ARTICLE I: NAME

Section A. Our official school name shall be Buhach Colony High School.
Section B.We, the students of Buhach Colony High School, shall be called Thunder
Section C. Our official school colors shall be Vegas gold and black.
Section D.Our school mascot shall be Thor the Norse god of Thunder.
ARTICLE II: GENERAL PURPOSE
Section A.We the students of Buhach Colony High School, in order to promote unity among the
students, staff, and administration, to foster a better understanding of democratic government,
to enhance progress in educational, cultural, social, and athletic interests, in a manner
consistent with the administrative policy, do hereby ordain this document to be the constitution
for the Student Body of Buhach Colony High School.

ARTICLE III: POWERS VESTED

Section A.The purpose of this organization shall be:

1. To create a channel through which students can express and take part in the management of
school.
2. To establish and maintain a cooperative spirit between students and the faculty,
administration, and community.
3. To encourage school pride within the school and the community.
4. To establish a functional training experience in democratic self-government.
5. To guarantee freedom of speech while within the framework of this Constitution.
6. To guarantee individual rights on the basis of equality, and not on race, color, or creed.
7. To guarantee freedom to assemble and to organize for discussion or for the advocacy to
petition, to propagandize via printed matter, spoken word, or other non-violent means while
within the framework of the Constitution, the California Education Code, Title V, Administrative
Code, and regulations.

ARTICLE IV: MEMBERSHIP

Section A.All regularly enrolled students of Buhach Colony School shall be members of this
association.
Section B.Involvement in any constituted club, organization, or activity as member or as a
leader will require membership as a student or staff member currently enrolled or working and
accredited at Buhach Colony High School, unless special administrative permission is given.
Section C.All Student Body members shall be subject to laws and restrictions, rights and
privileges, all which are stated in the Constitution.
Section D.All faculty members shall be considered honorary members of the Associated Student
Body.
ARTICLE V: OFFICERS AND QUALIFICATIONS
Section A.The Executive Council shall consist of the following elected offices:
1. Student Body President
2. Vice President
3. Secretary
4. Treasurer
5. Director of Activities
6. Director of Athletics
7. Director of Publicity
8. Commissioner of Rallies and Assemblies
9. Class Presidents or their designated representatives.
Section B.The Executive Council shall also consist of the following appointed offices.
1. Commissioner of Clubs
2. Commissioner of Dances
3. Commissioner of Lunch Time Activities
4. Commissioner of Technology
5. Commissioner of Renaissance

6. Commissioner of Character Counts

Section C.Each class shall elect, by the vote of the members of that class:
1. Freshmen Class President, Vice-President, Secretary, Treasurer, and two Legislators.
2. Sophomore Class President, Vice-President, Secretary, Treasurer, and two Legislators.
3. Junior Class President, Vice-President, Secretary, Treasurer, and two Legislators.
4. Senior Class President, Vice-President, Secretary, Treasurer, and two Legislators.
Section D. Additional officers to be appointed or elected if necessary are as follows:
1. Parliamentarian
Section E.All Executive Council and Class Officers must be members of the Buhach Colony
High School Associated Student Body.
Section F.All Executive Council officers and sophomore, Junior and Senior Class Offices shall
be selected in the spring of the previous school year. In the elected positions, the candidate
with the majority of votes will be the new position holder.
Section G. Class officers shall also serve as members of the Executive Student Council.
ARTICLE VI: DUTIES OF OFFICERS
Section A.Student Body President:
1. Shall maintain and enforce the Constitution.
2. Shall preside at all meetings of the Executive Council.
3. Shall have the responsibility of and the authority to coordinate all Associated Student Body
activities and perform any other duties that ordinarily revolve upon such an office.
4. Shall prepare an agenda for each Student Council meeting.
5. To oversee the execution of all final policy and legislative decisions.
6. Shall have the power to make appointments to any committee deemed necessary.
7. May temporarily create any committee he/she deems necessary. This committee may be
approved by a simple majority vote of the Associated Student Body Officers.
8. Shall represent the Associated Student Body on all community and advisory committees or
appoint a representative to serve in that capacity.
9. To call special meetings of the members of the Student Body, Executive Council, Student

Senate. and Club Council.


