Generally,housingprojectsshouldconformwith the zoningordinanceof the


city/municipalitywhere they are locatedthus shall be in suitable sites for
housing. However,wherethere is no zoningordinanceor land use plan,the
predominantland use principleand site suitabilityfactorscited hereinshall be
used in determiningsuitabilityof a projectto a site.

Furthermore,if the prcject is undoubtedlysupportiveof other land uses and


activities(e.9.,housingfor industrialworkers)said prcjectshallbe allowed.

3. PhysicalSuitability

A potential site must have characteristicsassuring healthful, safe and


environmentallysound community life. lt shall be stable enough to
accommodatefoundationload without excessivesite works. Criticalareas
(e.9.,areassubjectto flooding,landslidesand stress)mustbe avoided.

4. Accessibllity

The site must be sewed by a road that is readily accessibleto public


transoortationlines. Said access road shall conform to the standardsset
herein of these Rules to ac@mmodateexpecteddemand caused by the
development of the area.In no caseshalla subdivisionprojectbe apprcved
without necessary access road/right-of-way constructed either by the
developeror the LocalGovemment Unit.

B. PlanningConsiderations

1. AreaPlanning

Projectdesignshouldconsidernot only the reductionof cost of development


to i minimum but also the prcvisionfor possiblefuture improvement or
expansion,as in the prescriptionof lot sizes, right-of-wayof roads, open
space,allocationof areasfor commonusesand facilities'

The minimumright-of-wayof major roads shall be in accordance


with the precedingtable. However,in cases wherethe major road
willserveas interconnectihg road,it shallhave a minimumright-of-
way of 10 meters.lt shall have a 1s-centimetermix gravel(pit run)

Malor roads shall maintaina uniform width of road right-of-way'


Taperingof road width shall not be allowedwhere the road right-of-

Subdivision projects abutting main publio road must provide


sufficient setbackswith a minimum dimensionof 3.0 meterc in
depth and 5.0 meters in length at both sides of the subdivision

architectswho are not licensedenvironmental plannersmay in the meantimestill
continueto sign site developmentplans of subdivisionpojects, for a period of 2
yearsfrom the dateof effectivityof theseRules.

Section25. SeparabilityGlause
Theprovision
of theseRulesarehereby andintheeventanyof
separable,
declared
such provisionsare declarednull and void, the validityof all other provisionsshall
not be affectedthereby.

WHEREAS;in the light of the mandatesof the HLURB,this Board and the
HUDCC jointly conduct.continuingdialogue/consultation with stakeholdersto
harmonize housing policies, rules and standards in support of recent policy
pronouncementsof the administration;

WHEREAS,pursuantto existinglaws, particularlyPD 1308,otherwiseknown as


the Law Regulatingthe Practice of EnvironmentalPlanning Professionin the
Philippines,and the Rules and Regulationspromulgatedby the Professional
Regulations Commissionpursuantthereto,the scopeof practiceof environmental
planningincludes,among othersthe preparationof conceptualschemesand site
developmentplans for subdivisionprojectsfor residentialand other urban uses;
and tfie signatureof licensedenvironmentalplannersis requiredto be affixedon
saidplans;

WHEREAS,this Board fulty supportsthe immediateimplementationof Executive


Order No. 45, prescribing time periods for issuance of housing related
certifications,clearances and permits and imposing sanctions for failure to
observethe same:

WHEREAS, various groups of real estate developers have brought to the


attentionof HUDCCand this Boardissuesrelativeto the implementation
of the
revisedlRRs for PD 957 and BP 220:

WHEREAS, upon thorough review and evaluationof the issues raised by the
developers'group, as well as the rationaland basis of their concerns,this Board
finds some of their requestsreasonable;

WHEREFORE,be it RESOLVED,as it is herebyRESOLVED,that the foltowing


amendmentsto the revised implementingrules and regulationsfor PD 957 and
