Advance Increment

Entitlement of advance increment is only on improvement of "educational


qualifications" i.e. on acquiring F.A/F.Sc., B.A./B.Sc. and M.A/M.Sc.--These
qualifications were not strictly related to one's profession and were academic in
nature--Appellant was rightly given advance increment and it could not have been
withdrawn, nor could amount relatable to it be recovered--It was paid under the
then existing policy--Any subsequent change therein would not disturb a
transaction past and closed--Held : A vested right already created could not be
divested by any subsequent change in law or policy--Any executive fiat would
always be prospective and not retrospective--Appeal allowed. PLJ 1996 Tr. C.

Higher qualification--Ground of--Appellant had passed BA. examination and
had also acquired C.T. Course, which is condition for getting advance increments-Held: Appellant is, therefore, entitled to advance increments from date of passing