10. Put matters before the Associated Student Body Government to vote.
11. To perform all other duties ordinarily incumbent upon a president.

Section B.Student Body Vice President:


1. Shall conduct and regulate all general and special elections of the Student Body.
2. To advise the Student Body President in all pertinent issues.
3. Shall serve as Student Body President in case of absence, resignation, or removal from the
office of President.
4. The Vice President will preside over the following:
a. The Executive Council in the absence of the Student Body President.
b. The organization of the Freshmen Class.
c. The Student Senate as the Speaker.
5. Prepare an agenda and preside at all meetings of the Student Senate.
6. Call special meetings of the Student Senate when necessary.
Section C.Student Body Secretary:
1. Shall handle all correspondence for the Student Body President.
2. Shall record and file the minutes for the Executive Council and make these minutes available
to all interested parties.
3. Shall take charge of and keep filed all papers, resolution, and other records of the
proceedings of the Student Council.
4. Advise the Executive Council as necessary concerning the needs of the office.
5. Assist and advise the Director of Student Activities in maintaining the master calendar for the
school.
Section D.Student Body Treasurer:
1. Shall have charge of all Student Associated Body funds.
2. Shall be responsible for payment of all authorized purchases.
3. Shall keep records as to sales and purchases of all Associated Student Body fundraising

activities.
4. Shall prepare a financial report at least once a month and submit it to the Executive Council
for approval.
5. Act in an advisory capacity to the Executive Council on financial matters.
6. Act in an advisory capacity to Class Treasurers on financial matters.
7. Help prepare the annual Associated Student Body budget.
8. Shall be authorized to approve any one financial transaction of no more than $500.00.
9. Keep record of budgets of all Class Councils, Clubs and Organizations.
10. Will collaborate with the school accounting technician concerning Associated Student Body
accounts.

Section E.Director of Activities:


1. Shall be responsible to the President for all Associated Student Body social activities
(assemblies, dance, lunch time activities, etc.)
2. Shall be in charge of processing all activity requests.
3. Shall coordinate and work with the Commissioners of Clubs, Dances, Lunch Time Activities
and Rallies and Assemblies while creating and updating a school activity calendar.
Section F.Director of Athletics:
1. Shall act as liaison between the Athletic Department and the Executive Council.
2. Shall be responsible for the keeping of the individual records for the awarding of school
letters and for the filing of these records with the Secretary.
3. Shall be in charge of making all Athletic Certificates.
4. Make a monthly report to the Executive Council.
Section G.Director of Publicity:
1. Shall insure proper publicity for designated extra-curricular activities of the Associated
Student Body (posters, fliers, bulletins, announcements and the various marquees on campus)
2. Be responsible for the public relations and communications of the Associated Student Body
Executive Council with the general student body, other schools and the community.
3. Be responsible for the publicity of all student events, especially those events put on by the
Executive Council.

4. Work with the Spirit Leaders and other clubs, organizations, and committees for the purpose
of publicity.
5. Arrange spirit bulletins (ex: class competition board) and posters for student activities
throughout the year.
6. Work with the faculty on student/teacher relations and communications.
Section H.Commissioner of Rallies and Assemblies:
1. Shall schedule, organize, coordinate and plan all rallies under the direction of the Director of
Activities.
2. Shall maintain a record of all class spirit points.
3. Carry out duties and responsibilities upon request of the Executive Council, Associated
Student Body President, or Director of Student Activities

Section I.Commissioner of Clubs


1. Meet with all Club Presidents, Representatives and Advisors on a regular basis to keep a
schedule of club activities and know when club meetings are taking place.
2. Represent Clubs concerning club business during Executive Council Meetings.
3. Make sure all Clubs are following the Associated Student Body Constitution and their own
club constitution in carrying out official business and activities.
4. Make sure all Clubs are turning in their minutes to the school accounting technician.
5. Work with the Vice President to organize food fairs.
Section J.Commissioner of Dances
1. Shall plan, schedule, and coordinate, all school dances under the direction of the Director of
Activities.
2. Shall be responsible for obtaining and contracting bands/DJs for all school dances.
3. Shall assist all organizations in planning dances.
4. Shall be responsible for all decorations of dances.
5. Shall be responsible to overseeing all dance ticket sales; including clubs.
Section K.Commissioner of Noon Time Activities:

