Dear Ms. Lehmberg
Pursuant to Section 552.3215 of the Texas Public Information Act, | respectfully request that the Travis,
County District Attorney's office review my attached complaint against the Texas Workforce Commission
for criminal violations of the PIA. TWC is a state agency with their administrative offices in Travis
County. TWC appears to be altering, concealing, destroying and withholding public records in violation
of the Texas Public Information Act Sections $52.351(a) and 552.353(a).
Section $52.351 (a) provides:
A person commits an offense if the person willfully destroys, mutilates, removes without
permission as provided by this chapter, or alters public information.
Section 552.353(a) provides:
An officer for public information, or the officer’s agent, commits an offense if, with
criminal negligence, the officer or the officer’s agent fails or refuses to give access to, or to
permit or provide copying of, public information to a requestor as provided by this,
chapter.
Arecent press release from TWC shows their unflinching prosecution of alleged fraud by unemployment
recipients. Some individuals were prosecuted here in Travis County. If not for my evidence showing
their malfeasance, | may have been one.
Therefore, when your office finds the aforementioned violations by TWC, | ask that you consider the
reversal of all judgments against those Ul recipients. | asked that for each violation under Section
552.351 that TWC be charged the maximum of $4,000 each plus three months county jail. For each
violation under Section 552.353, | ask that TWC be charged the maximum of $1,000 each and the
maximum county jail term of six months. Of course, this is in addition any lawsuit or criminal charges
that I pray you file on behalf of Travis County.
