GRANTING AUTHORITY TO THE HONORABLE VICE-MAYOR JULIO S. TINGZON IV OF
GUINOBATAN, ALABY TO BE THE OFFICIAL SIGNATORY FOR ALL WARRANTS DRAWN ON
MUNICIPAL TREASURY INCLUDING THE SIGNING OF DISBURSEMENT VOUCHERS OF
EXPENDITURES INVOLVING APPROPRIATIONS APPROPRIATED FOR THE OPERATION OF
THE SANGGUNIANG BAYAN PURSUANT TO ARTICLE TWO, SECTION 445 (A) (1), OF R.A.
7160 AND SECTIONS 39 AND 43 OF COA CIRCULAR NO. 92-382.

WHEREAS, the article two, section 445, paragraph (a) (1) of R.A. 7160, otherwise known
as the Local Government Code of 1991, provides that,
Section 445. Power, Duties and Compensation (a) The Vice-Mayor shall:
(1) Be the presiding officer of the Sangguniang Bayan and sign all warrants drawn on the
municipal treasury of all expenditures appropriated for the operation of the
Sangguniang Bayan.
WHEREAS, in like manner, the Commission on Audit in its circular numbered 92-382,
under Sections 39 and 43 thereof, it provides in part and quoted hereunder that,
Section 39. Approval of Vouchers xxx. However, disbursement vouchers for
expenditures appropriated for the operation of the sanggunian shall be approved by the
provincial vice governor, the city vice mayor or the municipal vice mayor, as the case
may be. (emphasis supplied)
SECTION 43. Officials Authorized to Draw and Sign Checks xxx in case, however of
expenditures appropriated for the operation of the Sanggunian, checks drawn thereon
shall be countersigned by the provincial vice governor, the city vice mayor or the
municipal vice-mayor, as the case may be. (emphasis supplied)
WHEREFORE, in view of the foregoing premises, be it now:

RESOLVED, as it is hereby resolved by the Sangguniang Bayan of Guinobatan, Albay in


session assembled to grant as it hereby grants authority to the Honorable Vice-Mayor Julio S.
Tingzon IV of Guinobatan, Albay to be the official signatory for all warrants drawn including the
signing of disbursement vouchers of expenditures involving appropriations intended/appropriated
for the operation of the Sangguniang Bayan pursuant to article two, Section 445 (a) (1), of R.A.
7160 and Sections 39 and 43 of COA Circular No. 92-382.
RESOLVED FURTHER, that this authorization however, is to be understood that it is
granted together with the Municipal Treasurer as an Official Signatory in all the financial
transaction/expenditures appropriated for the operations of the Sangguniang Bayan especially in
drawing of checks from the depository banks of the municipal government. Emphasis is only made
on the Honorable Vice Mayor in this resolution being the new head of the Sanggunian, who had
just assumed the position on June 30, 2013;
RESOLVED FINALLY, that copies of this resolution be furnished the managers of all the
depository banks of the Municipal Government of Guinobatan, municipal mayor, municipal
accountant and the municipal treasurer for their information and guidance.

WHEREAS, the Sangguiang Bayan of Guinobatan on 02 July 2013 was in receipt of the
above-entitled proposed legislative measure, with amendments provided, from the Office of the
LCE, coupled with a Certificate of Urgency, which in response thereto, finding the same to be in
order, necessary and ministerial on the part of the Sangguniang Bayan to act on the same in order
not to disrupt the financial transactions and/or operation of the LGU especially with its depository
banks, a Special Session has been called by the members of the Sangguniang Bayan in
accordance with law and the rules of procedures, today, 04 July 2013 at 10:00 oclock in the
morning, solely for the purpose of acting on the said proposed measure;
WHEREAS, said authorization however, is confined only with the transactions under the
province/domain of the executive department and does not cover those under the appropriations
appropriated under the legislative branch of the LGU as the latter is independent from the former
pursuant to Article two, Section 445, paragraph (a) (1) of R.A. 7160, Sections 39 & 43 of COA
Circular No. 92-382, and Municipal Resolution No. 01-2013;
WHEREAS, this authorization likewise is to be understood that it is granted together with
Municipal Treasurer as an official signatory in all the financial transactions of the LGU especially in
drawing of checks from the depository banks of the municipal government. Emphasis is only made
on the Honorable Mayor in this resolution being the new head of the LGU/agency, who had just
assumed the position on June 30, 2013;
WHEREFORE, in view of the foregoing premises, be it now:

RESOLVED, as it is hereby resolved by the Sangguniang Bayan in session assembled to


grant as it hereby grants authority to the Honorable Mayor Ann Y. Ongjoco of Guinobatan, Albay to
be the official signatory for all warrants drawn on municipal treasury including the signing of
disbursement vouchers of expenditures involving appropriations appropriated for the operation of
the municipality of Guinobatan, Albay, subject however, to exemption as provided for by law,
circular, and/or resolution.
RESOLVED FURTHER, that copies of this resolution be furnished the managers of all the
depository banks of the Municipal Government of Guinobatan (MGG), municipal mayor, municipal
accountant and the municipal treasurer for their information and guidance.

MUNICIPAL RESOLUTION NO. 03-2013


RESPECTFULLY REQUESTING/RECOMMENDING TO THE LOCAL CHIEF EXECUTIVE, HON.
ANN Y. ONGJOCO OF GUINOBATAN, ALBAY AN ACROSS THE BOARD
ADJUSTMENT/INCREASE ON THE DAILY WAGE OF PERSONNEL HIRED ON JOB ORDER
STATUS BY THE MUNICIPALITY FROM PHP160.00 TO A MINIMUM OF NOT LESS THAN PHP
200.00 BUT NOT MORE PHP 250.00 A DAY TO COPE UP WITH THE PRESENT AND
UNDENIABLE HIGH COST OF LIVING CONDITIONS.
WHEREAS, with the high cost of daily living needs, such as but not limited to food,
transportation, clothing, power, communication, education and the like, the present Php 160.00
daily wage of personnel hired on Job Order status of the municipality is no longer sufficient,
reasonable, and economically viable for them to make both ends meet;
WHEREAS, as public officials and as the policy making body of the LGU, we are duty
bound to provide not only protection but as well as promotion of the general welfare of our men and
women whom we consider as our partners in attaining and sustaining our vision and mission for
our beloved community;
WHEREAS, the increase/adjustment, subject of this resolution, may be sourced out from
the budget surplus realized by the LGU for the fiscal year ended Decemebr 31, 2012, wherein with
the help of these job order personnel, the LGU netted/posted a surplus amounting to Php
21,379,060.09. Of this amount, Php 7,788,368.42 is under the general fund while the three (3)
economic enterprises had a combined net surplus/equity of Php1,472,336.55, aside from the
special accounts on 20% development fund, MDRRMF and the MUDHB fund which posted also a
combined net surplus of Php 12,118,355.12;
WHEREAS, adjusting/increasing their wages is also a way of boosting their morale thereby
creating upon them a positive attitude towards assigned works/tasks that will surely contribute in
attaining a higher level of success and the continued realization of LGUs goals towards excellence
in local governance;

WHEREFORE, in view of the foregoing premises, be it now:


RESOLVED, as it hereby resolved by the Sangguniang Bayan in session assembled, to
respectfully request/recommend as it respectfully requests/recommends to the LCE an across the
board adjustment on the Daily Wage of Job Order Personnel of the LGU from Php 160.00 to a
minimum of not less than Php 200.00 but not more than Php 250.00 a day to cope up with the
present and undeniable high cost of living condition.
RESOLVED FURTHER, that in case the existing savings/surplus cannot suffice the
recommended or requested adjustment under the supplemental budget as there may be other
priority needs that the LGU may attend to, it is further recommended that the same be duly
considered in the succeeding budgets of the municipality most especially in the annual budget of
the locality.
RESOLVED FINALLY, that upon approval of this resolution, the Hon. Mayor, the Honorable
Members of the Local Finance Committee and the 44 barangays through their respective barangay
captains be furnished a copy of this resolution for their information and appropriate action.