1. Shall plan, schedule, and coordinate all noontime activities under the direction of the Director
of Activities.
2. Shall organize all contests, tournaments, games, etc.
3. Shall plan, coordinate and oversee the playing of music during lunch.
4. Shall be required to get requisitions and proper supplies prior to the day of.
Section L.Commissioner of Technology:
1. Shall assist the Director of Activities in updating and keeping current the Buhach Colony High
School web site.
2. Will assist the Commissioner of Rallies and Assemblies with the operation of the sound
system and/or technological special effects.
3. Will assist the Director of Publicity when theres a need for technological support for the
public relations and communications of the Executive Council with the general student body,
other schools and the community.
4. Will perform any other duties that ordinarily revolve upon such an office.
Section M:Commissioner of Renaissance:
1. Shall assist Commissioner of Rallies and Assemblies in planning Renaissance Rallies
quarterly.
2. Will be responsible for making certificates for Renaissance recipients; staff, students and
communities
3. Shall coordinate with data entry, Activities Director, and the schools contracted photographer
to print Renaissance cards quarterly.

Section O. Parliamentarian:
1. Shall serve as an advisor to the Executive Council on all matters relating to proper meeting
procedures.
2. Will assist the Commissioner of Clubs in organizing club structures and overseeing club
meetings to ensure proper procedures are followed.
3. May attend meetings of the Executive Council to oversee proceedings and make
recommendations to members as needed.
4. May advise the presiding officer or other members on rulings of parliamentary law.
5. Will assist the president in maintaining order during meetings of the Executive Council.

6. May participate in meetings of the Executive Council with permission granted by the Council.
7. Will be responsible for assisting in the execution of parliamentary law within the Associated
Student Body and any other organized group within the school.
8. Shall serve as an interpreter of all official documents of the Associated Student Body.
9. Shall be responsible for any other matters which regard parliamentary law that may arise.

Section P. Commissioner of Character Counts


1. Will promote the Six Pillars of Character Counts (Responsibility, Trustworthiness, Respect,
Caring, Fairness, Citizenship).
2. Will plan and organize the Character Counts Week
3. Will Find creative ways to promote No name calling week.
4. Will Find creative ways to promote Anti-bullying.
5. Will Recognize and promote monthly Students/Staff Caught with Character
6. Shall only be open to students who will a sophomore, junior, or senior at the time of holding
office.

Section Q. Class Presidents, Vice Presidents, Secretaries, and Treasurers:


1. The President shall be head of the class, run all class meetings, be a voting member of the
Associated Student Body Executive Council, help plan all class activities, and work with the
class advisors. The President shall carry out any correspondence directed by the Class Advisor
or Associated Student Body President. The President will also call Class Meetings or Class
Officer Meetings as necessary.
2. The Vice-President shall assume the powers of the President in the Presidents absence or
removal from office, assist the President in planning and carrying out class activities, and be a
voting member in the Student Senate.
3. The Class Secretary shall keep minutes of all Class meetings and shall vote in all class officer
meetings.
4. The Class Treasurer shall create a purchase order log, a fundraiser list and a bill list, upon
approval of Class Officer meetings and shall assist in planning and carrying out all class
activities.
5. All Class Officers shall be responsible for supporting Associated Student Body activities as
well as supporting the activities in the perspective classes.

ARTICLE VII: ELECTION OF OFFICERS


Section A.No student may run or hold more than one Student Body or Class Office at the same
time.

Section B. The Vice President with the approval of the Director of Student Activities shall
designate a day of elections and develop a system of accountability, which will supervise the
printing, distribution, collection, polling areas, and counting of ballots.

Section C. Candidates will be approved to run for office when they fill out the necessary
paperwork and are certified by the Vice President and Director of Student Activities as official
candidates.

