used mainly in the United States and Canada. Recognized forms of post-secondary learning activities within the domain include: degree credit courses by

non-traditional students, non-degree career training, workforce training, formal personal enrichment courses (both on-campus and online) self-directed learning (such as through Internet interest groups, clubs or personal research activities) and experiential learning as applied to problem solving. CONTINUING EDUCATION GENERALLY General continuing education is similar to adult education, at least in being intended for adult learners, especially those beyond traditional undergraduate college or university age. However, it is not normally considered to include basic instruction such as literacy, English language skills, or programs such as vocational training or general education (GED) preparation. Instead, as the term suggests, it is assumed that the student already has an education and is simply continuing it. CONTINUING EDUCATION PROFESSIONALLY Within the domain of Continuing Education, professional continuing education is a specific learning activity generally characterized by the issuance of a certificate or continuing education units (CEU) for the purpose of documenting attendance at a designated seminar or course of instruction. Licensing bodies in a number of fields impose continuing education requirements on members who hold licenses to practice within a particular profession. These requirements are intended to encourage professionals to expand their knowledge base and stay up-to-date on new developments. Depending on the field, these requirements may be satisfied through college or university coursework, extension courses or conferences and seminars attendance. Although individual professions may have different standards, the most widely accepted standard, developed by the International Association for Continuing Education & Training, is that ten contact hours equals one Continuing Education Unit.

LEGAL BASES OF CPE I. 1987 Philippine Constitution, Sec. 14, Art. XII The sustained development of a reservoir of national talents . . . professionals . . . shall be promoted by the State. II. RA 8981- PRC Modernization Act of 2000 A. Specific Powers of PRC (Section 7-a, n, and y) Regulation and licensing of various professions and occupations, including the enhancement and maintenance of professional and occupational standards and ethics and the enforcement of the rules and regulations. B. Powers, Functions and Responsibilities of PRBs (Sec. 9-b) To monitor the conditions affecting the practice of the profession or occupation under their respective jurisdictions and whenever necessary, adopt such measures as may be deemed proper for the enhancement of the profession or occupation and/or the maintenance of high professional, ethical, and technical standards. III. Executive Order No. No. 220 Directing the Adoption of the Code of Good Governance for the Professions in the Philippines (June 12, 2003) In providing professional services, a certain level of competence is necessary, i.e., knowledge, technical skills, attitudes, and experience. Professionals shall, therefore, undertake only those professional services that they can reasonably deliver with professional competence. Corollary to this, it is their express obligation to keep up with new knowledge and techniques in their field, continually improve their skills and upgrade their level of competence, and take part in lifelong continuing education program. IV. PRC Res. No. 2004-179, Series of 2004 : Standardized Guidelines and Procedures for the Implementation of the Continuing Professional Education for all Professions Whereas, the said Code was adopted by the PRC and the forty-one (41) PRBs, embodying principles of professional conduct, specifically integrity and objectivity, professional competence, and global competitiveness; RATIONALE OF CPE I. National Council for Global Competitiveness Ensure that our own professionals are globally competitive in preparation for the effects of economic globalization. II. World Trade Organization As a sovereign member state, the Philippines has to deal with and prepare for the implementation of the General Agreement on Trade in Services (GATS) General Agreement on Trade in Services (GATS) It is a treaty of the World Trade Organization (WTO) that entered into force in January 1995 as a result of the Uruguay Round negotiations.

