AFFIDAVIT OF CONSOLIDATION OF OWNERSHIP IN PACTO DE RETRO SALE
I, MAXIMO MALANUM, of legal age, married to REGINA V. MALANUM, Filipino citizen, and a resident of Brgy. Cabaruan, San Fabian, Pangasinan, Philippines, after being sworn to in accordance with law, depose and state that:
1. On September 9, 2006, BERNARD VISPERAS MEIRGAS, of legal age, married, Filipino citizen, with residence and postal address at 1571 Kapangpangan St.,Sta Ana, Manila, sold to me a certain parcel of land under pacto de retro, executed before Notary Public Atty. Ma. Paz G. Serafica, and bearing Notarial Registry No. 487, Page No. 99, Book No. VIII, Series of 2006 of her Notarial Register;
2. A photocopy of the said pacto de retro sale is hereto attached as ANNEX A;
3. Pursuant to said Deed of Sale with Pacto de Retro, the vendor-a-retro, BERNARD VISPERAS MEIRGAS, should have exercised his right to repurchase the said property within the period of ONE (1) year, counted from date thereof, and upon payment and return of the sum of FIFTEEN THOUSAND PESOS ( PHP 15, 000,00);
4. The said period expired on September 9, 2007;
5. The said vendor-a-retro, BERNARD VISPERAS MEIRGAS, by himself or by any person in his behalf, had not complied with the condition and stipulation required for the repurchase of the said property;
6. The said period of repurchase has not been extended, either expressly or impliedly, by Affiant vendee a retro;
7. By virtue of the said Deed of Sale with Pacto de Retro, and by the failure of the vendor-a-retro , to duly repurchase the property therein mentioned within the period stipulated, the Affiant, as vendee-a-retro, hereby consolidates the absolute ownership of the said property;
8. Attached hereto, as Annex B, is an order of the ________________ Court _________________________ issued on ________________ approving and confirming the above consolidation of ownership in the name of Affiant.