GRANTING AUTHORITY TO THE HONORABLE MAYOR ANN Y. ONGJOCO AND THE
MUNICIPAL TREASURER MARJORIE O. OCFEMIA TO TRANSFER THE FUNDS, COMMONLY
KNOWN AS THE MUNICIPAL AID TO BARANGAY PRIORITY DEVELOPMENTAL PROJECTS,
ALLOCATED UNDER THE 20% DEVELOPMENT FUND IN THE AMOUNT OF PHP 100,000
EACH FOR CY 2013 AND ALL THE REMAINING MUNICIPAL AIDS SINCE CYs 2011, IF ANY,
DIRECTLY TO THE OFFICIAL ACCOUNT OF THE FORTY-FOUR BARANGAYS OF
GUINOBATAN, ALBAY.
WHEREAS, the Municipal Government of Guinobatan through the Sanggunian recognizes
the need of the barangays for financial support for their priority developmental projects;
WHEREAS, taking cognizance of this need, the Municipal Government of Guinobatan
provides every year for its forty-four composite barangays, in its budget, particularly in the 20%
development fund, a considerable amount equally shared by them as an aid for their identified
priority developmental needs/projects;
WHEREAS, the Municipal Government to further show and honor its unequivocal
commitment to bring development to the grassroots and the countryside and in furtherance of the
so called, barangay empowerment and local autonomy it hereby adopts the best practice of the
National Government of downloading or transferring support funds directly to the end users, the
barangays for this matter, without so much delay and pre-conditions, provided that, these funds
must be utilized for the common good and for public purpose and in accordance with the rules
implementing the 20% development fund;
WHEREFORE, in view of the foregoing premises, be it now:
RESOLVED, as it is hereby resolved by the Sangguniang Bayan of Guinobatan, Albay in
session assembled, to authorize as it hereby authorizes the Honorable Mayor Ann Y. Ongjoco and
the Municipal Treasurer Marjorie O. Ocfemia, to transfer the funds, commonly known as the
municipal aid to barangay priority developmental projects, allocated under the 20% development

fund in the amount of Php 100,000 each for CY 2013 and all the remaining municipal aids since
CYs 2011, directly to the official account of the forty-four barangays of Guinobatan, Albay.
RESOLVED FURTHER, that the Municipal Mayor, as an incident to this transfer of funds,
is further authorized to sign for and in behalf of the Municipality, in a Memorandum of Agreement
with all the barangays concerned, setting forth therein the terms and conditions on the proper
implementation of the project and the utilization of fund, thus, transferred, incorporating therein as
an integral part, among others, the program of work and other relevant documents of the project.
RESOLVED FURTHERMORE, that to effectively carry out the provision of this resolution,
the Office of the MPDC is hereby designated as the coordinating office between the barangay and
municipal governments in facilitating the transfer of funds, where as such, shall assist the
barangays in complying with the requirements such as but not limited to the making of programs of
work, disbursement vouchers, preparation of the final list of municipal aids per barangay and the
like;
RESOLVED FINALLY, that upon approval of this resolution, the Hon. Mayor, the Honorable
Members of the Local Finance Committee and the 44 barangays through their respective barangay
captains be furnished a copy of this resolution for their information and appropriate action.

MUNICIPAL RESOLUTION NO. 05-2013


GRANTING AUTHORITY TO THE HON. MAYOR ANN Y. ONGJOCO TO ENTER INTO A
MEMORANDUM OFAGREEMENT WITH THE ALBAY ELECTRIC COOPERATIVE (ALECO) FOR
THE INSTALLATION OF A SEPARATE ELECTRICAL CONNECTION/SERVICE IN RELATION
TO THE TOWN FIESTA CELEBRATION OF GUINOBATAN, ALBAY.
WHEREAS, in this years town fiesta of Guinobatan, Albay, the LGU of Guinobatan
decided to provide on its own the electrical services to the winning applicants of the spaces it is
renting out to transient vendors on some of the streets/roads it has temporarily lifted from public
servitude during fiesta season pursuant to Municipal Ordinance No. 01-2013, as amended;
WHEREAS, in providing for such service, there is a need also for the LGU to apply with
the necessary agency, ALECO, where as the sole energy supplier a Memorandum of Agreement
(MOA) between the parties is also a pre-requisite;
WHEREAS, pursuant also to law, in entering into a MOA, there is also a need for an
authority from the Sangguniang Bayan in favor of the Local Chief Executive to be granted or
extended;
WHEREFORE, in view of the foregoing premises, be it now:
RESOLVED, as it is hereby resolved by the Sangguniang Bayan in session assembled, to
grant as it hereby grants the Hon. Mayor Ann Y. Ongjoco to Enter into a Memorandum of
Agreement (MOA) with the Albay Electric Cooperative (ALECO) for the Installation of a Separate
Electrical Connection/Service in Relation to the Town Fiesta Celebration of Guinobatan, Albay.
RESOLVED FURTHER, that copies of this resolution be furnished all concerned for their
information and guidance.

IMPLEMENTATION OF FEEDING PROGRAM TO DAY CARE PUPILS IN THE MUNICIPALITY.

WHEREAS,

incident to the vested function of every local government unit in the exercise of
their devolved functions and responsibilities pursuant to the enactment of the
Local Government Code of 1991 relative to the provision of basic services and
facilities, especially those pertaining to social welfare services, is the coordination
with appropriate government agencies for youth and children development
projects and programs;

WHEREAS,

the Supplementary Feeding Program being managed and implemented in the


day care centers throughout the region by the Department of Social Welfare and
Development (DSWD) Regional Office V and being monitored and provided
augmentation for its implementation in the municipal level is a program which aims
to distribute foods in order to supplement the energy and other nutrients missing
from the diet of those who have special nutritional requirements to prevent or
alleviate malnutrition, among others;

WHEREAS,

this august body deems such program as necessary and beneficial for the
development of the children and the youth within the municipality as a way of
facilitating efforts in the promotion of their general welfare, thus consents the Local

Chief Executive to bind the local government in the implementation of such


program and to discharge the responsibilities embodied in the Agreement;
WHEREAS,

under this feeding program around 2,282 day care pupils, more or less, in all the
61 day care centers of the Local Government of Guinobatan are bound to benefit
in this anti-poverty and hungry alleviation program of the government for 120 days
at Php 13.00 per pupil per day with a total cost of Php 3,558,360.00, more or less.

WHEREFORE, in view of the foregoing premises, be it now:


RESOLVED, as it is hereby resolved by the Sangguniang Bayan of Guinobatan, Albay in session
assembled, to authorize as it hereby authorizes the Honorable Mayor Ann Y.
Ongjoco of Guinobatan, Albay to enter into a Memorandum of Agreement (MOA)
with the Regional Office No. V of the Department of Social Welfare and
Development for the implementation of Feeding Program to Day Care Pupils in the
municipality.
RESOLVED

FURTHER, that copies of this resolution be furnished the Hon. Regional Director
of the DSWD, Regional Office No. V, the Hon. Mayor, the office of the MSWD and
all the Day Care Workers of the Guinobatan, Albay for their information and
appropriate action.

ENERGY THE ELECTRIFICATION OF PUROK 6, BARANGAY BANAO, GUINOBATAN, ALBAY
UNDER THE SITIO ELECTRIFICATION PROGRAM OF THE DEPARTMENT OF ENERGY WITH
ABOITIZ POWER RENEWABLE, INC. (APRI).

WHEREAS, Purok 6 of Banao, this municipality, had been inspected by the Albay Electric
Cooperative, Inc. and properly identified to be qualified under the Sitio Electrification
Program of the DOE and the Electric Cooperative;
WHEREAS, an endorsement resolution to this effect from the Sangguniang Bayan is necessary
for the same to be acted upon by the Department under its Sitio Electrification
Program funded by ER-194 in cooperation with Aboitiz Power Renewable Inc.
(APRI) as per letter dated June 24, 2013 by Atty. Veronica T. Briones, Project
Supervisor of the Electric Cooperative;
WHEREAS, this project if approved and implemented is expected to benefit about 30 households
and the cost is estimated at Php 401,270.50;
WHEREFORE, in view of the foregoing, be it now:
RESOLVED, as it is hereby resolved by the Sangguniang Bayan of Guinobatan, Albay in session
assembled, to endorse as it favorably endorses to Albay Electric Cooperative, Inc.
and the Department of Energy the electrification of Purok 6, Barangay Banao,
Guinobatan, Albay under the Sitio Electrification Program of the Department of
Energy in cooperation with the Aboitiz Power Renewable, Inc. (APRI).

APPROVING THE UPDATING OF THE ANNUAL INVESTMENT PLAN (AIP) OF THE
MUNICIPALITY OF GUINOBATAN, ALBAY FOR THE YEAR 2013.

WHEREAS, the Annual Investment Program (AIP) of the Municipality of Guinobatan, Albay for
the year 2013 embodies the various programs/projects/activities of the municipality
in which, through this, the local government would be able to effectively and
efficiently deliver the basic services and facilities which they envision to provide to
their constituents during their tenure;
WHEREAS, as part of the short and long term investment programs of the LGU for the
development
of
the
municipality,
the
approval
of
additional
programs/projects/activities becomes inevitable and necessary;
WHEREAS, these additional programs/projects/activities which are to be embodied in the
forthcoming supplemental budgets must be included in the AIP for the year 2013 or
that such AIP be updated to include them considering that such is a condition
precedent in the preparation of a budget;
WHEREFORE, in view of the foregoing premises, be it now:
RESOLVED, as it is hereby resolved by the Sangguniang Bayan of Guinobatan, Albay in session
assembled, to approve as it hereby approves the updating of the Annual Investment
Program of the Municipality of Guinobatan, Albay for the Year 2013 to include
Projects/Programs/Activities in the forthcoming Supplemental Budget.