Section D. A candidate for the Associated Student Body office shall be designated as the duly
elected holder of that office if he/she receives a simple majority (50% + 1) of the votes cast at
the on the following basis: 25% campaigning, 25% interview, 25% popular vote, and 25%
recommendation from teachers, current officers, and the Director of Student Activities. A system
for scoring each section and deciding how it factors into a final result must be adopted by the
Executive Council each year. A primary, general, or special election or special election by
delegates will be held to fulfill the popular vote.
1. Primary Election: Any candidate receiving a simple majority (50% + 1) of the votes in this
election shall receive the highest possible scores for this section, depending on the system
devised for that year. be designated as the duly elected holder of that office. If no one
candidate receives a simple majority, the two candidates who receive the most votes shall be
eligible to run in the general election.
2. General Election: This is the run-off election between the top two candidates of the primary
election.
3. Special Election: Any election, which is conducted in addition to the primary or general
election.
4. Special Election by Delegates: A convention (i.e. Election Convention) that is conducted with
a delegation of students that may be held as an alternative to a primary election.
Section E. Every person who desires to have his/her name counted for a particular office shall
meet all election requirements as stated in Articles IV and VII.

Section F. All Executive Council officers shall be selected in the spring of the previous school
year. In the elected positions, the general associated student body will elect the candidate. The
majority of votes will be the new position holder.

Section G. Each individual class, excluding the Ninth Grade, shall elect its officers following the
election of the Executive Council, whose terms of office shall begin with the last school day of
the year elected and end with the last school day of the year in office.

Section H. Commissioners offices that are appointed will be held following the election of class
officers. Candidates must fill out an application and will be interviewed by the Director of
Student Activities, outgoing Student Body President, and outgoing Student Body Vice President.
Other commissioners may be included in the committee as deemed necessary by the Director
of Student Activities.

Section I. The entering eighth grade members of the Association shall vote for Class Officers
within the first month of the school year. Their terms of office shall begin immediately upon
election and end with the last school day of the year in office.

Section J. Candidates for the office of Student Body President and Vice President must be of
the highest ranking class when holding the office.
Section K. All elected and appointed officers must have at least a 2.5 grade point average in all
course work they undertake at any high school during the semester prior to running for office,
and they must maintain at least a 2.5 grade average while holding office.
Section L. Student council shall determine ASB policy by a majority vote when there is a
question or confusion to the election process.
Section M. No position is finalized until the student council puts the names on the silent ballot at
the beginning of campaigning.

ARTICLE VIII: RECALL AND VACANCIES OF OFFICERS


Section A. A two-thirds majority vote by the Executive Council or Class Councils will remove an
officer who fails to fulfill his/her obligations or fails to uphold the dignity of his/her office. The
Council shall then make a recommendation to the Director of Student Activities to remove the
officer from office. A two-thirds majority vote by the Executive Council or Class Councils will

Section B. No member shall be removed without due process and the opportunity to present a
defense.

Section C.Associated Student Body officers who are required to attend the Executive Council
meetings must do so or such members will be removed from office. Three unexcused missed
meetings by any member will result in loss of member privileges or automatic dismissal from the
Executive Council. There will be exceptions to this requirement in cases of emergencies or
other special circumstances.
Section D. Upon petition of twenty-five (25) percent of the student body demanding the recall of
any Executive Council or Class Officer, a recall election must be held. The recall petition must
state the reason for the recall. The officer subjected to the recall shall have the opportunity to
defend themselves before the general student body. The petition will be brought before the
Executive Student Council to decide if action should be taken. The recall election must be held
within two weeks of the receipt of the petition and the verification of the signatures. A two-thirds
vote of No Confidence from the Executive Council is necessary for recall and removal. A
supermajority of the entire student body would also be sufficient to remove an officer if such
method is desired. The member under investigation may not be present when a vote is taken.
The vote must not be taken sooner than 2 weeks after complaint is made. No officer may be
removed without the final approval of the Director of Student Activities, however, action may not
be taken without a vote to do so by the Executive Council.
Section E. Members of the Associated Student Body may submit an anonymous request for the
investigation of Officers, Elected or Appointed Commissioners, or other members of the ASB for
possible cause for removal. A petition from twenty-five percent of the student body is not needed
in this case.
Section F.The Student Body Vice President shall assume the office for the remainder of the
term in the event of permanent disability or ineligibility of a Student Body President, provided
that the Vice President is fully qualified to administer this office properly, as determined by the
Director of Student Activities. In the event the Vice President is unqualified or unable to fill the
office of President a special election will take place to elect a new President.
Section G.In the case of vacancy of any other Student Body Officers, including Commissioners,
the Executive Council shall elect a replacement with a majority vote within two weeks of the
vacancy of office. Unelected commissioner positions will be filled through the process described
in Article VII, Section H.
Section H.In case of vacancy in the office of Class President, the Vice President assumes the
duties of the President, and the class follows the procedure for filling the office of Vice President
as described in the following section.
Section I.In case of vacancy in the office of Class Vice President, Secretary, or Treasurer, the
office shall be filled by a person of that class recommended by the Class Officers and approved
by the Executive Council.
Section J. Any officer who is suspended or subject to other major disciplinary actions due to
violations warranting to do so under campus regulations shall be removed from office
immediately. Section D of this article does not apply in this circumstance. The vacancy shall be

