Mr. WALSH (for himself, Mr. HEINRICH, and Mr. UDALL of Colorado) sub-
mitted the following resolution; which was referred to the Committee on
Energy and Natural Resources
RESOLUTION
Establishing a point of order against legislation selling
Federal land in order to reduce the deficit.
Resolved, 1
SECTION 1. POINT OF ORDER AGAINST SELLING FEDERAL 2
LAND IN ORDER TO REDUCE THE DEFICIT. 3
(a) IN GENERAL.Except as provided in subsection 4
(b), it shall not be in order in the Senate to consider any 5
bill, joint resolution, amendment, motion, amendment be- 6
tween the houses, or conference report that sells any Fed- 7
eral land and uses the proceeds of the sale to reduce the 8
Federal deficit. 9

(b) EXCEPTION.Subsection (a) shall not apply to 1
the sale of Federal land as part of a program that acquires 2
land in the same State that is of comparable value or con- 3
tains exceptional resources. 4
(c) SUPERMAJORITY WAIVER AND APPEAL IN THE 5
SENATE. 6
(1) WAIVER.This section may be waived or 7
suspended only by the affirmative vote of three-fifths 8
of the Members, duly chosen and sworn. 9
(2) APPEAL.An affirmative vote of three- 10
fifths of the Members, duly chosen and sworn, shall 11
be required to sustain an appeal of the ruling of the 12
Chair on a point of order raised under this section. 13