WHEREAS, by virtue of an Executive Order No. 06, S. 2013,


dated July 16, 2013, issued by the Hon. Mayor Ann Y. Ongjoco, the
Arandurugan Festival was renamed to Longganiza de Guinobatan
Festival;

WHEREAS, there is a need to request this augmentation fund


from the Office of the Governor in view of the fact that the
Municipality lacks the necessary fund to finance all the activities that
had been lined-up for the holding on its first year this newly born
Festival in our municipality;
WHEREAS, should this request be granted by the Hon.
Governor, these activities that had been identified were all designed
to make the holding of the festival to be more attractive and
memorable not only to Guinobateous but to our local tourists as well,
true to the vision and aspiration not only of our town but also of the
province to improve our economy through tourism promotion;

WHEREAS, the Sangguniang Bayan of Guinobatan was in
receipt of a Certificate of Urgency from the Local Chief Executive
certifying as urgent the passage of the above-entitled resolution;
WHEREAS, attached to the certification is the draft
Memorandum of Agreement (MOA) stipulating therein the roles and
responsibilities of the parties, DENR & Local Government, for the
perusal of the honorable members of the Sangguniang Bayan;
WHEREAS, on August 6, 2013 at 9:00 oclock in the morning a
Joint Committee Hearing was called by the Committees on
Environment and Natural Resources and Laws, Rules and Oversight
where a representative from the Office of the DENR-EMB attended
the same and a full blown discussion with the honorable members on
the terms and conditions of the MOA ensued;
WHEREAS, the essence of the MOA is the grant unto the Local
Government of Guinobatan by the DENR Central Office of the amount
of Php500,000.00 for the establishment of Material Recovery Facility
(MRF) in the municipality as required under RA 9003 or the
Ecological Solid Waste Management Act of 2000;
WHEREAS, this grant carries with some responsibilities on the
part of the Local Government and has to be governed by the
Memorandum of Agreement to see to it that said grant will be utilized
in accordance with the set objectives and with the end in view of
implementing to the full extent the provisions of RA 9003 in the
municipality;
WHEREFORE, in view of the foregoing premises, and finding
the terms and conditions of the MOA not onerous or disadvantageous
to either party and for their mutual benefit, be it now:
RESOLVED, AS IT IS HEREBY RESOLVED by the
Sangguniang Bayan of Guinobatan, Albay to grant as it hereby grants
authority to Hon. Mayor Ann Y. Ongjoco of Guinobatan, Albay to enter
into a Memorandum of Agreement with Department of Environment
and Natural Resources, Environmental Management Bureau, (DENREMB), RO5, represented by herein by its Regional Director, Engr.
Roberto B. Sheen, regarding the establishment of Material Recovery
Facility (MRF) in the municipality.
RESOLVED FURTHER, that a copy of the draft Memorandum
of Agreement, subject of this resolution, is hereto attached and made
an integral part hereof and marked as Annex A;
RESOLVED FINALLY, that a copy of this resolution be
furnished all concern offices and/or officials for their information and
appropriate action.

WHEREAS,
the Sangguniang Bayan of Guinobatan, Albay was in
receipt on August 19, 2013 of a Certificate of Urgency
from the Local Chief Executive, certifying as urgent the
passage of this resolution which the Sangguniang Bayan
considered immediately in a Special Session;
WHEREAS,
the municipal mayor as the chief executive of the
municipal government, shall exercise such powers and
perform such duties and functions as are directly or
indirectly concerns the efficient and effective governance
the purpose of which is the general welfare of the
municipality and its inhabitants pursuant to Section 16 of
the Local Government of 1991;
WHEREAS,
in view of the above-mentioned mandate of the Local
Government Code of 1991, the Municipal Mayor shall
exercise general supervision over all the activities of the
municipal government, among others, and in connection
with this, shall represent the municipality in all its
transactions, upon authorization of the Sangguniang
Bayan;
WHEREAS,
this august body deems it necessary, appropriate
and beneficial to authorize the Municipal Mayor to
represent the municipal government in any suit/case that
it may be involved with in view of the pertinent powers
and functions of the municipal mayor and the
indispensability of a representative during such times;
WHEREFORE, in view of the foregoing premises, be it now:
RESOLVED,
as it is hereby resolved by the Sangguniang Bayan of
Guinobatan in session assembled, to grant as it hereby
grants the request of the Municipal Mayor, Honorable Ann
Y. Ongjoco, to represent the LGU in cases for and against

Resolution No. 147-2011, which originally authorizes the
Hon. Mayor Juan Miguel M. Garcia being the Mayor at

Mayor Ann Y. Ongjoco, being his successor to the position
be now given with the said authority.

GRANTING AUTHORITY TO HON. ANN Y. ONGJOCO,
MUNICIPAL MAYOR, GUINOBATAN, ALBAY TO ENTER INTO A
MEMORANDUM OF AGREEMENT FOR PILI DEVELOPMENT
PROGRAM WITH THE DEPARTMENT OF AGRICULTURE,
REGIONAL UNIT NO. 5, REPRESENTED BY ENGR. ABELARDE
BRAGAS AND THE FARMER COOPERATOR IN THE PERSON OF
MRS. SUSANA M. MALIGALIG OF INASCAN, GUINOBATAN,
ALBAY.

WHEREAS,
the Department of Agriculture (DA) is mandated to
develop PILI as a promising indigenous crop of the Bicol
Region which has a high potential of becoming an export
commodity of the country;
WHEREAS,
to attain this goal, massive production and planting
of superior recommended Pili varieties is necessary to
accelerate the commercialization of the Pili Industry;
WHEREAS,
this project cannot be realized without the support
and participation of Local Government Units and the
farmers who will act as cooperators and will provide the
needed area of not less than one hectare as technology

demonstration farm that will showcase new production


technologies for this indigenous crop;
WHEREAS,
considering the benefits of this program, which
include among others, significant employment and income
to our farmers, traders, processors and private
entrepreneurs, the Local Government of Guinobatan
warmly welcomes this initiative of the Department and
willingly accepts its role in propagating and cultivating
the success of this laudable program;
WHEREFORE, in view of the foregoing premises, be it now:
RESOLVED,
as it hereby resolved by the Sangguniang Bayan of
Guinobatan, Albay in session assembled, to grant as it
hereby grants authority to Hon. Ann Y. Ongjoco, Municipal
Mayor, Guinobatan, Albay to enter into a Memorandum of
Agreement for Pili Development Program with the
Department Of Agriculture, Regional Unit No. 5,
represented by Engr. Abelarde Bragas and the Farmer
Cooperator in the person of Mrs. Susana M. Maligalig of
Inascan, Guinobatan, Albay.
RESOLVED FURTHER, that a copy of this resolution be furnished
the Hon. Regional Director Engr. Abelarde Bragas, DA,
Regional Office No. V, the Hon. Mayor Ann Y. Ongjoco, the
Farmer Cooperator, Mrs. Mrs. Susana M. Maligalig, the
MAO, Mr. Florante Siapno and all other concerned
persons for their information and appropriate action.

WHEREAS,
the Local Government of Guinobatan and Rural Bank
of Camalig, Inc. have an existing Memorandum of
Agreement (MOA) regarding Group Accounts Loan
Program that enables the formers permanent employees
to access from the latter their own financial needs to
improve their livelihood through modest and honorable
means;
WHEREAS,
with the change in leadership of the Local
Government of Guinobatan on June 30, 2013 from the
Hon. Mayor Juan M. Garcia to Hon. Mayor Ann Y. Ongjoco
it likewise necessitates the change in the signatories in
the said program covered by the MOA;
WHEREAS,
the entry of the Municipal Accountant and the
Administrative Officer as signatories is due to the request
of the Municipal Treasurer to have her replaced for
reasons that are acceptable and understandable on the
part of the parties;
WHEREFORE, premises considered, be it now:

RESOLVED,
as it hereby resolved by the Sangguniang Bayan of
Guinobatan, Albay in session assembled, to approve as it
hereby approves the amendment of the existing MOA
between the Rural Bank of Camalig (RBC), Inc. and the
LGU-Guinobatan by changing the authorized signatories
therein from Municipal Mayor Juan M. Garcia & Municipal
Treasurer Marjorie O. Ocfemia to Municipal Mayor Ann Y.
Ongjoco, Municipal Accountant Tarcila S. Sales &
Administrative Officer Arnel O. Ortile.
RESOLVED FURTHER, that a copy of this resolution be furnished
the Manager of RBC, Inc., Hon. Mayor Ann Y. Ongjoco, the
Municipal Accountant, the Administrative Officer and all
other concerned persons for their information and
appropriate action.

REQUESTING HIS EXCELLENCY PRESIDENT BENIGNO C. AQUINO III TO
ALLOCATE FUNDS FOR THE CONSTRUCTION OF FLOOD CONTROL DIKE
AT BARANGAY MAIPON, GUINOBATAN, ALBAY TO PRIMARILY PROTECT
THE MAIN WATER RESERVOIR OF THE MUNICIPALITY LOCATED IN THE
VICINITY IN THE AMOUNT OF PHP10,000,000.00.