filled according to Section G.

ARTICLE IX: MEETINGS AND SPECIAL SESSIONS


Section A.All official meetings shall follow Roberts Rules of Order and minutes must be taken.
There must be a quorum in order to hold an official meeting. A majority of the voting officers
shall constitute a quorum. Members of the organization can only make motions.

Section B.The Executive Council:


1. Shall hold a business meeting once a week to discuss campus activities, approve funding,
make decisions, and set policies.
2. Will hold a night meeting once a month, which is opened to the public, during the academic
year to discuss issues pertinent to the school.
3. The Student Body President will preside over the Executive Council and will determine when
Executive Council meeting will take place.
4. Three unexcused missed meetings by any member will result in loss of member privileges or
automatic dismissal from the Executive Council. There will be exceptions to this requirement in
cases of emergencies or other special circumstances. Three tardies are equivalent to one
absence.
5. No member of the Executive Council will hold more than one Associated Student Body Office.
6. All Executive Council members and class Vice Presidents must be enroll in one period of
Leadership class during their term in office.
7. The term of office will be one school year.
8. The Director of Student Activities shall have no voting power. He/She may advise but not
initiate any action.
9. The Executive Council shall conduct business as a deliberative assembly of an organized
society.
10. The Executive Council, with the permission of the president and vice president, may elect a
president pro tempore for procedural purposes only. The president pro tempore must relinquish
the chair when the meeting is adjourned or upon the request and/or majority vote from the
council.

Section C.Class Organizations:

1. Each class shall hold an official meeting once a month to discuss class activities, approve
funding and make decisions pertinent to their class.
2. The Class President will preside over the meetings and will determine when each meeting will
take place.
3. No member of a Class Office will hold more than one office.
4. Each Class President will be enrolled in one period of Leadership class during their term in
office.

Section D.Student Senate:


1. Shall meet at least once a month per semester during a student council meeting and once
quarterly separately to discuss any issues within the Associated Student Body and/or other
issues on campus. The Executive Council shall address these concerns and take actions
necessary to correct the problem.
2. The Student Body Vice President will preside over the Student Senate as Speaker.
3. This shall not be a voting body except under special circumstances where another voting
body is desired by the Executive Council.

Section E.Club Council:


4. School clubs shall be authorized to participate in campus activities only when organized in
accordance with the following procedures:
b. Must first secure a faculty advisor
c. Must then request permission from the Director of Student Activities to hold a meeting for the
purpose of developing a statement of purpose, a budget and a Constitution.
d. Must then submit a statement of purpose and a Constitution to the Club Council Student
Senate for approval or rejection.
e. The Club Council Student Senate shall determine whether to recommend to the Director of
Student Activities, that the club be approved, disapproved, or referred back to the petitioning
committee for additions, deletions, or revisions to the basic information required under
subsections, (a) through (e) held under the advisement pending further study, or referred back
to the Director of Student Activities without recommendation.
f. If both the Director of Student Activities and the Club Council Student Senate approves the
petition for formation of the club then the Director of Student Activities shall forward a written
recommendation pertaining to recognition of the club to the Secretary, MUHSD Board of

Trustees, after preceding preliminary requirements have been satisfactorily fulfilled.


