GIVE BRIEF DESCRIPTION OF WHAT HAPPENED: .~

On Tuesday, December 1,2009, at approximately 2052 hours, members of the Metropolitan Police Department's Seventh District were dispatched for the report of a shooting in the 4200 block of 4th Street, Southeast. When

officers arrived in the area they located two individuals who were suffering from gunshot wounds. The decedent,

who was later identified as Arvel Alston, was in and out of consciousness suffering from a gunshot wound to his

body. As will be set forth below, the decedent was one ofthe participants in the armed robbery of W-I. The

District of Columbia Fire Department (DCFD) responded to the scene and rendered aid to both victims. The decedent was transported to MedStar where hospital staff recovered more than over $ 4,200 of U.S . Currency, a Chrysler car key and a cellular phone from the decedent, which were turned over to detectives. A short time later the decedent succumbed to his injuries and was subsequently pronounced dead by Dr. Jeng at ] 0:05 pm. The decedent's remains were then transported to the Office of the Chief Medical Examiner (OCME) for the District of Columbia pending an autopsy. On Wednesday, December 2,2009, an autopsy was performed on the

decedent. At the conclusion of the autopsy, Dr. Pestanar ruled that the cause of death was a single gunshot wound to the decedent's right torso and the manner of death was ruled a homicide.

While investigators were still conducting the initial on-scene investigation, they located a Chrysler 300 which was registered to the decedent parked approximately one block away from the crime scene. Investigators noted that there is a crime camera directly above of where the decedent's vehicle was parked.

During the subsequent investigation into the homicide, witnesses were interviewed. One such witness, hereinafter referred to as W -1 (the victim of the robbery), reported that on December I, 2009, IT was walking to IT's vehicle, a black Infiniti, which was parked in front of 4329 4th Street, Southeast. While walking to IT's vehicle, W-I was approached by a number of black males. W-I indicated that at the time the individuals approached W -I, W -I noticed a marked police car in the immediate area of the parking lot. As will be addressed below, these black males were later identified as decedent Arvel Alston, his son defendant Arvel Crawford, defendant S-I, and another individual known as defendant S-2. According to W -I, S-l showed W -] a gun in IT's waistband and then told W-l to walk back to the building. While W-I was walking back to the building, the

other robbers joined them. When they got W -I to the building, S-1 stated, "Where' s the money at?" W -1 said IT asked, "What money you talking about?" W-I indicated that S-1 stated, "You know what money I'm talking about." W -I said that is when one of the robbers went into his pocket and got approximately 700 dollars of U.S. Currency.

According to W -I, one of the other robbers (later determined to be Arvel Crawford), then hit W -I in the head with a handgun and told W-J to open the door to the apartment building. W-I told the gunman (Arvel Crawford) that IT did not have a key and defendant Crawford stated, "You think we fuckin playing with you?" W -1 said IT then buzzed one of the apartments in the building, but there was no answer.

A third robber (decedent Arvel Alston), stated, "Where the fuckin key to the car?" W -1 said IT gave that robber

the key to IT's car and that robber stated, "This ain't no fuckin key!" W-I stated, "That is the key!" That robber (decedent Arvel Alston) then went to W-l 's car, got in, backed W-I 's car out of the parking space, and stopped

the car as ifhe were waiting on his cohorts. W-I reported that the other robbers started walking IT towards IT's

car and were trying to force W-I into the car. W-I said that IT started to fight with the suspects because one of

the suspects said that they were going to kill IT. W -I reported that while IT was struggling with the suspects, the robber that had hit him with the handgun (Arvel Crawford) fired a shot, striking the robber who had taken W -I's

car keys and backed W-l's car out of the parking spot (decedent Arvel Alston). In other words, the investigation revealed that during the shooting, Arvel Crawford shot and killed his father Arvel Alston. After apparently being struck by a bullet, W -1 indicated that the robber in the driver's seat of W -I's car (decedent Arvel Alston) stated, t

"What the fuck you doing?" W -1 said it was at that point that an uninvolved witness started yelling. W -1 ')

reported that IT too started yelling for help and that is when the armed robber (Arvel Crawford) shot IT in the "

body.

