WHEREAS, the City of Pelican Bay desires to provide sanitary sewer

t.o the residents and property owners of t,he city; and

WHEREAS,the City of Pelican Bay desires to

contract with the City
of Azle for treatment of wastewater generated j-n Pelican Bay; and

WHEREAS,t,he City of Azle has agreed to treat wastewater generated

in Pelican Bay; and

WHEREAS, the City of Pelj-can Bay and the City of Azle have engaged
in negotiations resulting in the development of a draft document
identified as the Wholesale Wastewater Asreement between the two
entlties,. now theref ore

The city Council of the city of pelj-can Bay agrees to the terms
and conditions contained in the Wholesale Wastewater Ag,reement
between the city of Pelican Bay and the City of Azle as set forth
in Exhibit A to this Res o lu t io n , s u b je c t to the c it y of A zl e ' s
acceptance of the revisj-ons the wholesale
to Wastewater Agreement
as shown on the pages contained j-n Exhibit B to t,his Resolution.
Provided, however, the City of Pelican Bay does not agree t.o
Section 8.4 of the wholesale Wastewater Agreernent as contained in
Exhibit a. Provided further, the city of peli-can Bay is agreeable
to further discussions concerning the appropriate terms for
Se cti on 8.4 upon receipt of necessary additional information from
the City of Azle.