5. The Commissioner of Clubs will head the Club Council Student Senate in conjunction with the
Student Body Vice President.
6. The Club Council Student Senate will consist of the Commissioner of Clubs, the Student
Body Vice President, the President of each chartered club, as defined in Article VI, Section I,
and two legislators from each class.
7. The Club Council Student Senate shall act as a coordinating body for the purpose of
regulating club activities and projects, as well as a communication link between the Executive
Council, the clubs themselves, and the classes. The Council Senate will also serve as a
supportive, problem-solving group.
8. Any club wishing to sponsor a school related activity must submit an activity request to the
Director of Activities at least two weeks prior to the activity.
9. Clubs sponsoring an activity must show evidence to the Director of Student Activities that
such an activity is properly organized. Upon evidence of lack of plans, the Director of Student
Activities may either allow it to operate or cancel the activity.
10. The Council Senate may review activity requests to prevent conflicting dates and interests.
If approved, the activity shall be placed on the Activity Calendar.
11. All clubs failing in the judgment of the Commissioner of Clubs and Director of Student
Activities to properly clean up after the activity will be charged for the time of the Janitor and
cleaning materials.
12. The Council must meet a minimum of one time per quarter or at the discretion of the
Commissioner of Clubs and ASB Vice President.
Section H. Referendum
1. A petition from at least five hundred (500) students for a particular issue or initiative will be
taken up as a Special Order of business during the next Executive Council meeting.
2. The petition must also be endorsed by at least 5 members of the teaching staff or
administration or a combination thereof.
3. The petition for initiative does not guarantee that the initiative will be adopted by the
Executive Council. Receiving the required endorsements will demand that subject initiative be
introduced to the Executive Council.
4. After receiving the minimum number of signatures, a referendum must be properly submitted
at least one week before an official meeting of the executive. Failure to do so will result in
postponement for consideration until the next regular meeting.

ARTICLE X: RIGHTS AND RULES


Section A. Access to the Constitution and official documents
1. All members of student body shall have the right to review the ASB constitution upon
demand.
2. All members of the student body shall have the the right to review all official motions, rules, or
legislation that has been adopted or is in consideration by the student government.
3. Sensitive materials may be withheld from public view by the Director of Student Activities or
the administration.
Section B. Adoption of Rules
1. The Associated Student Body may adopt rules not already contained within the constitution
that apply to ASB procedures or conduct.
2. Rules adopted by the ASB do not need to be added to the constitution and do not need to be
treated as constitutional amendments provided that they are not contained within the
constitution.
3. Any rules adopted, whether part of the constitution in the form of bylaws or as a separate
motion, will have equal effect on the subject they pertain.

ARTICLE XI: METHOD AND PROCEDURE FOR RATIFICATION OF THE CONSTITUTION

Section A.The Constitution should become effective when submitted to the general student body
in a special election. A majority of the votes cast is needed to approve a new constitution.

ARTICLE XII: PROVISIONS BY WHICH THE CONSTITUTION MAY BE AMENDED

Section A.The Associated Student Body President may, with the approval of the Executive
Council, appoint a committee to revise the constitution or other amendments. The revision,
after passing the Executive Council by a simple majority, will may be submitted to the Student
Senate for a two-thirds approval vote if such action is desired. Once approved will then be
submitted to the general student body in a special election. A majority of the votes cast is
needed to approve a new constitution. The amendments must be made available to the student
body for review prior to any vote. A vote by the student body may be taken in the form of
unanimous consent given that there are no objections. If objections are raised, the query may

be heard in entirety before a full vote of the student body is cast.

Section B.If the general student body does not pass the constitution, it will be referred back to
the committee for additions, deletions, and/or revisions.

Section C.If the constitution is approved then the Director of Student Activities shall forward a
written recommendation to the Secretary of the MUHSD Board of Trustees for their approval.