The treaty was created to extend the multilateral trading system to service sector, and constitutes the legal framework through which World Trade Organization (WTO. Members progressively liberalize trade in services, including health-related services. Within the GATS framework, trade in health services is understood as the provision of specialized and general health personnel, nursing services, hospital services, ambulance services, and physiotherapeutic and paramedical services provided by medical and dental laboratories. According to GATS: Recognizing the growing importance of trade in services for the growth and development of the world economy. Desiring to facilitate the increasing participation of developing countries in trade, in services and the expansion of their service exports including, inter alia, through the strengthening of their domestic services capacity and its efficiency and competitiveness. III. Association of Southeast Asian Nations (ASEAN) As member state, the Philippines have to ensure that the Filipino professional is compliant with established requirement in various Mutual Recognition Arrangements/Agreements (MRA) entered into under the ASEAN Framework Agreement on Services (AFAS). ASEAN Framework Agreement on Services (AFAS) It is a treaty of the Association of Southeast Asian Nations (ASEAN) that entered into force in December 15, 1995. According to Article I, Par. 1 AFAS: To enhance cooperation in services amongst Member States in order to improve the efficiency and competitiveness, diversify production capacity and supply and distribution of services of their service suppliers within and outside ASEAN. PRC RESOLUTIONS AFFECTING NURSING PRACTICE PRC RESOLUTION NO. 2004-17 SERIES OF 2004 Re- implemented Continuing Professional Education requiring sixty (60) credit units for three years for professionals with bachelors degree. Any excess unit earned cannot be carried on the next three year period except for units earned for doctoral and masteral degrees. The total CPE units for registered professionals without baccalaureate degrees shall be thirty (30) units for three (3) years. Any excess shall be not be carried to the next three-year period. REVISION OF CPE FOR PROFESSIONAL REGULATORY BOARDS AT THE PRC All professions have the responsibility to ensure that each professional develops and maintains competence necessary for the safety and benefit of the public it serves. Nursing, like all the other professions, encourages the professionals commitment to lifelong learning. While the Board of Nursing expects each professional to develop and maintain competencies that are expected of their work, it is the individual responsibility of the nurse to see that he/she is updated in knowledge and skills and does not put the public at risk in the performance of his/her work. PRC Resolution 2004-179 contains the Standardized Guidelines and Procedures for the Implementation of the Continuing Professional Education for All Professions. In this set of guidelines, CPE remains voluntary and cannot be mandated as a requirement in the renewal of professional IDs. In the interest of maintaining the professionals capability to deliver services with the highest standards and quality that promotes the general welfare of the public, each professional is expected to maintain and improve the professions standards. Last August 1, 2008, Resolution No. 2008-466 Series of 2008 entitled Revised Standardized Guidelines and Procedures for the Implementation of the CPE/CPD System for All Registered and Licensed Professionals was passed by PRC. PRC RESOLUTION NO. 2008-466 SERIES OF 2008 Repealing Resolution 2004-179, Series Of 2004, The Standardized Guidelines And Procedures For The Implementation Of The Continuing Professional Education/Development (CPE/ CPD) System For All Professions And Implementation Of Revised Standardized Guidelines And Procedures For The Implementation of The CPE/ CPD System For All Registered And Licensed Professionals WHEREAS, Section 14, Article XII of the 1987 Philippine Constitution partly provides that The sustained development of a reservoir of national talents... professionals... shall be promoted by the State; WHEREAS, the Professional Regulation Commission (the Commission), under Section 7 (a), (n), and (y) of Republic Act (RA) No. 8981 otherwise known as the PRC Modernization Act of 2000, has these specific powers: (a) To administer, implement and enforce the regulatory policies of the national government with respect to the regulation and licensing of the various professions and occupations under its jurisdiction including the enhancement and maintenance of professional and occupational standards and ethics and the enforcement of the rules and regulations relative thereto; (n) To adopt and promulgate such rules and regulations as may be necessary to effectively implement policies with respect to the regulation and practice of the professions; (y) To perform such other functions and duties as may be necessary to carry out the provisions of this Act, the various professional regulatory laws, decrees, executive orders and other administrative issuances;

WHEREAS, Section 9 (b) of R.A. No. 8981 provides that one of the Powers, Functions and Responsibilities of the Various Professional Regulatory Boards (PRBs) is [T]o monitor the conditions affecting the practice of the profession or occupation under their respective jurisdictions and whenever necessary, adopt such measures as may be deemed proper for the enhancement of the profession or occupation and/or the maintenance of high professional, ethical and technical standards,...; WHEREAS, the formulation of the policy on CPE is in consonance with the objective to enhance and maintain high professional and occupational, ethical and technical standards in the practice of the professions; WHEREAS, the President of the Republic of the Philippines issued on June 23, 2003, Executive Order (E.O.) No. 220, [Directing the Adoption of the Code of Good Governance for the Professions in the Philippines; WHERERAS, the said Code was adopted by the Commission and the forty-four (44) PRBs, embodying principles of professional conduct, specifically, integrity and objectivity, professional competence, and global competitiveness; WHEREAS, all the forty-three (43) PRBs and the forty-three (43) accredited professional organizations (APOs) are in favor of implementing a CPE in the practice of their respective professions; WHEREAS, the Commission , as the instrument of the Filipino people in securing for the nation a reliable, trustworthy and progressive system of developing professionals whose competencies are globally competitive, has decided to prescribe guidelines and procedures to carry out the CPE for the registered and licensed professionals; WHEREFORE, the Commission hereby RESOLVED, as it now RESOLVES, to prescribe, issue and promulgate the Revised Standardized Guidelines and Procedures for the Implementation of the Continuing Professional Education/Development (CPE/ CPD) system for All Registered and Licensed Professionals, which is made an integral part hereof as Annex A. This Resolution shall take effect after fifteen days following its complete and full publication, in the Official Gazette or any newspaper of general circulation. Done in the City of Manila, this 1st day of August, 2008.

