FACTS: Ferdinand Marcos was deposed from office and was forced into exile in Hawaii. In his deathbed, Marcos
implied his wish to return to the Philippines to die. But President Aquino did not grant this wish and barred the
Marcos and his family from returning to the Philippines, considering all the consequences of their return.

ISSUE: Whether or not the President may bar the return of Marcos to the Philippines, in the exercise of the powers
granted to her by the Constitution.

HELD: Yes, the President has the power to bar the return of Marcos to the Philippines and it is within the scope of
executive power. It cannot be said that the powers of the President are only limited to the powers specified and
enumerated in the Constitution. Whatever power inherent in the government that is neither legislative nor judicial
has to be executive. It must be treated as a matter that is appropriately addressed to those residual unstated powers
of the President which are implied to be the essential in order to execute the duty to safeguard and protect the
general welfare of the country.
