As stated in your letter, pursuant to 25 CFR, § 2.8, BIA must either make a decision on the request within 10 days from receipt of the letter requesting a decision, or establish a later date by which the decision shall be made. A decision on your request shall be made by no later than February 20, 2015. Pursuant to section 2.8, February 20, 2015 is established as “the date by which failure to make a decision shall be appealable.” ‘Your letter describes immense frustration that this intragovernmental dispute continues. In response I wish to emphasize my hope that the citizens of the Cayuga Indian Nation will find a mechanism to resolve the dispute themselves.