WHEREAS, since the occurrence of Super Typhoon Reming in November, 2006
that resulted in the deaths of hundreds of people in this municipality, with hundreds more
missing, highlights the need for the construction of flood control dikes in this area as
there are still millions of tons of volcanic debris deposited on the slopes of Mayon
Volcano and with its continued eruption and flooding brought about by the yearly visiting
typhoons from the months of June to November, it continue to pose an imminent threat to
the people of the Municipality of Guinobatan especially to its main water reservoir
located just about 30 meters below the existing Mayon River Gully, a new and wider
river canal created and established by Super Typhoon Reming;
WHEREAS, dikes were constructed around Mt. Pinatubo after its one massive
eruption in 1991 but its scale is comparable to the regular eruption of Mt. Mayon that
deposits volcanic debris on its steep slopes waiting for heavy rains to wash it down and
onto ravines that more often than not terminates on towns at its base;
WHEREFORE, the foregoing premises considered;
RESOLVED, AS IT IS HEREBY RESOLVED by the Sangguniang Bayan of
Guinobatan, Albay in session assembled to request, as it hereby requests His Excellency
President Benigno C. Aquino III to earmark Php 10 Million Pesos, more or less, in favor
of the Municipal Government of Guinobatan, Province of Albay for the immediate
construction of flood control dikes in Purok 2 of Maipon, Guinobatan, Albay to primarily
protect the main water reservoir of the municipality and eventually save the town from
mudflows and flashfloods brought about by the steep slopes of Mount Mayon during
typhoons, heavy rains, eruptions and similar disasters.
RESOLVED FURTHER, that attached to this resolution for reference by the
Office of the President are the following documents:

2. Program Design/Perspective
3. Program of Work
RESOLVED FINALLY, that a copy of this resolution together with its
attachment be furnished the Office of the President, and all other concerned for their

Bridge then connecting Barangays San Rafael & Poblacion of this municipality was
totally destroyed and was replaced by a Hanging Bridge only late last year (2012)
through the assistance of Hon. Congressman Fernando V. Gonzalez by way of his Priority
Development Assistance Fund;
WHEREAS, this new hanging bridge must be protected and fortified by putting

GRANTING AUTHORITY TO THE HONORABLE ANN Y. ONGJOCO, MUNICIPAL MAYOR OF
GUINOBATAN, ALBAY, TO ENTER INTO A MEMORANDUM OF AGREEMENT WITH THE
PROVINCE OF ALBAY FOR THE AVAILMENT OF THE KALAHI-CIDSS, COMMUNITY DRIVEN
DEVELOPMENT PROJECT.

WHEREAS, every local government unit shall exercise the powers expressly granted,
those necessarily implied therefrom, as well as powers necessary, appropriate, or incidental for its
efficient and effective governance, and those which are essential to the promotion of the general
welfare, and as such, shall ensure and support among other things, the promotion of health and
safety, the enhancement of economic prosperity and social justice and the preservation of comfort
and convenience of their inhabitants (Section 16, RA 7160);
WHEREAS, the KALAHI-CIDSS is one of the poverty reduction programs implemented by
the Department of Social Welfare and Development utilizing Community Driven Development
(CDD) as a primary strategy wherein the Province of Albay is one of three (3) pilot provinces of this
project;
WHEREAS, this project seek to pilot an enhanced role for the provincial local government
units in using CDD to help constituent municipalities, like Guinobatan, in planning, budgeting, subproject implementation and monitoring and evaluation;
WHEREAS, while all municipalities in Albay are included in the PLGU-led KC-CDD Project,
all however, will be subjected to an enrolment process, and only those eligible sub-projects
selected through participatory process will be provided with grants under the project;
WHEREFORE, in view of the foregoing premises, be it now:

RESOLVED, as it is hereby resolved by the Sangguniang Bayan of Guinobatan, Albay in


session assembled, to grant as it hereby grants the Honorable Ann Y. Ongjoco, Municipal Mayor of
Guinobatan, Albay to enter into a Memorandum of Agreement with the Province of Albay for the
availment of the KALAHI-CIDSS, Community Driven Development Project.
RESOLVED FURTHER, that the Memorandum of Agreement subject of this resolution is
hereto attached and made an integral part hereof and marked as Annex A.
RESOLVED FINALLY, that upon approval of this resolution, the Hon. Mayor, and all other
persons concerned be furnished a copy of this resolution for their information and appropriate

department heads made by the Local Chief Executive

WHEREAS, on August 22, 2013, on the basis of the endorsement

Resolution Numbered 001-2013, the Hon. Mayor Ann Y.
Ongjoco, appointed Mrs. Salve Orolfo Ragas to the vacant
position of Municipal Budget Officer, which was rendered

WHEREAS, on August 23, 2013, the documents for her appointment

legal mandate, has called for a committee meeting and
finds that the appointee has met the necessary
qualifications/requirements of the position and is
therefore qualified to be permanently appointed thereto;

WHEREAS,the LGU of Guinobatan had long envisioned for a new and
modernized slaughterhouse (abattoir) in town, fully
equipped with the needed meat facilities compliant with
the national standards and be a primary producer of
quality meat in the locality;
WHEREAS, the present state of the towns slaughterhouse and its
location in Barangay Ilawod and along a river, will not fit
to its vision of being a major producer of meat and meat
products in and outside of the province where a shortage
of these vital commodities have been noted for a
considerable time;
WHEREAS, in the past, the Bicol University College of Agriculture
and Forestry with their offered course on Animal
Husbandry, had been pursuing a partnership with the
Local Government along this laudable plan by offering a
site inside their campus on the same purpose, which
according to their school officials, the plan could further
be strengthened by offering a new course for butchering
which is at present becoming an in demand career not
only in our country but in other countries like New
Zealand, Australia, Denmark and other meat/cattle
producing countries;
WHEREAS, these shared plans can be made easier and possible by
further tapping the technical and financial assistance of
the Department of Agriculture more particularly the
National Meat Inspection Services (NMIS) which is the
agency of the state mandated to ensure quality production
of meat and meat products from established and
rehabilitated meat establishment that are compliant with
the prescribed national standards;
WHEREAS, since 2006, the NMIS has an existing program known as
the Meat Establishment Improvement Program (MEIP)
which is designed to assist LGUs in their efforts to
rehabilitate
and/or
complete
their
existing
slaughterhouses and poultry dressing plants;
WHEREFORE, in view of the foregoing premises, be it now:
RESOLVED, as it is hereby resolved by the Sangguniang Bayan of
Guinobatan, Albay in session assembled to grant as it
hereby grants authority to the Hon. Mayor Ann Y. Ongjoco
of Guinobatan, Albay to enter into a Memorandum Of
Agreement with the Bicol University College of
Agriculture and Forestry and the Department of
Agriculture - National Meat Inspection Services (DANMIS) for the establishment of a new slaughterhouse in
the municipality.

WHEREAS,this request of the Municipal Government of Guinobatan
in the Province of Albay is in consonance with the vision of
the Philippine Government under administration of His
Excellency President Benigno C. Aquino III to be a major
producer in Southeast Asia of meat and meat products
from an established and rehabilitated meat establishments
that are compliant with the prescribed national standards;
WHEREAS,
Republic Act 9296 otherwise known as the Meat
Inspection Code of the Philippines provides that the local
government units shall endeavor to improve existing meat
facilities to comply with the national standards, and the
national government shall allocate funds as assistance for
this purpose;
WHEREAS, the Local Government of Guinobatan in pursuing this
goal, has an on-going partnership/agreement with Bicol
University College of Agriculture & Forestry, a premier
state college offering agricultural courses located at the
center
of
the
municipality,
allowing
the
construction/establishment of a new slaughterhouse
(abattoir) within their campus with the view also on the
part of the state college to introduce a new course on
butchering which is at present a career becoming in
demand in and out of the country, should this new and
modernize meat facility is realized;

WHEREAS, the Local Government of Guinobatan is also in close


contact with the National Meat Inspection Services,
Regional Office No. V at Pili, Camarines Sur, for this much
awaited project and is very much willing to extend both
technical and financial assistance to the LGU in this
endeavor;

WHEREAS, every local government unit shall exercise the powers expressly granted,
those necessarily implied therefrom, as well as powers necessary, appropriate, or incidental for its
efficient and effective governance, and those which are essential to the promotion of the general
welfare, and as such, shall ensure and support among other things, the preservation and
enrichment of culture as well as of comfort and convenience of their inhabitants (Section 16, RA
7160);
WHEREAS, every year the Local Government of Guinobatan by presidential and provincial
declarations is the center of a provincial celebration and commemoration of a National Hero, in the
person of the late General Simeon Arboleda Ola, who was a pure-bloodied Guinobateo and
nationally known and recognized in Philippine history to be the last Filipino General to vow to the
Americans during the Filipino-American War;
WHEREAS, in fitting honor to his heroism, a monument right at the center of his
hometown, Guinobatan, was built since early 90s, the PNP Regional Camp in Legazpi City was
renamed after him from Camp Ibalong to Camp Gen. Ola, and September 2 of each year, his birth
anniversary, is declared a special non-working holiday for all Albayanos to pay respect on this man
whose gallantry and patriotism had led his fellowmen to freedom, which we all enjoy now;
WHEREAS, in 2012 the Local Government of Guinobatan had planned to expand the Gen.
Ola National Shrine and an Ola/Guinobatan Museum was started to be constructed beside his
monument in the continuing pursuit of the Guinobateos to further preserve and inculcate in the
minds of the present and future generations the bravery and the true spirit of a Guinobateo

national hero, which this noble plan, however, was unduly interrupted and not completed due
primarily to the ending of the term of officials;
WHEREAS, according to the plan, the completion of this project will entail a cost of more
or less Five Million Pesos, and its completion will be complementary to the flagship program of the
Provincial Government on Tourism, by having another Tourist, Historical and Educational
Destination in the 3rd District of Albay;
WHEREFORE, in view of the foregoing premises, be it now:
RESOLVED, as it is hereby resolved by the Sangguniang Bayan of Guinobatan, Albay in
session assembled, to request as it hereby request the Provincial Governor of Albay, Hon. Joey
Sarte Salceda to allocate funds amounting to Five Million Pesos (PHP5,000,000.00) for the
construction/completion of the Ola Shrine located at Barangay Iraya, Guinobatan, Albay.
RESOLVED FURTHER, that the Proposed Program of Work for the completion of the
project, subject of this resolution, is hereto attached and made an integral part hereof and marked
as Annex A for reference and perusal of the Honorable Governor.

