COUNTER-AFFIDAVIT

I, ALRASHID PALAHUDDIN, 55 years old, married, and presently living at Paraiso Homes, Tumaga, Zamboanga City, Philippines, after having been sworn to in accordance with law, do hereby depose and state that:

I am the respondent in the Complaint filed by my step-granddaughter, GING HERRERA, accusing me of the crime of Rape.

I deny the allegations of my step-granddaughter, the truth being that:

I, together with my wife, Irish Palahuddin, have been entrusted by the daughter and son-in-law of my wife the custody of their daughters Grethel Herrera and Ging Herrera since they left for abroad in 2006 in search of greener pasture. I have loved and cared for the two girls like though they came from my blood and flesh. I attend to their everyday needs and support to the best of my means. I cannot commit such heinous act of rape nor allow it to be done to them, Grethel and Ging Herrera.

I have observed the change in the attitudes of my two step-granddaughter since they started out with their peers. I became strict to them because I believe that girls of their age need a lot of guidance and _______. My *daughter/son* ________ can attest to this.

On the 24th of July, 2011, I saw them playing outside and Ging was filled with dirt. So I called her inside our room for me to clean her up and change her clothes. After that I immediately left the room.

I have been suffering from Erectile Dysfunction or otherwise known as Impotence due to the complexities of my Diabetes, a disease I have been suffering for the past five (5) years. I have attached to this the medical certificate issued by __________.

I am executing this Counter-Affidavit for the purpose of attesting to the truth of the foregoing statements, to inform the proper authorities of the above facts, to support my prayer for the dismissal of the instant case against me and for whatever purpose this may serve best.