ANNEX A ARTICLE I CPE DEFINITION, OBJECTIVES, NATURE, AND RATIONALE (Note: The texts highlighted in red indicates the revisions made in this resolution.) Section 1. Definition. Continuing Professional Education (CPE) refers to the inculcation, assimilation and acquisition of knowledge, skills, proficiency and ethical and moral values, after the initial registration of a professional that raise and enhance the professionals technical skills and competence. Section 2. Objectives. (Addition of objective) The CPE programs shall have these objectives: (1) To provide and ensure the continuous education of a registered professional with

the latest trends in the profession brought about by modernization and scientific and technological advancement; (2) To raise and maintain the professionals capability for delivering professional services; (3) To attain and maintain the highest standards and quality in the practice of his/her profession; (4) To comply with the professionals continuing ethical requirements; (5) To make the professional globally competitive; and (6) To promote the general welfare of the public. Section 3. Nature. (The word voluntary was removed) The CPE programs consist of properly planned and structured activities, the implementation of which requires the participation of a determinant group of professionals to meet the requirements of maintaining and improving the occupational standards and ethics of the professionals. Section 4. Rationale. (Removal of the word voluntary) Compliance with the CPE program is deemed a moral obligation of each professional and within the context of the concerned professions code of ethics and is considered a necessary, effective and credible means of ensuring competence, integrity and global competitiveness of professional in order to allow him/her to continue the practice of his/her profession. ARTICLE II THE CPE COUNCILS: CREATION, COMPOSITION, TERMS OF OFFICE, FUNCTIONS AND MEETINGS Section 5. Creation. Each of the concerned Professional Regulatory Board (PRBs), upon approval by the PRC (the Commission), shall create a Council within thirty (30) days from the effectivity of this resolution. This shall be known as the CPE Council (the CPEC or the Council) which shall assist its corresponding PRB in implementing its CPE programs. Section 6. Composition. Each CPE Council shall be composed of a chairperson and two (2) members. The chairperson of each CPE Council shall be chosen from among the members of the PRB by the members themselves. The first member shall be the president or, in his absence or incapacity, any officer chosen by the Board of Directors of the Accredited Professional Organization (APO). The second member shall be the president or, in his absence or incapacity, any officer of the organization of deans or department heads of schools, colleges or universities offering the course requiring licensure examination. In the absence of such organization, the second member shall be chosen and appointed by the PRC from at least three (3) recommendees of the PRB concerned. Said recommendees shall be well-known academicians. All members of the Council shall be appointed by the Commission and shall take their oath of office before any or all member/s of the Commission. Section 7. Terms of Office. (addition) The term of office of the chairperson of each Council shall be co-terminus with his/her incumbency in the PRC or determined by his/her capacity to fully discharge such functions. Should a change be required by the PRB before the end of the Council Chairpersons incumbency, the necessary replacement shall be nominated/named by the simple majority of the PRB and thereafter appointed by the Commission in accordance with due process. The first member shall have a term of office co-terminus with his/her incumbency as officer of the APO; the second member shall have a term of office coterminus with his/her incumbency as officer of the organization of deans or heads of departments. In the case of the academician chosen and appointed by the Commission, his/her term of office shall be for two (2) years with one reappointment. Except in the case of the

academician-member, upon the expiration of their respective terms of office in the PRB, APO or organization of deans or heads of departments, the chairperson, first member and second member shall continue to function as such in the Council until the appointment or election of their respective successors in the PRB, APO or organization. Section 8. Exercise of Powers and Functions. Each Council shall, upon a majority vote, exercise powers and functions which shall include but shall not be limited to the following: 1. Accept, evaluate and approve applications for accreditation of CPE providers. 2. Accept, evaluate and approve applications for accreditation of CPE programs, activities or sources as to their relevance to the profession and determine the number of CPE credit units (CUs) to be earned on the basis of the contents of the program, activity or source submitted by the CPE providers. 3. Accept, evaluate and approve applications for exemptions from CPE requirements. 4. Monitor the implementation by the CPE providers of their programs, activities or sources. 5. Assess periodically and upgrade criteria for accreditation of CPE providers and CPE programs, activities or sources. 6. Perform such other related functions that may be incidental to the implementation of the CPE programs or policies. Section 9. Functions of the Council Chairperson. Each Council Chairperson shall have the following functions: 1. To preside over the meetings of the Council. 2. To direct or supervise the activities of the Council. 3. To submit minutes of regular and special meetings within thirty (30) days from date of said meetings. 4. To submit Council annual reports before the end of February of the succeeding year. 5. To issue the certificate of accreditation (the CoA) to CPE providers found by the Council to be qualified in accordance with these Guidelines as well as certificate of accreditation of program/s (the CoAP), activities and sources. Section 10. Secretariat. The Chairperson of the Commission shall designate or appoint an official of the Commission with the rank not lower than Division Chief who shall act as the Secretary of all CPE Councils. The designated official may participate in the deliberations of the CPE Councils but shall not vote. His/her duties and functions shall be as follows: 1. To see to it that the sessions, meetings or proceedings of the Councils are recorded; 2. To prepare the minutes of all the meetings and proceedings of the Councils; 3. To receive applications for accreditation of CPE providers, programs, activities or sources; 4. To submit to the Councils applications for accreditation of aspiring CPE providers and CPE programs, activities or sources; 5. To release Certificates of Accreditation to CPE providers and programs, activities or sources; 7. To assist the Councils by providing relevant statistical data on the renewal of professional licenses and other related matters.