WHEREAS,

the Sangguniang Bayan of this municipality recognizes the need for improving and
providing adequate means of communications between and among the members
of local sanggunian, the different heads of the LGU, barangay officials and other
officials in the municipality, in the province and most especially in the national level
and abroad where most of the time are being requested with funds for local
development;

WHEREAS,

providing for a more adequate means or much improved communications facility


would result in a faster, more collaborative and coordinated efforts to deliver basic
and urgent services, most especially in times of calamities, to our beloved
constituents;

WHEREAS,

as it is already settled in todays modern time, the fastest and cost effective ways
to make such coordination possible is through the use of mobile phones;

WHEREAS,

the recognition of the municipality of its vital importance in its official functions and
transactions cannot however be permitted without any limitation to safeguard the
use of public money for this purpose;

WHEREFORE, in view of the foregoing premises, be it now:


RESOLVED,

by the Sangguniang Bayan of Guinobatan, Albay in session assembled to approve


as it hereby approves the adjustment of the allocation for communication expensemobile for municipal officials of Guinobatan, Albay entitled thereto.

RESOLVED FURTHER, that only the following elective and appointive officials of the LGU, who by
the nature of their work being head of an Office or Sub-Office in Permanent or OIC
capacities, shall enjoy the privilege for communication expense-moblie and shall
be allocated strictly under the following manner:
1. Elective Official.
a.) The Mayor is entitled to allocate under its office an amount not exceeding Php5,000.00 per
month for communication expensemobile.
b.) The Vice Mayor is likewise entitled to allocate under his office an amount not exceeding
Php3,500.00 per month for communication expensemobile.
c.) Every Member of the Sangguniang Bayan are also entitled to provide an allocation under
their communication expenses-mobile up to Php2,500.00 pesos per month.
2. Appointive Local Officials.
a.) All appointive office heads in permanent capacity of the municipality and/or those whose
salary grade is 24, are entitled to allocate under their respective office budgets an amount
not exceeding Php2,500.00 pesos each per month.
b.) All other appointive local officials who are designated as head of an office or sub-office
with plantilla permanent personnel of not lower than 3, whether as OIC or in acting
capacity, in the absence of permanent head of office, are likewise entitled to allocate under
their respective office budgets an amount not exceeding Php1,800.00 pesos per month.
RESOLVED FURTHERMORE, that the adjusted allocation for communication expense-mobile
shall always depend upon the availability of funds and shall take effect upon the
approval of the office budget for this purpose. Failure of the Office to allocate
funds for a particular period can no longer avail of this adjustment retroactively.
Hence, in no case shall the adjustment subject of this resolution be effected earlier
than the month of September, 2013.
RESOLVED FINALLY, that a copy of this resolution which repeals Municipal Resolution No. 0292004, be furnished the office of the Mayor, the heads of offices and all other
concerned personnel for their information and guidance.

APPROVED UNDER APPROPRIATION ORDINANCE NO. 01-2013, OTHERWISE KNOWN AS

WHEREAS,

embodied and approved under Appropriation No. 01-2013, other otherwise known
as the Annual Budget for CY 2013 of the municipality is an appropriation item for
the Purchase of Generator 3KVA, Capital Outlay, in the amount of PhP30,000.00
under the office of the SB Legislative;

WHEREAS,

during the canvassing made of our personnel in-charge in the procurement, the
appropriated amount of PhP30,000.00 can even afford to buy a generator that is
higher in voltage up to 5KVA;

WHEREAS,

accordingly, the higher voltage, the better for the Sangguniang Bayan in order to
operationalize all its indispensable office equipments vital for its operation like the
computers, photocopier, tape recorder and the printers during power interruption
which a 3KVA generator cannot operate all simultaneously;

WHEREAS,

the documents necessary for the purchase of the 5KVA cannot be effected unless
the term under the approved appropriation ordinance is not correspondingly
changed/adjusted by way of this resolution as per advise by the Budget Officer
and other concerned personnel on procurement;

WHEREAS,

this plan of the Sangguniang Bayan to purchase generator had long been
programmed being a necessity considering that the municipality together with the
province constantly experience brownouts/power outages that disrupts office
functions and deprives its constituency with the delivery of the much needed
services because of an insurmountable indebtedness of the power cooperative
from its energy suppliers.

WHEREFORE, in view of the foregoing premises, be it now:


RESOLVED FINALLY, that a copy of this resolution be furnished the office of the Mayor, the heads
of offices and all other concerned personnel for their information and guidance.
APPROVED UNANIMOUSLY this 9th day of September, 2013 on motion of the lead sponsoring

REQUESTING THE HONORABLE SECRETARY ROGELIO SINGSON OF THE DPWH
THROUGH ITS REGIONAL DIRECTOR IN BICOL TO ALLOCATE FUNDS FOR THE
IMMEDIATE REHABILITATION OF A VITAL BRIDGE WHICH IS IN IMMINENT DANGER OF
COLLAPSING LOCATED AT SITIO SAGAYSAY, BARANGAY MAGUIRON, GUINOBATAN,
ALBAY CONNECTING PRIMARILY THE MUNICIPALITIES OF GUINOBATAN AND JOVELAR.

WHEREAS,

due to the numerous typhoons that visited the country, such that of Super
Typhoons Reming & Juaning, which brought immense destruction not only in
Guinobatan, but throughout Albay Province since 2006, numerous infrastructure
facilities had been damaged within the municipality, including the subject bridge of
this resolution, situated at Sitio Sagaysay, Barangay Maguiron, this Municipality;

WHEREAS,

this 5-Ton primary bridge at barangay Maguiron serves not only its residents living
in the highland district of the municipality, but as well as passengers, merchants
and travellers, among others from the towns of Jovelar and part of Camalig, as a
convenient access to and from the urban centers and a vital link sooner or later, to
the Bicol International Airport in Alobo, Daraga, Albay and the Donsol- Jovelar ByPass Road when finally opened;

WHEREAS,

numerous typhoons are still expected to visit the municipality within this year and
in the coming years, thus, said bridge, if not immediately and promptly
rehabilitated, would result in its subsequent destruction, and as a necessary

consequence of which is the disruption of convenient and expedient transportation


services, i.e. traversable and passable bridge;
WHEREAS,

in the exercise of the vested powers and functions upon every local government
unit which are essential in the promotion of the general welfare, they shall make
an effort of providing basic services and facilities necessary, appropriate and
incidental in the preservation of their constituents safety, comfort and
convenience, as well as for the benefit of those persons indirectly benefited by its
services, and incident in this function is the need to find ways of realizing these
endeavours, such as resort to other effective and efficient sources imbued with the
much needed capabilities, resources and facilities;

WHEREFORE, in view of the foregoing premises, be it now:


RESOLVED,

as it is hereby resolved by the Sangguniang Bayan of Guinobatan, Albay in


session assembled, to request the Honorable Secretary Rogelio Singson of the
DPWH through its Regional Director in Bicol to allocate funds for the immediate
rehabilitation of a vital bridge which is in imminent danger of collapsing located at
Sitio Sagaysay, Barangay Maguiron, Guinobatan, Albay connecting primarily the
municipalities of Guinobatan and Jovelar.

RESOLVED FURTHER that a copy of this resolution be furnished the Hon. Secretary Singson
through the Hon. Bicol Regional Director of the DPWH, Honorable Danilo E.
Dequito, and all other concerned persons/agencies, for their information and
appropriate action.

WHEREAS, every local government unit shall exercise the powers expressly granted,
those necessarily implied therefrom, as well as powers necessary, appropriate, or incidental for its
efficient and effective governance, and those which are essential to the promotion of the general
welfare, and shall ensure and support among other things, the promotion of health and safety and
preservation of the comfort and convenience of their inhabitants (Section 16, RA 7160);
WHEREAS, a private corporation in the person of the Family Vaccine and Specialty
Clinics,Inc. with principal address at 34 th Floor, RCBC Plaza Tower II, 6819 Ayala Avenue, Makati
City, and through the representation of its General Manager, is offering to the Local Government of
Guinobatan its medical services which specializes on supplying vaccines on animal bites and other
diseases accompanied by an extra commitment of establishing a center and facilities for the proper
treatment of animal bite victims;
WHEREAS, along this line, the Municipal Government of Guinobatan taking cognizance of
the existence of a number of animal bite incidences in the municipality most especially from dogs,

where most of the victims belong to indigent family or have no sufficient financial capability to
finance its treatment, finds this offer as timely, beneficial and advantageous to the government and
its inhabitants;
WHEREAS, after due consultation and exchanges of ideas with all the concerned persons
from and among the local government and the corporation, a memorandum of understanding had
been reached and forged, outlining the terms and conditions that they deem fit and acceptable to
both parties;
WHEREFORE, in view of the foregoing premises, be it now:
RESOLVED, as it is hereby resolved by the Sangguniang Bayan of Guinobatan, Albay in
session assembled, to grant as it hereby grants the Honorable Ann Y. Ongjoco, Municipal Mayor of
Guinobatan, Albay to enter into a Memorandum of Agreement with the Family Vaccine and
Specialty Clinics, Inc. represented by its general manager, Mr. Jose S. San Agustin for the
Establishment of Human Rabies Management and Treatment Clinic in the municipality.
RESOLVED FURTHER, that the Memorandum of Understanding subject of this resolution
is hereto attached and made an integral part hereof and marked as Annex A.

