REGULATION ORDINANCE NO. 2005-228


AN ORDINANCE AMENDING SECTION 7 OF ARTICLE Ill OF REGULATION
ORDINANCE NO. 2003-233 OTHERWISE KNOWN AS "BASIC FISHERY
ORDINANCE FOR THE REGULATION, DEVELOPMENT, PROTECTION,
CONSERVATION AND DISPOSTION OF FISHERIES AND AQUATIC
RESOURCES AS WELL AS THE RELATED ACTIVITIES IN THE CITY OF
ILOILO"

Parcon and Eduardo L. Penaredondo
WHEREAS, the Local Government Code of 1991 recognizes the role of Sangguniang
Panlungsod in the protection of the environment and imposition of appropriate penalties for acts
which endanger the environment and such other activities which result in pollution, acceleration of
eutrophication of rivers and lakes, or of ecological balance;
WHEREAS, Article I, Section 16-25 of Republic Act 8550 known as "The Fisheries code of
1998" describes the role and scope of every Local Government Unit in the effective management,
conservation, development, protection, utilization and disposition of fish/fishery/aquatic resources
within their respective area of jurisdiction;
WHEREAS, lloilo River Development Council as created through Executive Order No. 63,
Series of 2004, recognizes the need to address the indiscriminate proliferation of fish pens and
illegal structures along lloilo River;
WHEREAS, IRDC finds out that there is a need to address siltation, increasing pollution,
poor aesthetics and the proposed development of the DPWH at the lloilo City;

WHEREAS, Section 7 of Article Ill of Regulation Ordinance No. 2003-233 limits the
existence of fishing structures like punots at areas from the Benigno Aquino Bridge downward to
the mouth of the river;
WHEREAS, after some consultation and committee hearings with BFAR, DENR, DPWH,
and the Green Forum, the committee has determined the need to expand the regulated zone for
fishing structures to include areas up to the Carpenter's Bridge, invoking the need to address the
problems;
WHEREAS, each concerned agency express their willingness to support the displaced
fisher folks for whatever alternative livelihood will be provided by the City Government.
NOW, THEREFORE, be it ordained by the Sangguniang Panlungsod of the City of lloilo,
that:
Section 1. - Section 7, Article Ill of Regulation Ordinance No. 2003-233 otherwise known
as "BASIC FISHERY ORDINANCE FOR THE REGULATION, DEVELOPMENT, PROTECTION,
CONSERVATION AND DISPOSTION OF FISHERIES AND AQUATIC RESOURCES AS WELL
AS THE RELATED ACTIVITIES IN THE CITY OF ILOILO", is hereby amended to read , as
follows:
"Section 7. Regulated Fishing Area. Fishing along the area from the
Beniano Aquino Bridge Diversion Road BridgeJ to Carpenter's Bridge
downward to the mouth of the river shall be limited only to sports fishing and no
fishing structures will be installed of active fishing methods is allowed.
Section 2. - Except for the above amendment, all other provisions of Regulation
Ordinance No. 2003-233 shall remain in full force and effect.
Section 3. - This ordinance shall take effect immediately upon approval.
