Tentative Ruling: (1)To Deny Plaintiffs'Motion to Set Case Management Conference; (2)To Grant Plaintiffs'
Motion to Re-Open Discovery and to Order that all Discovery deadlines will be calculated from the current trial
date of December 17,2012; (3) To Deny Plaintiffs' Motion for Order Compelling Defendant Nicholas Hoffman to
Answer Discovery Demands.
This matter is currently set for trial in this department on December 17,2012. No further Case Management
Conference is necessary.
Discovery is properly permitted based on deadlines calculated from the current trial date in order to permit
the parties to complete discovery on the merits of this matter.
Plaintiffs' have improperly included a request to compel discovery responses within a motion requesting
other relief. A separate motion will be required. Further, any such motion must be made in accordance with the
Code of Civil Procedure and the California Rules of Court. Based on the moving papers it appears that Defendant
may have provided at least some response to Plaintiffs' discovery. In such case, any new motion should be to
compel further responses to discovery. Plaintiffs must comply with the meet and confer requirements of the
Discovery Act.
lf no one requests oral argument, under Code of Civil Procedure section 1019.5(a) and California Rules of
Court, rule 3.1312(a), no further written order is necessary. The minute order adopting this tentative ruling will
become the order of the court and service by the clerk will constitute notice of the order.