implementation of the Sponsored Program component of the National
Health Insurance Program;

WHEREAS, along this line, the Municipal Government of Guinobatan taking


cognizance of the existence of a number of its inhabitants without any
health insurance to depend on in cases of emergencies despite of being
qualified considering their obvious and validated marginalized status in
life, finds this program as necessary for the government to provide to its
qualified constituents, believing in the underlying principle of social
justice that, those who have less in life, must have more in laws;
WHEREAS, after due deliberation and exchange of ideas from and among the
personnel of the local government, the memorandum of agreement in
connection with this program had been found to be in order, outlining
therein clearly the terms and conditions that will govern the availment of
this program by the local government;
WHEREFORE, in view of the foregoing premises, be it now:
RESOLVED, as it is hereby resolved by the Sangguniang Bayan of Guinobatan, Albay in
session assembled to grant as it is hereby grants the Honorable Ann Y.
Ongjoco, Municipal Mayor of Guinobatan, Albay to enter into a
Memorandum of Agreement with the Philippines Health Insurance
Corporation (PhilHealth) represented by its Regional Vice President, Mr.
Orlando D. Iigo, Jr. And National Nutrition Council, Region V,
represented by Nutrition Program Coordinator, Ms. Arlene R. Reario.
RESOLVED FURTHER, that the Memorandum of Agreement subject of this
resolution is hereto attached and made an integral part hereof and marked
as Annex A.
RESOLVED FURTHERMORE, that the offices of MSWD and MHO shall be
responsible for the identification of qualified enrollees under this program
by the municipality, subject however, to the final approval of the
Sangguniang Bayan who shall be chosen from among the poorest of the
poor and those without any health insurance yet issued or availed of in
their favor.
RESOVED FINALLY, that upon approval of this resolution, the Hon. Mayor, the
Regional Vice President of PhilHelath, the Municipal Accountant, The
MSWDO and the Municipal Health Officer be furnished a copy of this
resolution for their information and appropriation and appropriate action.

GRANTING AUTHORITY TO THE HONORABLE ANN Y. ONGJOCO, MUNICIPAL MAYOR OF
GUINOBATAN, ALBAY, TO ENTER INTO A MEMORANDUM OF AGREEMENT WITH
INTERVIDA PHILIPPINES FOUNDATION WITH OFFICE ADDRESS AT BENNY S. IMPERIAL

WHEREAS,

every local government unit shall exercise the powers expressly granted, those
necessarily implied therefrom, as well as powers necessary, appropriate, or
incidental for its efficient and effective governance, and those which are essential
to the promotion of the general welfare, and shall ensure and support among other
things, the promotion of health and safety and the preservation of comfort and
convenience of their inhabitants (Section 16, RA 7160);

WHEREAS,

a private and development foundation in the person of the Intervida Philippines


Foundation, duly organized and existing under the laws of Spain, and duly
licensed by the Securities and Exchange Commission to operate in the
Philippines, has for the past six years implemented several activities
complementary to Governments Accelerated Hunger Mitigation Program and the
Medium Term Philippine Plan of Action for Nutrition;

WHEREAS,

along this line, the Municipal Government of Guinobatan aware of Memorandum


Circular No. 2012-89, dated May 14, 2012, issued by the Department of Interior &
Local Government (DILG), which mandates all governors, mayors and punong

barangays for the adoption of the Philippine Plan of Action for Nutrition (PPAN)
2011-2016, finds this program collaboration with the parties as necessary for the
government to achieve its overall goal of improving the quality of human resource
and the reduction of child and maternal mortality and ultimately contribute to the
attainment of the Millennium Development Goals (MDGs) specifically in
addressing extreme poverty, hunger and malnutrition.
WHEREAS,

after due deliberation and exchange of ideas from and among the personnel of the
local government, the memorandum of agreement in connection with this program
had been found to be in order, outlining therein clearly the terms and conditions
that will govern the conduct of the parties under this laudable partnership;

WHEREFORE, in view of the foregoing premises, be it now:


RESOLVED, as it is hereby resolved by the Sangguniang Bayan of Guinobatan, Albay in session
assembled to grant as it is hereby grants the Honorable Ann Y. Ongjoco, Municipal
Mayor of Guinobatan, Albay to enter into a Memorandum of Agreement with
Intervida Philippines Foundation with office address at Benny S. Imperial Street,
Legazpi City, represented by its country delegate, Imelda A. Abalos.
RESOLVED

FURTHER, that the Memorandum of Agreement subject of this resolution is hereto


attached and made an integral part hereof and marked as Annex A.

RESOVED FINALLY, that upon approval of this resolution, the Hon. Mayor, the Regional Vice
President of PhilHelath, the Municipal Accountant, the MSWDO and the Municipal
Health Officer be furnished a copy of this resolution for their information and
appropriation action.

RESPECTFULLY REQUESTING THE MUNICIPAL MAYOR AND THE MUNICIPAL
DEVELOPMENT COUNCIL TO CONSIDER IN THE 2014 ANNUAL AND ECONOMIC
DEVELOPMENT BUDGET THE ESTABLISHMENT OF A BUS TERMINAL AND PASALUBONG
CENTER SOMEWHERE IN BARANGAY SAN RAFAEL, THIS MUNICIPALITY.

WHEREAS, Guinobatans Center of Commerce which is Poblacion is continuously expanding as
evidenced by the opening up of new commercial establishments in other parts of the
town such as in Iraya, Ilawod, San Francisco, Travesia and San Rafael;
WHEREAS, this momentum of economic growth must continue to be sustained by further
expanding this kind of avenues for trade & commerce;
WHEREAS, if a bus terminal bound for Manila and Visayas could be established in Barangay
San Rafael and at the same time a site for Pasalubong, it will encompass the
businesses already established and coming-up in the above-mentioned barangays,
thereby expanding and creating a bigger and wider commercial atmosphere in
Guinobatan;
WHEREAS, the establishment of a Pasalubong Center in the site is very much compatible with
the terminal as it will provide an avenue to showcase our own products to other
places such as the famous Guinobatan Longganiza, Pili Candies, Honey Bee,
Honey Wine and the like;

WHEREAS, this move will likewise decongest/free Poblacion from traffic which is now being felt
and expected to be a major problem in the near future just like in any other
developing places;
WHEREAS, this new business outlook/climate of the town once realized, will bring more
attraction to businesses which will certainly boost our economy, our road to
economic prosperity;
WHEREFORE, in view of the foregoing premises, be it:
RESOLVED, as it is hereby resolved by the Sangguniang Bayan of Guinobatan, Albay in session
assembled, to request as it is respectfully requesting the Municipal Mayor and the
Municipal Development Council to consider in the 2014 Annual and Economic
Development Budget the establishment of a Bus Terminal and Pasalubong Center
somewhere in barangay San Rafael of this municipality.
RESOLVED FURTHER, that should this request be favorably granted, an ad hoc committee must
be created by the Honorable Mayor solely for the purpose of carrying out the
objectives of this resolution who will be tasked among others, the identification of the
lot/site in Barangay San Rafael, including the negotiations for the purchase of the
same in favor of the LGU and eventually its development for the stated purpose.
RESOLVED LASTLY, that a copy of this resolution be furnished the Hon. Mayor and Members of
the MDC through the MPDC, for their information and appropriate action.

CENTERS IN MAYON AREA, MAURARO & HIGHLAND DISTRICT.

WHEREAS, Guinobatan is an emerging economy in the Province of Albay, in fact, among its 15
municipalities, our town is No. 1 in terms of income in the third district and No. 2 in
the province;
WHEREAS, one of the noted problems of a developed and developing community is its failure to
see the ill-effects of concentrating all its development in one place, most often in its
urban places, that resulted to uneven development of its territory;
WHEREAS, only those who are in the urban areas benefit most of the fruits of development to
the exclusion of those in the periphery which is not in essence a true development
as only a few are benefitting when it should be everybody as they all belong to one
municipality;
WHEREAS, the road to true, fair and balanced economic development begins now by investing
to our future by acquiring enough properties that could well be developed as Growth
Areas or New Economic Centers by the municipalities, as these properties so to

speak are still vacant and therefore, very much affordable on the part of the LGU as
compared when you will acquire them 10 more years from today;
WHEREAS, these new economic centers or growth areas being envisioned in this resolution
involve among others the development/preparation of new commercial sites that will
cater for Satellite Markets, in some noted emerging center-barangays of the town,
such as the Barangay of Masarawag in Mayon District, Barangay of Mauraro in MidHigland Areas and Barangay Sinungtan in Highland Territory where the municipality
has an existing mini-market since the 90s;
WHEREAS, this noted momentum and road for economic prosperity may only be sustained
through the expansion of our avenues for trade & commerce and unless it is
anticipated now the sustainability in the future of our envisioned equal distribution of
development for all will be far from its realization;
WHEREFORE, in view of the foregoing premises, be it:
RESOLVED, as it is hereby resolved by the Sangguniang Bayan of Guinobatan, Albay in session
assembled, to request as it is respectfully requesting the Municipal Mayor and the
Municipal Development Council to consider in the 2014 Annual and Economic
Development Budget the development of new growth areas or economic centers in
Mayon Area, Mauraro & Highland District.
RESOLVED FURTHER, that should this request be favorably granted, an ad hoc committee must
be created by the Honorable Mayor solely for the purpose of carrying out the
objectives of this resolution who will be tasked among others, the identification of the
lot/site in barangays of above-mentioned growth areas, including the negotiations for
the purchase of the same in favor of the LGU and eventually its development for the
stated purpose.