The Secretary shall exercise general supervision and control over each of the Council Secretaries, the staff of which shall be selected by the Chairperson of the Commission from among the existing personnel of the Commission. Each of the Council Secretaries shall have, among others, the following functions: 1. To release CPE Certifications of credit units (the CUs) earned to the registered and licensed professionals concerned; 2. To keep all records, papers and other documents relative to the evaluation, approval and accreditation of CPE programs, activities or sources; 3. To maintain records of accredited CPE providers, ongoing, continuing or completed CPE programs, activities or sources, the list of participants and other relevant data. Section 11. Meetings. The Councils shall hold regular meetings once a month on dates to be fixed by said Councils. Special meetings may be called by a Chairperson or upon written request of at least a member of a CPE Council. Section 12. Budgetary Requirements. (new section) Budgetary Requirements Direct costs and other expenses of all the councils may be provided for in the annual Commission Budget. Section 13. Involvement of the Accredited Professional Organization (APO). (new section) The Council, if the need arises, and upon approval of the Commission, may delegate to the APO the processing of the application, keeping of all records of CPE providers and their respective programs and credit units (CUs) earned by each registered and licensed professional who avail of the CPE programs and related functions. For this purpose, the APO may create a counterpart CPE Council known as APO CPE Council (the APO-CPEC) and may ask for reimbursement of reasonable processing and recordkeeping fees directly from the applicants apart from the accreditation fee that such applicants pay directly to the Commission. The APO CPEC shall keep separate books of accounts of its expenses and amounts collected from applicants and make a monthly report thereof to the Commission through the PRB. Any excess collection shall be used exclusively as working capital of the APO for the CPE activities. ARTICLE III CRITERIA FOR ACCREDITATION OF PROVIDERS, PROGRAMS, ACTIVITIES OR SOURCES; EQUIVALENT CREDIT UNITS; CREDIT REQUIREMENTS; EXEMPTIONS AND OTHER MATTERS Section 14. Criteria for Accreditation. In order to merit accreditation, the following criteria shall be complied with: A. For CPE Provider 1. Must be a duly registered organization, firm, institution or agency, or a registered and licensed professional of good standing in the APO concerned, and who has never been convicted of a crime; 2. Shall have an established mechanism for measuring the quality of the program being offered or administered; 3. Must have adequate, modern and updated instructional materials to carry out the CPE programs and activities;

4. Shall have a pool of regular instructors, lecturers and resource speakers with good moral character and technical competence and must be holders of current/valid professional registrations and licenses, if they are professionals regulated by the Commission. B. For CPE programs, activities or sources 1. The scope shall be beyond the basic preparation for admission to the practice of the profession. The contents shall be relevant/related, but not limited, to the practice of the profession. 2. The programs, activities or sources shall enhance the competence of the registered and licensed professional by upgrading and updating knowledge and skills for the practice of the profession as brought about by modernization and scientific and technical advancements in the profession. Section 15. Programs, Activities and Sources for Accreditation and Equivalent Credit Units. (addition) Any provider may submit to the CPE Council programs, activities or sources to be approved and accredited for credit units (CUs) units. No CPE provider shall be allowed to conduct CPE programs, activities or sources without prior approval and accreditation from the Council. As used in these guidelines, the following terms shall mean: 1. Seminars shall refer to the gathering of registered and licensed professionals which shall include, among others, workshops, technical lectures or subject matter meetings, non-degree training courses and scientific meetings. 2. Conventions shall refer to a gathering of registered and licensed professionals which shall include, among others, conferences, symposia or assemblies for round table discussions. 3. Doctoral Degree shall refer to a post graduate degree from a recognized school, college or university. 4. Masteral Degree shall refer to a graduate degree from a recognized school, college or university. 5. Fellowship shall refer to the completion of a post-doctoral training program in a specific field pre-approved by a duly recognized institution, scientific faculty meeting and the like. 6. Residency/Externship shall refer to apprenticeship training at the graduate level which is beyond the basic preparation for the regulated and licensed health professionals. This should be conducted by duly-accredited hospitals and medical centers and the like. 7. Authorship shall refer to the ownership of intellectual property which includes technical or professional books, instructional materials and the like. Credit units (CUs) earned must be claimed within one (1) year from the date of publication. 8. Self-Directed Learning Package shall refer to learning which uses course manuals or accredited learning modules. Accredited learning modules include selfinstructional materials or programs which may be in the form of printed manual, audio and video cassette tapes, films, computer-assisted learning (CAL), study kits, learning aids and modules or the use of the information highway. These should include among others, clearly defined objectives, adequate content and an evaluation component for each module. 9. Post Graduate/In-Service Training shall mean training or specialization at the post graduate level for a minimum period of one (1) week.