W -1 reported that after IT was shot, the suspects started running away. W -I reported that IT fell to the ground and noticed IT's car drifting down the parking lot toward 4th Street, and IT's vehicle glanced off a retaining wall and crashed into the mailboxes at the end of the parking lot.

W-I reported that IT had approximately 4,000 dollars ofO.S. Currency in the center console oflT's car. Upon investigators processing W -1 's car for evidence, no money was found in the vehicle.

Investigators obtained the video footage of the crime camera that is at the corner of 4th Street and Livingston

Terrace, Southeast. While viewing the footage, investigators saw that at approximately 1942 hours (prior to the robbery/homicide) the decedent Alston's vehicle, a black Chrysler 300, parks at the comer of 4th Street and Livingston Terrace, Southeast. At approximately 1943 hours, decedent Alston is observed getting out of the driver's seat of the car and defendant S-1 is observed getting out of the front passenger seat of decedent Alston's car. S-I and decedent Alston then are seen walking toward 4329 4th Street, Southeast.

Another witness, W -2, indicated that IT saw the individuals attempting to rob W -1. W -2 saw a marked police car

sitting at the end of the drive way and W-2 ran to the police car for assistance. W-2 indicated that as IT was ~

running to the police car for assistance, the police car pulled off. W-2 then ran to the end of the driveway to flag

the police car down but indicated that the car just kept going and left the area.

Another witness, W-3, indicated that IT was in the area at the time of the shooting. W-3 stated that there was a marked police car parked "on the left side by the mailboxes" (indicating the area of the driveway to the parking lot of the apartment complex.

On December 11, 2009, S-1 was arrested and charged with First Degree Felony Murder while armed and was transported to the Metropolitan Police Department's Homicide Branch to be processed.

During the interview with S-l, he reported that on Sunday, November 29, 2009, decedent Alston told S-! of a "job" that he had that would get them some "major money," S-I knew that when the decedent Alston referred to a 'job" he was referring to a robbery.

S-l'reported that on Monday, November 30, 2009, he and decedent Alston went to a car detailing shop located at 3722 Old Silver Hill Road in Suitland, Maryland, to meet with the other people who were going to participate in the robbery. S-l said that on their way to the car detailing shop, decedent Alston informed him that "his (the decedent Alston's) man, L" had a police officer who was going to assist in the robbery. S-l said that when they arrived at the car detailing shop, he observed a District of Columbia marked police car parked in front of the detailing shop. S-l said that he and decedent Alston entered the detailing shop and walked into the back area of the shop where only employees were allowed access. Sol said that when they entered the back room, he met an individual referred to as "L," an individual referred to as S-2 and a District of Columbia police officer, whom "L" referred to by a name/nickname S-l believes sounded like "Roger." According to S-l, the officer was wearing a bullet proof vest with "Police" written on it. S-l said that in the room he noticed a computer and surveillance equipment for the surveillance cameras that were on the property. S-l said that as he was in the back room, decedent Alston and "L" went into the next room and began talking. Shortly thereafter, the decedent and "L" walked back into the room where S-l was and "L" asked decedent Alston if he had a gun. Decedent Alston told "L" that he had a gun in his vehicle. Decedent Alston told S-l that they were going to the location of where the robbery was going to occur, and S-I then observed "L" go to a file cabinet in the room and take out two guns. S- 1 described one gun as a "machine gun," which "L" kept. The other gun was a handgun which "L" provided to S-2. S-l said that while "L" was getting the two guns out of the file cabinet, he observed other guns inside of the

file cabinet. S-l also said that while "L" was getting the guns out of the cabinet, the D.C. police officer was just 1 feet away in the room and was on the computer. S-l reported that when they left the detailing shop, "L" got into

the police car with the Police Officer and S-2 got into the car with he and decedent Alston.