MUNICIPAL RESOLUTION NO. 030-2013


RESPECTFULLY REQUESTING THE MUNICIPAL MAYOR AND THE MUNICIPAL DEVELOPMENT
COUNCIL TO CONSIDER IN THE 2014 ANNUAL AND ECONOMIC DEVELOPMENT BUDGET AND
EVERY YEAR THEREAFTER, TO INCREASE THE MUNICIPAL AID TO BARANGAYS FROM
PHP100,000.00 TO PHP150,000.00.

WHEREAS,

Section 287 of the Local Government Code of 1991, mandates all local government units to
appropriate in its annual budget no less than twenty percent (20%) of its internal revenue
allotment for development projects;

WHEREAS,

in CY 2014 the 20% development fund of Guinobatan, Albay will reach about Php 25 Million
and with a better outlook of increasing in the succeeding years;

WHEREAS,

under Article 419, paragraph (c) of the Rules and Regulations Implementing the Local
Government Code of 1991, provincial, city and municipal governments are mandated to
provide aid to barangays;

WHEREAS,

with these guideposts, the Municipal Government of Guinobatan, through the Municipal
Development Council, provides an annual allocation of a considerable amount in the 20%
Development of the municipality commonly known as the municipal aid to priority
development projects of all the 44 barangays of the municipality;

WHEREAS,

this year, the Municipal Government of Guinobatan and the Municipal Development Council
earmarked an amount of Php 100,000.00 for every barangay to substantially augment its
funding for the much needed projects of the 44 composite barangays to propel development
or growth in the countryside;

WHEREAS,

this act of the Municipal Government is in recognition of the need of barangays to be fully
supported financially and to have an equitable share in the proceeds from its development
funds which are likewise in accord with the LGUs goals, plans and programs, foremost of
which is to equitably allocation its resources to attain a fair and balanced development
throughout the municipality and not only on its urban commercial district;

WHEREAS,

increasing the share of the barangays from the development fund of the municipality from
the present Php100,000.00 to Php 150,000.00 in the Year 2014 and beyond, is very much
manageable on part of the municipality as it is only about Php6.6 Million compared to the
Php 18 Million more remaining for the LGU to dispose/allocate for its own priority
development projects;

WHEREAS,

by honoring this request, the Honorable Mayor and the MDC crystalize further the
cooperative undertakings among LGUs as mandated under Section 33 of the RA 7160,
where local government units may consolidate, or coordinate their efforts, services and
resources for purposes commonly beneficial to them and finally, it will bolster our States
declared policy unto its territorial and political subdivision like the barangays to enjoy
genuine and meaningful local autonomy to enable them to attain their fullest development as
self-reliant communities and make them effective partners in the attainment of municipal and
national goals.

WHEREFORE,

in view of the foregoing premises, be it:

RESOLVED,

as it is hereby resolved by the Sangguniang Bayan of Guinobatan, Albay in session


assembled, to request as it is respectfully requesting the Municipal Mayor and the Municipal
Development Council to consider in the 2014 Annual and Economic Development Budget
and every year thereafter, to increase the municipal aid to barangays from Php100,000.00
to Php150,000.00.

RESOLVED

FURTHER, that should this request be favorably granted, it is further requested that these
funds be downloaded to the barangays in accordance with Municipal Resolution No. 042013, but only if the concerned barangay apply or opted for the said transfer.

RESOLVED

LASTLY, that a copy of this resolution be furnished the Hon. Mayor and Members of the
MDC through the MPDC, for their information and appropriate action.

members present this 16th day of September, 2013 during their 12th Regular Session.

FRANCHISE APPLICANTS AS SCREENED AND RECOMMENDED BY
THE TASK FORCE KAAYUSAN TAKEN FROM 64 UNCLAIMED
FRANCHISE NUMBERS AND 43 DROPPED/SURRENDERED AND
CANCELLED FRANCHISE NUMBERS THAT WERE DECLARED
VACANT AND AVAILABLE FOR AWARD.

Councilor Rolando P. Palabrica

pursuant to the provisions of Amendatory Ordinance No. 001-2009 passed and


approved on February 2, 2009, otherwise known as the Guinobatan Tricycle Code of
1999, the application for Tricycle Operation in Guinobatan, Albay was made open as
Section 9 of the Guinobatan Tricycle Code of 1999, to quote: All applicants who
shall completely satisfy all the qualifications and none of the disqualifications
and comply all the requirements provided for by the Ordinance shall be
granted franchise by the Sangguniang Bayan without prejudice however for its
revocation for cause/s or grounds authorized or provided for by the same
ordinance.

tricycle franchise and re-award with the Task Force Kaayusan and after due evaluation,

WHEREFORE, in view of the foregoing premises, be it now:

RESOLVED,
as it is hereby resolved by the Sangguniang Bayan of
Guinobatan, Albay in session assembled, to grant as it
hereby grants a one month provisionary Municipal Tricycle
Opertions Permit (MTOP) to 107 qualified franchise applicants
as screened and recommended by the Task Force Kaayusan
taken from 64 unclaimed franchise numbers and 43
dropped/surrendered and cancelled franchise numbers that
were declared vacant and available for award.
RESOLVED

FURTHER, that the above-named tricycle franchise grantees on provisionary status


must comply with their respective deficiencies, such as but not limited to, full payment
in the Treasury Office of the required fees and tricycle whole-body painting according

FURTHERMORE, that any of the above-named grantee who shall remain deficient of

automatic exclusion from the list of tricycle franchise holders and those who shall
completely comply the remaining requirements shall be permanently included in the
official list of tricycle franchise holders in LGU-Guinobatan who are eligible to renew
every year but without prejudice however, from its revocation for cause/s authorized by
the code. All payments made by the grantees who shall remain deficient after the
provisionary period shall be forfeited in favor of the LGU.

WHEREAS,

every local government unit shall exercise the powers expressly granted, those
necessarily implied therefrom, as well as powers necessary, appropriate, or
incidental for its efficient and effective governance, and those which are essential
to the promotion of the general welfare, and shall ensure and support among other
things, the promotion of health and safety and the preservation of comfort and
convenience of their inhabitants (Section 16, RA 7160);

WHEREAS,

a private and development foundation in the person of the Intervida Philippines


Foundation, duly organized and existing under the laws of Spain, and duly
licensed by the Securities and Exchange Commission to operate in the
Philippines, has for the past six years implemented several activities
complementary to Governments Accelerated Hunger Mitigation Program and the
Medium Term Philippine Plan of Action for Nutrition;

WHEREAS,

along this line, the Municipal Government of Guinobatan aware of Memorandum


Circular No. 2012-89, dated May 14, 2012, issued by the Department of Interior &
Local Government (DILG), which mandates all governors, mayors and punong
barangays for the adoption of the Philippine Plan of Action for Nutrition (PPAN)
2011-2016, finds this program collaboration with the party as necessary for the
government to achieve its overall goal of improving the quality of human resource
and the reduction of child and maternal mortality and ultimately contribute to the
attainment of the Millennium Development Goals (MDGs) specifically in
addressing extreme poverty, hunger and malnutrition;

WHEREAS,

after due deliberation and exchange of ideas from and among the personnel of the
local government, the memorandum of agreement in connection with this program
had been found to be in order, outlining therein clearly the terms and conditions
that will govern the conduct of the parties under this laudable partnership;

WHEREFORE, in view of the foregoing premises, be it now:


RESOLVED, as it is hereby resolved by the Sangguniang Bayan of Guinobatan, Albay in session
assembled to grant as it is hereby grants the Honorable Ann Y. Ongjoco, Municipal

WHEREAS, with these guiding principles, Guinobatan must invest in a more focused and
enhanced programs on agriculture where farming, nursery, fishing, livestock raising,
meat processing and marketing, agricultural researches on crops, prevention and
control of animal and plant diseases and pests, trainings and the like can be learned
and can be had to maximize productivity by our farmers and local entrepreneurs;
WHEREAS, it will be more unique and pleasing if all these envisioned agricultural programs and
services will be provided and can be found in just one place, in a one-stop
agricultural facility, where a little of everything can be found and showcased,
including the Office of the Municipal Agricultural Services and its allied farmerpartners;

WHEREFORE, in view of the foregoing premises, be it:


RESOLVED, as it is hereby resolved by the Sangguniang Bayan of Guinobatan, Albay in session
assembled, to request as it is respectfully requesting the Municipal Mayor and the
Municipal Development Council to consider in the 3-Year Term Investment Program
of the municipality the establishment and development of a 5-hectare Agricultural
Center of Guinobatan, Albay.
RESOLVED FURTHER, that should this request be favorably granted, an ad hoc committee must
be created by the Honorable Mayor solely for the purpose of carrying out the

appropriate lot/site for the agri-center, including the negotiations for the purchase of

