CASE MANAGEMENT ORDER NUMBER 1

This Case Management Order will govern all future proceedings in this case.

1. All fact discovery will be completed by November 30, 2009.

2. Plaintiffs will identify all experts whom they will call to testify at trial and

produce the Curriculum Vitae and Expert Reports of such Expert Witnesses no later than

October 9, 2009.

3. Defendant will identify all experts whom they will call to testify at trial and

produce the Curriculum Vitae and Expert Reports of such Expert Witnesses no later than

October 20, 2009.

4. The parties will identify all rebuttal experts whom they will call to testify at trial

and produce the Curriculum Vitae and Expert Reports of such Expert Witnesses no later than

October 30, 2009.

5. All expert depositions are to be completed by November 15, 2009.

6. All expert witness discovery will be completed by November 16, 2009.

7. Any party wishing to file dispositive motions must do so by December 31, 2009.

8. Responses to dispositive motions must be filed by January 15, 2010.

9. Any reply to the response to a dispositive motion must be filed by January 22,

2010.

10. Oral argument on any dispositive motions will be set by the Court.

11. Within ten (10) days of the Court’s ruling on any dispositive motion, or within

ten (10) days of the close of discovery, if no dispositive motions are filed, the parties will submit

a proposed schedule for the filing of pretrial motions, including any evidentiary motions and

proposed findings of fact and conclusions of law.

12. If no dispositive motions are filed, the parties shall be ready for trial no later than

February 1, 2010. If such motions are filed, the Court will expedite decision and the parties shall

be ready for trial by March 1, 2010.