10. Resource Speaker shall refer to a professional who acts as discussion leader or lecturer, in a convention or seminar or similar gathering. 11. Peer Reviewer shall refer to a professional who acts as an evaluator of a research paper, conference paper or journal article before it is presented or published. 12. CPE Provider shall refer to a natural person or a juridical entity which includes among others, accredited or non-accredited professional organization, firm, partnership, corporation or institution which offers, organizes or arranges CPE programs, activities or sources for implementation and administration. 13. CPE Programs, Activities or Sources shall refer to the regime of CPE which enhance the competence of the professional by upgrading and updating knowledge and skills for the profession as brought about by modernization and scientific and technical advancements in the profession. The scope shall be beyond the basic preparation for admission to the practice of the regulated profession. The content shall be related but not limited to the practice of the profession. The following is the Matrix for CPE programs, activities or sources with their corresponding credit units and supporting documents required. Section 16. CPE Credit Units. (addition) The total CPE credit units (CUs) for registered and licensed professionals with baccalaureate degree shall be sixty (60) credit units for three (3) years. Any excess credit units earned shall not be carried over to the next three-year period except credit units earned for doctoral and masteral degrees or for other special training. The total CPE credit units (CUs) for registered and licensed professionals without baccalaureate degrees shall be thirty (30) credit units for three (3) years. Any excess shall not be carried to the next three-year period. One credit hour of CPE program, activity or source shall be equivalent to one (1) credit unit.

Programs and activities conducted by providers which were not pre-accredited may be given credit upon submission of documents relevant to the programs to the APO CPEC and upon approval of the Council. Section 17. Procedures. Each Council shall observe the following procedures for the accreditation of CPE providers and CPE programs, activities, or sources: A. Procedure for Accreditation of CPE provider: I. In case of natural persons: 1. Any person seeking to offer an organized or arranged program, activity or source shall accomplish and submit to the appropriate Council an application form. 2. An application shall include, but shall not limit to the following information: a. Full name, address and telephone number of the applicant-provider. b. Relevant educational background. c. Profession, principal area of professional work and number of years in the legal practice of the regulated profession. d. PRC License Number and date of expiration. e. Current employment. 3. Applicant-provider shall submit a valid NBI clearance. II. In case of juridical entity: 1. Any agency, organization, institution, association or similar juridical entity seeking to offer an organized program, activity or source shall accomplish and submit to the appropriate Council an application form. 2. An application shall include, but shall not be limited to, the following information and documents: a. Full name, address and telephone/fax number/s and e-mail address. b. Securities and Exchange Commission (SEC) or Department of Trade and Industry (DTI) original registration papers. c. List of officers with their PRC License Numbers and expiry date if officer is a member of a regulated profession. d. Plans for CPE programs or activities for the year applied. e. Proof of past CPE activities or programs conducted / arranged (immediate past year) for applicants renewing accreditation (not required for first time applicants). III. All applicants shall submit to the CPE / CPD Council concerned the following: 1. Mechanism for measuring the quality of the program, activity or source being offered. 2. Criteria for selecting and evaluating speakers, resource persons or lecturers. IV. Issuance by the Council of Certificate of Accreditation (CoA) as CPE provider in the case of natural persons and juridical entities and their programs, activities and sources by the Commission Proper. Accreditation shall be for a period of three (3) years, renewable every three (3) years.

B. Procedures for Accreditation of a CPE Program, Activity or Source 1. A CPE provider seeking accreditation of an organized or arranged CPE program, activity or source shall submit said program, activity or source (in triplicate) to the Council concerned for its evaluation and approval. The program, activity, or source shall cover a period not to exceed three (3) years. 2. The application for accreditation of a CPE Program, activity or source shall include the following information and documents: a. Title/s of program/s, activity/ies or source/s. b. Name of CPE provider, address, phone and fax numbers. c. Date and venue of the Administration of the program. d. Objectives. e. Targeted audience or participants. f. Contents and number of hours. g. Resource speakers, lecturers, discussion leaders, panelists, reactors, moderators, and facilitators, including their qualifications and current PRC license if they are members of the regulated profession. h. Actual program and schedule. i. Submission of the proposed budget and seminar or convention fee to be collected shall be reviewed by the Council. j. Seminar or convention fee to be collected. k. Evaluation to be used which could either be any of the following modes or systems: i. evaluation of seminar by participant. ii. evaluation of participants by CPE providers; tests. iii. other methods of evaluation 3. If the Council concerned finds the CPE program, activity or source to be relevant to the profession, cost effective to the participants and to be in accordance with these guidelines, said Council shall issue a certificate of accreditation within thirty (30) days from receipt of the application. Section 18. Post-Accreditation Requirements. Upon the completion of an accredited CPE program, activity or source, the CPE provider shall submit a report to the Council concerned within fifteen (15) days from the last day of the offering. The report shall include, but shall not be limited to the following information: 1. 2. 3. 4. Name of CPE provider. Name or description of CPE program, activity or source. Accreditation number and date of issuance of accreditation. Certified list of participants indicating names and PRC professional license/identification (ID) cards and expiry dates, resource speakers, lecturers, discussion leaders, panelists, moderators or facilitators who took part or participated in the CPE program, activity or source. Date and time of start and completion of the holding of the CPE program, activity or source. Venue/Location of the holding of the program. Summary of evaluation results of participants. Name of Secretariat representative who monitored the CPE program or activity.