WHEREAS, the standing fund of the drivers association in the annual budget for 2013

WHEREAS, the total amount available for appropriation as certified by the Municipal

HUNDRED FOURTY SIX PESOS AND EIGHTY ONE CENTAVOS (Php221,846.81), and thus, the
amount needed for supplemental budget to cover the proposed expenditures is ONE HUNDRED

CENTAVOS (221,846.81 75,000 = 146,846.81);
WHEREAS, to encourage the drivers to develop the spirit of cooperation and unity toward
an orderly and accident free traffic in the Municipality of Guinobatan, the committees affirmed the
proposal to include gasoline subsidy in the amount of NINETY FIVE THOUSAND EIGHT
HUNDRED FORTY NINE PESOS (Php95,849.00), Enhancement Training in the amount of FIFTY
FOUR THOUSAND EIGHT HUNDRED (Php54,800.00), GUTODA SEC Registration as part of the
Financial Plan in the amount of THREE THOUSAND PESOS (Php3,000.00), and Parada tents in
the amount of ONE HUNDRED SEVENTEEN THOUSAND PESOS (Php117,000);
WHEREAS, to augment the funding source, the Office of the Mayor has committed FIFTY
THOUSAND PESOS (Php50,000.00) from the Donation to the Parada Priority Development
Assistance Fund, thus making the aggregate amount available for appropriation to TWO

WHEREAS, the Municipal Government of Guinobatan (MGG) given only a limited


or scarce resources for development has and must realize the need for the exercise of the

towards the maximum benefits and satisfaction of its constituents;
WHEREAS, development, as a compelling goal, is neither instant nor done
overnight, but rather, a deliberate process which needs a thorough and extra careful
planning so that efforts to develop become relatively easier and with less failure;
WHEREAS, the MGG in its pursuit to become one of the most progressive towns
in the Province of Albay, revising and updating its Comprehensive Land Use Plan (CLUP)
including its Zoning Ordinance has become necessary and inevitable;
WHEREAS, revision of CLUP to be effectively carried out, the MGG needs the
services of technical and professional men whose expertise over the subject matter are
beyond question which the municipality does not actually have in its present workforce;
WHEREAS, such technical and professional men can be well provided by the
Bicol University and through the Bicol University Development Foundation, Inc., which has
the financial flexibility and likewise, the willingness to manage the project fund of the MGG,
are just in their proper time and places to be timely tapped and immediately put everything
in motion towards the realization of this much awaited plan of the municipality to revise and
update its CLUP including the re-formulation of its Zoning Ordinance;
WHEREFORE, in view of the foregoing premises, be it now:
RESOLVED, as it hereby resolved by the Sangguniang Bayan of Guinobatan,
Albay in session assembled, to grant as it hereby grants authority to Hon. Ann Y. Ongjoco,
Municipal Mayor of Guinobatan, Albay to enter into a Memorandum of Agreement with the
Bicol University and Bicol University Development Foundation, Inc. (BUDFI) in connection

MUNICIPAL RESOLUTION NO. 037-2013


GRANTING AUTHORITY TO HON. JULIO S. TINGZON IV, MUNICIPAL VICE- MAYOR
OF GUINOBATAN, ALBAY TO ENTER INTO A MEMORANDUM OF AGREEMENT WITH
THE BUREAU OF LOCAL GOVERNMENT DEVELOPMENT (BLGD) AND DILG
REGIONAL OFFICE NO. V, IN CONNECTION WITH THE ESTABLISHMENT OF
SANGGUNIAN INFORMATION SYSTEM/LOCAL LEGISLATIVE TRACKING AND
MONITORING SYSTEM IN THE SANGGUNIANG BAYAN.

WHEREAS, one of the priorities of the present Sanggunian of Guinobatan, Albay


is the introduction and adoption of the Sanggunian Information System or the Local
Legislative Tracking and Monitoring System in its office operation;
WHEREAS, the Sanggunian is very much aware that by having this
program/project installed in the Office, it will enable the local legislators, its Secretariat and
all other interested parties an access to the database of its policy/legislative measures
more particularly to the status of its preparations and implementation, performance and
reliability of the system as well as the provisions for some feedbacks on legislative
performance as it assesses the impact or its effect on the community;
WHEREAS, a computer program on the Sanggunian Information System (SIS)
had long been developed by the Department of the Interior and Local Government through
the Bureau of Local Government Development (BLGD) and is implemented with the
assistance of the DILG Regional Offices, which could be availed of, by the Local
Sanggunian of every Local Government Units (LGUs);
WHEREAS, to be able to avail this program a Memorandum of Agreement must
be entered into by the Sanggunian with the above-concerned agencies;
WHEREAS, pursuant to Section 445 (a) of R.A. 7160 and applying the decision of
the Supreme Court in the case of Atienza vs. Villarosa, G.R. No. 161081, May 10, 2005,
where it upholds the power of the Vice-Mayor/Sanggunian as separate and independent
over the executive when it comes to the operation of Sanggunian, the Vice Mayor of
Guinobatan is hereby authorized by the Sanggunian to make representation and sign in
the Memorandum of Agreement, on its behalf, with above-concerned agencies for the
implementation of this project;

WHEREAS, the implementation of the project whereby application systems are to


be installed and adopted in the Local Sanggunian will ensure effective and efficient
legislative functions thereby contributing growth and development in LGUs;
WHEREFORE, in view of the foregoing premises, be it now:
RESOLVED, as it hereby resolved by the Sangguniang Bayan of Guinobatan,
Albay in session assembled, to grant as it hereby grants authority to Hon. Julio S. Tingzon
IV, Municipal Vice- Mayor of Guinobatan, Albay to enter into a Memorandum of Agreement
with the Bureau of Local Government Development (BLGD) and DILG Regional Office No.
V, in connection with the establishment of Sanggunian Information System/Local
Legislative Tracking and Monitoring System in the Sangguniang Bayan.
RESOLVED FINALLY, that a copy of this resolution be furnished the Office of the
Hon. Director Blandino Maceda, Ph. D., CESO IV, DILG, Regional Office No. V and the
Office of Hon. Director Manuel Q. Gotis, CESO IV, Bureau of Local Government
Development, DILG, Central Office, A. Francisco Gold Condominium II, EDSA corner
Mapagmahal St., Quezon City for their information and favorable consideration.
UNANIMOUSLY APPROVED this 23rd day of September 2013, on motion of the
Sponsoring Committee Chairman, Hon. Councilor Frances John M. Oxales and
unanimously seconded by the body during their 13 th regular session.

REQUESTING THE BICOL UNIVERSITY FOR AN ADDITIONAL LOT INTENDED FOR THE
PROPOSED MUNICIPAL HOSPITAL IN GUINOBATAN, ALBAY, ADJACENT TO ITS PRESENT
RURAL HEALTH UNIT (RHU) LOCATED INSIDE THE BICOL UNIVERSITY COLLEGE OF
AGRICULTURE AND FORESTRY.

WHEREAS,

the Rural Health Unit (RHU) of Guinobatan serves more or less 90,000 inhabitants
or 19,000 households as per survey conducted by the LGU last 2010, and
provides, among others, medical services reaching up to 150 patients per day, and
dental services reaching 50-70 patients per day, and this number is expected to
continuously increase in the coming years;

WHEREAS,

it is the mandate of every local government to become self-reliant and continue


exercising the powers and discharge the duties and functions currently vested
upon them as are necessary, appropriate or incidental to the efficient and effective
provision of basic services and facilities, such as those pertaining to
medical/health services which include the implementation of programs and
projects on primary health care, maternal and child care, and communicable and
non-communicable disease control services and access to secondary and tertiary
health services, among others;

WHEREAS,

all these programs and projects relative to health are being carried out through the
RHU which is located in the compound of the Bicol University College of
Agriculture and Forestry (BUCAF) in a very minimal area taking into consideration
the number of inhabitants/patients which depend upon its services and visit the
place every day;

WHEREAS,

the local government envisions the provision of a more efficient, improved and
expanded implementation of health programs and services, such as but not limited
to, the addition of doctors/dentists, on-going establishment of a lying-in clinic and
segregation of patients depending on their respective illnesses, which can be, in

actual fact, achieved through the construction of additional health facilities. Thus,
in order to realize this intention, it is regarded by this august body as necessary in
the interest of public service, beneficial to the inhabitants, and practical taking into
consideration the current location of the RHU which is in the BUCAF compound, to
request an additional area of one (1) hectare, for its improvement and expansion
by constructing a new building separate and independent from it, in the form of a
Municipal Hospital;
WHEREFORE, in view of the foregoing premises, be it now:
RESOLVED,

as it is hereby resolved by the Sangguniang Bayan of Guinobatan, Albay in


session assembled, to request as it hereby requests the Bicol University for an
additional lot intended for the Proposed Municipal Hospital in Guinobatan, Albay,
adjacent to its present Rural Health Unit (RHU) located inside the Bicol University
College of Agriculture and Forestry.

RESOLVED FURTHER, that a copy of this resolution be personally furnished to the Bicol
University by the Hon. Mayor Ann Yap Ongjoco considering the importance and
the nature of this resolution.
APPROVED UNANIMOUSLY on motion of the lead sponsoring committee chairman, Hon.
Councilor Carlomagno P. Flores, duly seconded by the members present this 23rd
day of September, 2013 during their 13th Regular Session.
