Unfortunately, that's exactly what a controversial new law in Pennsyivania says. Last October, the Pennsyivania state legislature fast-tracked a bill caled the Revictimization Relief Act, which targets the free speech of incarcerated and formerly incarcerated people. The bill was passed in reaction to a commencement speech that the well-known state prisoner Mumia Abu-Jamal gave via a recording at his alma mater, Goddard College, and then-Governor Tom Corbett signed tn a public ceremony on the streets of Philadelphia. The law allows crime victims, prosecutors, or the Attomey General to sue anyone with a ‘personal injury crime” conviction for speaking publicly if they think such speech will create "a temporary or permanent state of mental anguish” for the victim. This law—also known as the “Silencing Act’—wil have a chilling effect on prisoner speech in general, but it wil have a unique impact on wrongfully convicted Prisoners like myself. With the already-strict uidelines and procedures that innocent prisoners have to abide by in our efforts to prove our innocence, this new law sabotages ‘our rights under the First and Fourteenth Amendments, making it much more difficult for Us to advocate for ourselves, For innocent prisoners, this law means that if we speak out about our cases— whether it's through a TV or radio interview, an article for a magazine, a letter to the editor, of a blog post online-—if the victim's family doesn't lke it, they can claim we ‘caused them "mental anguish” and bring a lawsuit against us in civil court. What's more, the Silencing Act also allows prosecutors and the Attorney General to bring such a lawsuit forward without even consulting the victims. Social media has played an integral part in helping exonerate innocent prisoners, over 125 of whom were freed in 2014, For those of us in Pennsylvania, our chances of advocating successfully for our exoneration will all but evaporate if this law stands. Under the Silencing Act, innocent prisoners could face arbitrary censorship, be forced fo pay the other party's attorey fees, and be targeted for speaking out against the injustice we continue to face. At first, was so eager te lexrn everything that | had to slow down and exercise patience. My trainers taught me discipline, which brought about a calmness that I'd never known before. After a couple months of tralning-—and, eventually, sparring — | fell in love with boxing and decided I wanted to become a fighter. Every day, Iran straight {from school tothe gym to join my friends and boxing family. The time finally came when my coach said | was ready to fight. I got ten dollars from my family for the fee for my American Boxing Federation card, which I needed to fight in tournaments. My family saw I was serious about boxing and supported me. | entered my first junior tournament, won my frst two fights, and then lost the third in the semifinals, ‘That frstloss crushed me. I took it hard and felt I had let my boxing team down. So Ihit the gym with a vengeance, vowing to become the best I could be. ‘Within a year's time, I won my first “Kids Glove" tournament and a couple others. | guess tasting defeat gave me more energy, because I didn't want to endure it again. I began fighting more often. Our boxing team went to every fight card or tournament in the New York City area. So had to stay in shape and be ready. What created the biggest firein me was entering the New York City Junior Olymples tournament in 1987.1 won and earned an invitation to represent New York City in the New York State Junior Olympics in Lake Placid, ‘New York: Senior fighters such as former Heavyweight Champion Riddick Bowe would also be there fighting in the adult US. Olympic Trials fora spot on the 1988 Olympic Team. [After three weeks of intense training the time came for me to go to Lake Placid. My coach ‘was not taking the trip, which meant | would have corner men | didn't know. My friend Brian O'Shea was going to fight, too. We boarded a bus along with the New York City Boxing Team. It was the frst time [was ever away from home. All had to do was win two fights and I would win the gold medal in my weight class. If ost, I would be eliminated. My first fight was against a kid from New England, | won and advanced to the finals, where | would fight againsta kid from Adirondack. | wound up winning the gold. The feeling of calling my ‘mother and coach telling them I'd won was indescribable. Returning with the gold medal around my neck was priceless. | went on to fight and win in numerous other fights and tournaments. Alot of my boxing teammates went on to turn professional. At the age of 22, my whole life would change for the worse when I was wrongfully charged with, and eventually convicted for, a murder! hhad nothing to do with, or even knew about. For the past 19 years straight, I've been in the fight of my life—literally fighting for my life, 1 briefly won my freedom in 2012 through a decision on October 5, 2011 by the Federal ‘Third Circuit Court of Appeals. That was short-lived when the U.S. Supreme Court reinstated my wrongful conviction without exercising normal procedures and allowing my legal team to file briefs or make oral arguments. You would think because I won my freedom on the grounds of insufficient evidence (equivalent toa “not guilty" verdict and barring a retrial, the US. Supreme Court would want to hear my attorney's perspective, But this was not the case. | went back to prison to keep on fighting from the irside. After I turned myself back in, an all-out investigation by my legal team went into fll effec, What they uncovered is not only shocking, but shows the lengths that the crooked detective and prosecutor in my case went to in their efforts to conceal my innocence. I've been maliciously prosecuted for nineteen years and counting. Before tral, the prosecution never turned over the first elght pages of ‘my case discovery.