Section 19. Sanctions. (new section)

a. Accredited CPE Provider Accreditation shall be withdrawn from the CPE Provider who: 1. Is found not complying with the prescribed rules and regulations for CPE, or 2. Has committed substantial deviation from the approved program, or 3. Has submitted false reports, or 4. Has committed such other acts that the Council finds to be in violation of the intent of the program. b. Commission Employees Any employee of the PRC who causes, abets or helps in the renewal of the ID card / license of a registered professional without complying with CPE requirements shall be considered to have violated office and/or civil service rules and regulations and shall be proceeded against administratively, and, if found guilty, shall be meted out the penalties provided for by the said laws and rules and regulations. ~~~ Nothing follows ~~~ The changes provided for in the approved resolution are deigned to be important which hopefully will strengthen the CPE Councils of all Professional Regulatory Boards. The CPE Council for Nursing, chaired by Hon. Perla G. Po, with the members, Dr. Leah S. Pacquiz and Dr. Carmelita Divinagracia, is ready to explore and create a more concrete mechanism to put the above resolution into effect as soon as possible.

STANDARDS FOR NURSING SPECIALTY CERTIFICATION


Nurses who opt to engage in advanced or specialty practice in the Philippines require specialty certifications from the Nursing Specialty Certification Council (NSCC). Specialty certification is a process of validating the qualifications of Nurse Clinician (NC) and/or Clinical Nurse Specialist (CNS) whether in chronic, acute or critical nursing care and linking resources and to optimize outcomes from patients, families and health care providers (PRC-BON Manual, p.20). This specialty certification is available in the following areas: community health nursing specialty; medical-surgical nursing specialty; mother and child nursing specialty; and mental health and psychiatric nursing specialty. It has three (3) levels, namely: Level I Nurse Clinician; Level II Nurse Clinician II, and Level III Clinical Nurse Specialist. The program for the specialty practice is composed of didactic/ theoretical, practicum/ clinical and written examination to be administered by the Specialty Certification Board concerned. The NSCC shall issue certifications as NC and/ or CNS after the nurses have complied with the following requirements: a) Submission of certified copy of Transcript of Records (TOR) of BSN and graduate M.N. degrees; b) Submission of documents showing completion of requirements (clinical/ academic) for the level applied for; and c) Recommendation of NSCC to BON for the issuance of certification for the level applied for.

The specialty certification is valid for the period of five (5) years from the date of issuance, renewable within thirty (30) days before its expiration. There are two policy issuances in the specialty certification program, as follows: a) Adoption of a Nursing Specialty Program and Creation of a Nursing Specialty Certification Council (PRC-BON Resolution No. 14, s. 1999); and b) Guidelines for the Implementation of Board Resolution No. 99-14, s. 1999 [Re: Adoption of a Nursing Specialty Program and Creation of a Nursing Specialty Certification Council (NSCC)] (PRC-BON Resolution No. 118, s. 2002). The following are the exact reproductions of said guidelines/ standards for easy reference: BON RESOLUTION NO. 14, S. 1999 Adoption of a Nursing Specialty Program and Creation of a Nursing Specialty Certification Council SPECIALTY CERTIFICATION IN NURSING PROCESS OF ROLE DEVELOPMENT IN NURSING A. FRAMEWORK A prevailing theme in both society and health care today is that one must do more with less in a short time and at less cost. Evert expenditure is scrutinized and critically evaluated in terms of increase efficiency and improved quality. The role of the clinical nurse specialists (CNS) has been valued, their roles and responsibilities expanded. The challenges facing health care today are so complex that they require nurses to excel and advance not only in clinical practice but also in system insight and analysis through experience and advanced education. The CNS is in a very unique position to provide these skills. Notwithstanding the knowledge and expertise of the advanced clinician, the CNS is able to provide a greater range and depth of knowledge, anticipation of patient responses, and judgment about non-clinical variables and clarify the rationale for clinical decisions. The process of role development in nurses has been conceptualized by several authors. Patricia Benner identifies five stages of skills acquisition in clinical nursing practice based on Dreyfus Model: novice, advanced beginner, competent, proficient and expert. Although Benner did not focus on CNS, the process of roles development and skill acquisition that she described could be applied to the development of CNS in any setting. B. DEFINITION Specialty certification is the process whereby qualified agents, based on a variety of measure and assessment strategies, confirm or attest that individual nurses who underwent training and instruction for advanced nursing practice in specialized nursing services meet minimum standards set at specified times. Broadly, certification is a mechanism that is used to validate achievement of a level of clinical specialty or functional expertise and competence that goes beyond the level basic licensure. Specifically, the act of a competent authority, embodied in a document certifying that one has fulfilled the requirements of and may practice in a particular level and field of specialization.