S-l further indicated that on the way over to 4th Street, Southeast, they went by decedent Alston's son's house to get a gun. S-l said that the decedent had lied to "L" when he told him that he had a gun in the car. S-l said that the police officer followed them when they went to the decedent's son's house. S-l indicated that when they got to the decedent's son's neighborhood, the decedent's son (Arvel Crawford) was outside. Arvel Crawford later

indicated to S-1 that he was about to run when he saw the police car, until he saw his father in the second car ~

flagging him down from within the car. Arvel Crawford then got into the his father's car where he gave S-2 a (\~"""",-

gun for his father, decedent Alston, to use. After giving S-2 the gun, Arvel Crawford exited the car. S-l said that ~

the five men (he, Alston, and S-2 traveling in one car and the police officer and "L" traveling in the marked

police car) then rode through the 4300 block of 4th Street, Southeast, and decedent Alston, who was on the phone

with "L," was pointing out the location ofW-1 's girlfriend's apartment. After driving through the neighborhood,

"L" called decedent Alston and told him to meet back at the detailing shop. Once at the shop, "L" told decedent

Alston that he knew W-1 because W-I had previously brought IT's car to the shop. "L" said that W-I drives a Cadillac truck. S-I said that the police officer was present during the conversation.

SOl reported that on Tuesday, December 1,2009, he was with decedent Alston and they went to the detailing shop on Old Silver Hill Road in Suitland, Maryland, to meet with "L," S-2 and the police officer. Once at the detailing shop, they met with the police officer, "L" and S-2. S-I said that he, decedent Alston, "L" and S-2 were talking about the impending robbery and decedent Alston told them that W-I (the target of the upcoming

robbery) was on IT's way to IT's girlfriend's house, but W-l was not driving IT's Cadillac, W-I was driving an ~

Infinity. S-I said decedent Alston indicated that the plan was for S-l , decedent Alston, his son Arvel Crawford ~

and S-2 to catch W-l coming out of the building and force W-I back into W-l 's girlfriend's apartment where

they would rob W-I. S-I reported that he was then suppose to drive decedent Alston's car back to the detailing

shop while decedent Alston, his son Arvel Crawford and S-2 would kidnap W -1 and use W -1 's vehicle to take IT

back to IT's house in Ft. Washington, MD, where they would burglarize W -I 's house.

S-1 said that once decedent Alston had finished telling them the plan, they left the detailing shop. S-l said that S-2 and "L" got into the marked police car with the police officer and S-1 got into the car with decedent Alston. S-1 reported that he and decedent Alston drove to Potomac Gardens where they picked-up the decedent's son, Arvel Crawford. S-1 said that the police officer, "L" and S-2 followed them as they drove to 4th Street, Southeast. S-1 said that once they were in the area of the 4300 block of 4th Street, Southeast, decedent Alston saw W-l 's vehicle, a black Infinity, parked in the parking lot in front of 4329 4th Street, Southeast, and that they then parked at the comer of Livingston Terrace and 4th Street, Southeast. S-l said that once they were parked, decedent Alston called "L" and told him that W -1 was there, but that people were in the courtyard that had to be

cleared out. Decedent Alston told "L" to have the police officer drive into the parking lot to clear out the people who were hanging out in the area. S-1 said that immediately thereafter, the marked police car arrived, entered the parking lot area, turned around and returned to 4th Street where S-1 saw "L" open the police car door, so that S-2 could exit from the rear of the police vehicle. After dropping S-2 off on 4th Street, the police vehicle drove into the parking lot area a second time to clear the area and then parked on the driveway of the parking lot facing 4th Street.. S-2 proceeded to the front of 4327 4th Street, Southeast, where S-2 joined S-I, decedent Alston and the decedent's son Arvel Crawford where they waited for W-l to exit 4329 4th Street, Southeast. While S-l, S-2, decedent Alston and decedent's son Arvel Crawford waited, the police officer and "L" remained inside the marked police vehicle, which was parked near the entrance of the parking lot, serving as lookouts and protection for the four assailants.

