Response to your lettor dated February 15, 2012
‘As per your request, full disclosure was provided to Shane Wagner, Federal Prosecutor on March.
23, 2012. | reviewed the full disclosure of material as well as spoke directly to certain police
officers which will address the question regarding your client in a cell without water to the sink and
toilet and your client not given her bra back.
Miss Pelly was subject to an investigation under the Controlled Drugs and Substances Act. Itis
‘not uncommon for either gender to try and conceal a controlled substance while in transport or
prior to interaction with the police. Miss Pelly was transported to the Yorkton cells by police on
2012-02-09 at 00:19 hrs., at which time, Cst. Colin Stark instructed the guard to turn off the water
to Miss Pelly’s cell in the event Miss Pelly had concealed a controlled substance and would attempt
to destroy evidence. Miss Pelly was searched by two female police officer's, Cst. Joelle Salyn
and Cst. Karen Vicente and no further evidence was seized, According to the cell video which is
part of disclosure, Cst's Salyn and Vincente were the only police officers present with Miss Pelly
during the search,
While Miss Pelly was being lodged in cells, she stated she has asthma and required an inhaler.
Cst. Salyn gave Miss Pelly @ cup of water and contacted EMS who arrived within 10 minutes.
Miss Pelly was assessed by EMS Paramedic's who determined her oxygen levels were normal and
she was just upset’. Cst. Stark instructed Cst, Salyn and Cst. Vicente to have Miss Pelly remove
her bra ift had a wire support as ferale prisoners have used the wire in the bra to cause damage
to the walls and door ofthe cell as well as used their bra to aid in self-harm behaviour.
| spoke to Cst. Nieman, the primary investigator who recalled Cst. Stark talking about having the
(guard turn off the water, but they did not have any further discussions, Due to the lack of
‘communication, it wasn‘ until 14:20 hrs., when the guards brought it to Cst. Nieman's attention that
he instructed the guard to turn the water back on to Miss Pelly’s cel.

| de-briefed the members from Yorkton Provincial GIS regarding the investigative strategy of
turning off the water to a prisoner's cal to prevent the destruction of evidence to be conducted in a
timely manner. In this particular case, the lack of communication and the time of day left Miss
Pelly in a cell without water for a period of 14 hours which was unacceptable.
(On behalf of the investigator's involved, please pass on to Miss Pelly our sincere apology for
having the water turned off to her cell for that extended period of time.