C. ASSUMPTION Health care consumers have the right to expect health professionals to provide high quality care. D. NURSING SPECIALTY CERTIFICATION COUNCIL 1) Mission to certify and promote that optimally contributes desired patient care outcomes 2) The Board of Nursing (BON) under the Professional Regulation Commission (PRC) is committed to the provision of quality certification programs, removal of barriers to certification and recertification and active participation in influencing and shaping health care delivery through certified practice. For this purpose, a Nursing Specialty Certification Council is hereby created which shall be directed responsible to the BON. 3) The Nursing Specialty Certification Council (NSCC) through the Specialty Certification Boards (SCBs) shall administer the program on three levels. In order ti protect the health care consumer, it shall validate the knowledge of nurses who provide nursing care. The BON shall assign an organization that shall monitor and evaluate as well as accredit and certify institutions, programs, and individuals. 4) Sub-specialty boards under the four major groups of Nursing Specialties may be organized provided that the criteria set by the Council approved by the BON shall be followed. The Council shall formulate guidelines and procedures subject to the approval of the BON for the creation of sub-specialty boards providing for the number of officers for each sub-specialty boards providing for the number of officers for each sub-specialty board; their term of office and the qualifications of the members of the specialty boards. 5) Organization Structures a. The Nursing Specialty Certification Council (NSCC) shall be composed of five officers namely: Chairman, Vice Chairman, Secretary, Treasurer, Business Manager. The Chairman of the Council shall be a member of the Board of Nursing designated by its Chairman, whose term in the Council shall be co-terminus with their term in the BON. The Vice Chairman, Secretary, Treasurer, and Business Manager shall be appointed by the Chairman of the PRC from the recommendees (2 for each position) of the BON to serve for a term of three years with reappointment. The recommendees of the BON shall be chosen from the nominees (1 nominee for each position) of the presidents of the SEC registered associations in each of the four major groups of Nursing Specialties. The Vice Chairman shall sit as a Chairman in the absence of the Chairman in case the member from the BON has not been designated or the term of the member of the BON has expired and no BON member has been designated or the chairman is incapacitated to act. The Business Manager shall be the Consumer Representative.

b. The Nominating Committees There shall be organized in each of the four (4) Major Groups of Nursing Specialties a Nominating Committee (NC) composed of a Chairman and two members who shall serve for a term of three (3) years with re-appointment. The Chairman and the members of the NC shall be appointed by the Chairman of the BON upon the recommendation of the council shall be chosen from the nominees (3 nominees for each position) of presidents of the SEC registered associations in each of the four (4) Major Groups of Nursing Specialties. It shall be the duty of the Nominating Committees of the four (4) Major Groups of Nursing Specialties to ensure the selection of impartial, component and qualified Chairman and Members of Appeals Panel and the Specialty Certification Boards. The NC shall strictly observe the criteria and qualification standards adopted by the council after its organization and approved by the BON. c. The following qualifications shall be considered in the selection of the members (except the Chairman) of the Council: i. Must be visionary, able to think conceptually, objectively and analyze from systems perspective. ii. Must be articulate and effective in written and oral communication. iii. Must be a team leader with excellent interpersonal skills. iv. Must be capable of critical thinking and possess analytical ability. v. Must be trustworthy, ethically and morally upright and consistently demonstrate integrity in all situations. vi. Must be committed to the mission and the values of the association and the nursing profession. vii. Must be connected in any capacity in a review center, such as officer, reviewer, partner, stockholder, or owner thereof or should not engage in any activity which would be in conflict with the interest of the Council. viii. Must be a registered nurse in good standing with a Masters Degree in Nursing and ten (10) years experience in general practice and five (5) years experience in any nursing specialty. 6) There shall be an Appeals Panel in each of the four (4) Major Groups of Nursing Specialties composed of Chairmen and two (2) members, who shall serve for a term of three (3) years with reappointment. The Chairperson and Members of the Panel shall be appointed by the Chairman of the BON upon recommendation of the Council. The recommendees (2 recommendees for each position) of the Council shall be chosen from the nominees (at least three (3) nominees for each position) of the Nominating Committees of the four (4) Major Groups of Nursing Specialties. The panel shall be directly responsible to the council. a. The Appeals Panel shall have the authority to decide appeals taken from the decisions of the Specialty Certification Boards and Sub-specialty Certification Boards. The decision of the Appeals Panel shall be final.

