Waiver and Release

In consideration for allowing me to participate in any equestrian or other event at or in Buffalo Ridge
Arena, I, as the Participant individually and on behalf of my heirs, next of kin, representatives, dependents,
executors, administrators, successors and assigns (My Family) hereby release and agree to indemnify
and hold harmless Buffalo Ridge Arena, Bruce Barber, Pamela Barber and their respective officers,
directors, members and employees, and any instructors, supervisors, or other participants, (the
Sponsors), from any cause of action, claims or demands of any nature whatsoever, which I or My Family,
may now have or have in the future, against Sponsors, on account of personal injury, property damage, or
accident of any kind, including death, arising out of my participation in any equestrian or other even or
activity at or in Buffalo Ridge Arena. I understand that by signing this Release, I covenant and agree that I,
as well as My Family, will never institute any compensation for or on account of any damage, loss or injury
to my person, property or both, which may result from my attendance at and participation in events at
Buffalo Ridge Arena.
I further understand and agree the while participating in any activities, there is a substantial risk of injury
(including death) and I fully understand, accept and assume that risk. I agree and verify that: (a) I am in
good health and that I have no physical limitations that would preclude my safe participation in the
activities; (b) I assume responsibility for my own physical fitness and capability to participate in any
activities and represent that I am fit and capable of such participation; (c) prior to participating in any
activities, I will inspect the facilities and equipment to be used, and if I believe anything is unsafe, I will
immediately advise a representative of the Sponsors of such conditions and refuse to participate; (d) I am
providing and will be solely responsible for, my own horse(s), my own means of transportation to and from
the Activity, all of my own tack and horse equipment and all of the supplies and medical or hospitalization
insurance for me; (f) I certify that I will be covered by my own medical and hospitalization insurance while
participating in the activities; and (g) I certify that if I am riding Sponsors horses for lessons or any
activities held at Buffalo Ridge Arena that I hold Sponsors harmless as a result of their horses actions while
participating in activities.
I am fully aware of all the dangers of participation in activities; I am of lawful age and legally competent to
sign this Waiver and Release, which I have fully read and completely understand; I understand that I will be
legally bound by the terms of this Waiver and Release and that I have signed this document of my own free
act. If this Waiver and Release is to allow a minor to participate in any Activities, then the person signing
this Waiver and Release certifies that they are lawful and custodial parent or guardian of the minor and
that they understand they (and the minor) will be legally bound by the terms of this Waiver and Release
and that they have signed this document of their own free act.

Participant hereby agrees to abide by posted, verbal and/or agreed upon safety rules and guidelines of
Buffalo Ridge Arena, knowing and understanding that there are always risks involved in any farm animal
activity. For any Participants under the age of 18 it is mandatory per state law to wear helmets.
Participants over the age of 18 can initial this page if they are not going to wear a helmet. __________

Parents with children must initial after reading the following: I am aware of and have
discussed the following with my child:
1. Being in contact with horses risks injury from falling, being stepped on, trampled, bitten or
kicked.
2. Others may act in a negligent manner which may result in harm to my child.
3. Certain risks associated with outdoor activities could occur, including but not limited to,
contact with poisonous plants, stinging insects, wild animals and inclement weather.
4. Certain activities may involve use of sharp or heavy instruments (pitchforks, equipment,
etc.) which could result in harm to my child if used by anyone in an other-than-originallyintended manner.
5. I have discussed with my child the importance of following rules and procedures and failure
to act in a safe and responsible manner may result in expulsion.

If any legal action or other proceeding is brought in connection with this Agreement, the successful or
prevailing Party shall be entitled to recover reasonable attorneys fees and other related costs, in addition
to any other relief to which the Party is entitled.

UNDER KENTUCKY LAW, A FARM ANIMAL SPONSOR, FARM ANIMAL

PROFESSIONAL, OR OTHER PERSON DOES NOT HAVE THE DUTY TO ELIMINATE
ALL RISKS OF INJURY OF PARTICIPATION IN FARM ANIMAL ACTIVITIES, THERE
ARE INHERENT RISKS OF INJURIES THAT YOU VOLUNTARILY ACCEPT IF YOU
PARTICIPATE IN FARM ANIMAL ACTIVITIES. Kentucky Statute Title XXI, Chap.