S-1 said that once W-I exited the building, S-I, decedent Alston, decedent's son Arvel Crawford and S-2

approached W -1 and announced the robbery. According to S-I, decedent Alston, his son Arvel Crawford and S-

2 were all armed, but S-1 was not. S-1 indicated that he kept his hand in the pocket of his coat to give the

impression he was armed during the robbery. S-1 stated that as they were robbing W -1, the police officer

remained at the entrance of the parking lot and "L" was in the car with him. S-1 said that as they were robbing

W-l, Arvel Crawford hit W-I in the head with a gun. S-1 said that decedent Alston obtained W-I 's car keys and entered W-I 's car. S-I indicated that as they were trying to kidnap W-I, W-I started fighting and the decedent's t son attempted to shoot W-I but struck his father who was sitting in the driver's seat ofW-l 's car. S-I said that

he heard several more gunshots and that Arvel Crawford was the only person he saw shooting.

S-I said that after being shot, decedent Alston exited the front passenger door of W -1' s car and W -I' s car drifted toward the parking lot exit and then crashed. S-1 saw decedent Alston run toward 4th Street and collapse on the sidewalk. S-1 then saw decedent Alston's son, Arvel Crawford, run over to his father and urge his father to, "get up dad, get up!" However, decedent Alston remained on the ground and Arvel Crawford then fled the area.

S-1 also reported that while the robbery was occurring, a woman (determined to be W -2, as related above) exited the building and started screaming and yelling. S-1 said that the woman ran to the police car (containing the police officer and "L") for help, but that the police car then pulled off. S-1 indicated that he then fled the area on foot.

S-1 also indicated that IT had a conversation with "L" sometime after the robbery where "L" indicated that as "L" sat in the police vehicle and the shots were being heard, that the police officer said to "L" "I'm either gonna have to leave the area or get out and start shooting."

During the interview, investigators showed S-I a nine-picture photo array to include a photograph of Arvel Crawford, decedent Alston's son. Upon viewing the array, S-I picked the photograph of Arvel Crawford, which was in position number three. S-I indicated that the individual that it picked from the array was the same person that S-1 had observed shoot decedent Alston during the robbery ofW-I. During an interview with Arvel Crawford, he provided 639 I Street, Southeast, as his home address and a records check of Arvel Crawford revealed that he currently resides at 639 I Street, Southeast.

After interviewing S-1 , your affiant and Detective Greene secured an unmarked police vehicle and had S-1 show them where "L's" car detailing shop is located. S-1 led investigators to 3722 Old Silver Hill Road, Suitland, Maryland. When investigators and S-1 were driving past the shop, S-1 stated, "that's S-2 right there about to walk in the building." Your affiant looked and saw the back of a black male walking inside detailing shop. S-I informed your affiant and Detective Greene that S-2 works for "L" at the detailing shop.

Your affiant and Detective Greene, then parked and watched the detailing shop for a short while. While watching the shop, the detectives noticed a heavy set black male exit the detailing shop and enter a silver Ford pick-up truck bearing Virginia tags, XUT4500. Your affiant and Detective Greene, with S-1 still in their vehicle, followed the truck in order to run the license plate. While stopped at a red light, Detective Greene pulled-up next to the truck, at which time S-1 spontaneouslystated, "that's the police dude right there," identifying the driver of the truck as the police officer who participated in the offenses on December 1,2009. Detective Greene

informed your affiant that he knew the police officer and his name was "Reggie Jones" and he works with the Metropolitan Police Department's Narcotics and Special Investigations Division.

Lieutenant Posey of the Metropolitan Police Department's Homicide Branch contacted Sergeant Sloan of the Metropolitan Police Department who informed Lieutenant Posey that the silver pick-up truck bearing V A tags XUT4500 that Reginald Jones was observed operating after he exited "L's" detailing shop was leased by the Metropolitan Police Department and was assigned to the Narcotics and Special Investigations Division.

Based on the facts set forth in this affidavit, your affiant requests that a Judge of the District of Columbia Superior Court issue a warrant for the arrest of Reginald Jones.