7) There shall be a Specialty Certification Board in each of the four (4) Major Groups of Nursing Specialties to be composed of the Chairman and the four (4) members who shall serve a term of three (3) years with reappointment. The Chairman and the Members of the Specialty Certification Boards shall be appointed by the Chairman of the BON upon recommendation of the Council. The recommendees (2 for each position) of the council shall be chosen from the nominees (at least three (3) nominees for each position) of the Nominating Committees of the four (4) Major Groups of Nursing Specialties. a. The Council shall adopt, subject to the approval of the BON, the qualifications and criteria for the selection of the members of the Appeals Panel and Specialty Certification Boards. b. The Specialty Certification Board in each of the four (4) Major Groups of Nursing Specialty Certification in each of three levels. c. The Presidents of the SEC registered associations in each of the four (4) Major Groups of Nursing Specialty Certification Board shall assist their respective Specialty Certification Board in determining the following: i. Criteria for each level ii. Basic competencies iii. Preparation required (both academic and clinical) iv. Number of contact hours required to show maintenance of competencies v. Minimum performance evaluation grade vi. Accredited institutions/s agencies to provide the required clinical competencies vii. Outputs necessary prior to certification e.g., type and nature of clientele, number of varied cases, or the participation in group research or individual study, judgment skills. d. The following Committees shall be organized by each Specialty Certification Board: i. Examination Development Committee - examine each test item in relation to the other items with emphasis on preventing world traps or double meanings ii. Subject Matter Experts Committee - to analyze the test and validate knowledge of nurses required for each specialty/ level of practice category in the specific area of specialty iii. Item Writers Committee - to formulate the test items and examine/ analyze test questions submitted within the framework of the required level of proficiency (knowledge/skills/attitudes) for each area of specialty/ level of practices. 8) The Council with the assistance of the SCB, shall formulate the criteria for the approval of the BON for the selection of the above named committees. 9) Certification shall be given for three (3) levels namely: *Level I *Level II *Level III Nurse Clinician I Nurse Clinician II Clinical Nurse Specialists

E. F. TESTING DEVELOPMENT PROCESS The SCB Certification Examination shall determine the focus on each of the major nursing specialty areas. Expert writers shall formulate the questions following a test item where knowledge levels and categories need to be matched. Once the test items are made, they shall pass through a review by the Item Writer Committee and shall move on to Examination Development Committee which is made up of selected writers. G. EXAMINATION The examination shall be given twice a year and the dates shall be determined by the SCB. The passing score shall be determined by using a standard setting method established by the content specialists with the assistance of a psychologist. H. RECERTIFICATION A nurse may use the following mechanisms for recertification: Category A Registered Nurse may use the CE Recognition points obtained from attending seminars and formal classes. Category B 1. Written an article for a professional organizations newsletter/ journal 2. Developed pamphlet/ handbook Category C 1. Given in-service education to nurses (as lecturer, resource person, panel reactor, keynote speaker, etc.) 2. Taught BCLS and ACLS 3. Presented a poster during a research forum 4. Presented grand rounds related to the nursing specialty area being applied for recertification Category D 1. Committee member/ officer of a local or national professional organization 2. CRITERIA
A. EDUCATIONAL REQUIREMENTS

LEVEL I Nurse Clinician I 1. R.N. 2. BSN + 12 units in MAN

LEVEL II Nurse Clinician II 1. R.N. 2. BSN + completed academic requirements in MAN 3. 120 contact hrs, 40 of didactic, and 80 hrs clinical component of training in specialty such as Pedia, OB, etc.

LEVEL III Clinical Nurse Specialist 1. R.N. 2. M.A.N. completed with an area of specialization either in Admin./ Research/ Training 3. Has conducted continuing education program, 150 contact hrs, (60 theoretical, 90 clinical sessions) of training in the past 2yrs. 4. Community exposure 40hrs.

3. 60 contact hrs, 20 of didactic, and 40 hrs clinical component of training in postgrad. courses

CERTIFICATION B. EXPERIENCE

SUCCESSFUL COMPLETION OF EXAMINATION REQUIREMENTS

1. 3yrs in an accredited institution with a minimum of 100 patients within the last 5 years.

1. 5yrs in an accredited institution with a minimum of 100 patients or community clients. Experience must be within the specialty area applied for. 2. Type of Hospital: Tertiary with occupancy rate of 80% or above

1. 10yrs in an accredited institution with a minimum of 200 patients or community clients. Experience may be in nursing administration education, clinical practice, research or community.

2. Type of Hospital: Secondary with occupancy rate of 80% or above C. PERFORMANCE D. RESEARCH VERY SATISFACTORY Research protocol with significance to improve client care must meet the criteria for scientific investigation

E. RESEARCH

Every 5 years recertification is shall be based on either a successful completion of examination or continuing education. Continuing education requirement may be met using in-service, grand rounds, academic credits, CCPEN credits and other programs.
