Department of Environment Regulation (DER) has investigated the matter and provides the following advice based on information provided by Buru: 1. The site depicted in the YouTube video appears to be at the Yulleroo 3 gas well site. The entire Yulleroo 3 site is fenced with 1.8 metre-high cyclone mesh fencing and a locked double gate, in order to prevent unauthorised persons and large animals from accessing the site; 2. A Yawuru Traditional Owner is employed by Buru to undertake checks of all Yulleroo well sites. These checks occur between two and three times a week and include checks of ponds, fences and gates. Fences and gates at Yulleroo 3 have been recently checked and found to be intact; 3. The pond that the goanna was swimming in is located at the back of the Yulleroo 3 well site where rainwater has collected over the recent wet season. It is linked to a scoop drain that was installed around the well site. The contents of this pond is therefore rainwater, not toxic or radioactive tailings; 4. Buru is currently reviewing egress materials used on all open excavations and ponds Company-wide with a view to move towards egress ladders (as opposed to ropes), which will make for an easier escape path for fauna that becomes inadvertently trapped in ponds. This review is supported by DER and also the main regulatory agency for the Yulleroo site, the Department of Mines and Petroleum (DMP); and 5.
