Construction, Management, Coordination, Supervision & Delivery of Ireo’s Mixed Use Project- Hotel & Commercial Buildings (Office & Retail) ‘SPECIAL CONDITIONS OF CONTRACT GENERAL The following Special Conditions shall be read in conjunction with the “General Conditions of Contract’. The following clauses shall be considered as an extension of and not as a limitation of the obligation of the Principal Contractor. If there are any provisions in the General Conditions of Contract, which are at variance with the provisions in these Special Conditions, the provisions in these Special Conditions shall take precedence. ‘SCOPE OF CONTRACT ‘The Scope of Work as defined in Clause 11 of the GCC shall include = Earthwork for foundations Dewatering ~ Waterproofing works for rafts, basements and terraces , podium ~ _ Plain Cement Concrete, Reinforced Cement Concrete & Post Tensioning works. > MS structural works. = Masonry and Block works = Basement finishes. ~ External works: Landscape structural works, roads and pavements, boundary walls, - Allother necessary Civil and Structural works as defined and detailed in the Bill of Quantities B00) Mirage, suprise, coordinate and be espns fh nly complaon sd pertamance of all Other Specialty Contractors and Separate Contractor's work. ~ Preliminaries for its Work and for Other Specialty Works and Separate Works Principal Contractor shall carry out and complete the Work in every respect in accordance with the Contract, Drawings, Technical Specifications, Bill of Quantities, other documents forming part of Contract Documents and with the directions of Engineer-in-Charge and to the satisfaction of the Owner. SITE CONDITIONS: All equipments shall be suitable for satisfactory operation at the following Site conditions {indicative weather conditions) Maximum 50° Celsius, 90 % relative humidity ‘Minimum 2* Celsius, 20 % relative humidity ‘Storms with wind velocity above 70 Kmph, No extension of time will be entertained due to extreme weather conditions except act of God like earth quakes, storms ete APPROVAL FOR COMMENCEMENT OF WORKS ‘The Engineer-in-Charge (EIC) will handle Commencement Cerificate, No Objection Certificate, if applicable, for the permanent building works under this Contract, ‘The Principal Contractor shall be responsible for providing required notices to authorities and to obtain and retain with him at his own cost all other approvals from the statutory bodies pertaining to Construction, Management, Coordination, Supervision & Delivery of Ireo’s Mixed Use Project Hotel & Commercial Buildings (Office & Retail) Works under this Contract including the works of Approved Sub Contractors, Other Speciality Contractors as well as for temporary structures to be constructed at Site, ESI, PF, Tax Depts. Insurance etc. and any other approval required to faciitate performance of the Principal Contractor's Work under the Contract until its completion. Refusal by statutory authorities to issue completion / occupation certificate or any other approvals due to the Principal Contractor's failure to construct the buildings in accordance with sanctioned plans and for Specifications shall render the Principal Contractor liable for damages and in addition, render him liable to obtain such certificates at his own cost and all penalties due to the violation shall be paid by the Principal Contractor. ENGINEER-IN-CHARGE's INSTRUCTIONS 5:1 Engineer-in-Charge may, at his absolute discretion and from time to time, issue further Drawings and/ or verbal/ written instructions, details, directions, & explanations, which are hereafter collectively referred to “Owner's Instructions” in regard to 2) Variation or modification of the design, quality or quantity of Works or the addition fr omission or substitution of any work. b) Any discrepancy in the Drawings or between the Priced Bill of Quantities and/or Drawings and/or Specifications. ©) Removal from the Site of any defective materials brought therein by Principal Contractor and his Approved Sub Contractors and replacing with good quality ‘material therefore. Similarly coordinating with Other Specialty Contractors & ‘Separate Contractors for the same if the defective material is supplied by them, ) Removal andlor re-execution of any defective work executed by Principal Contractor and his Approved Sub Contractors. Similarly coordinating with Other Specialty Contractors & Separate Contractors for the same ifthe defective Work executed by them, ©) Dismissal from the Works of any persons employed therein. 4) Opening up for inspection of any work that has been covered up 9) Amending and making good any defects 1) Implementation of Health and safety measures 5.2 The Principal Contractor shall forthwith comply with and duly execute any work conveyed in such “Engineer-in-Charge’s Instructions” provided always that verbal instructions, directions and explanations given to Principal Contractor or his representative upon the Works by Engineer-in-Charge shall, i involving a variation, be got confirmed in writing by the Principal Contractor from the Engineer-in-Charge within seven days on a separate instruction form, 5.3. The Principal Contractor shall maintain a Site instruction file at the Site office. All instructions received from the Engineer-in-Charge relating to the Work shall be retained in the file. 5.4 The Principal Contractor shall maintain a proper record of Instructions given by it to Other Speciality Contractors and Separate Contractors in regards to coordination, management and supervision of Other Specialty Works and Separate Works DRAWINGS. Drawings forming part of the Contract are listed in Volume-4 of the Tender Documents. Further additional Drawings furnished by the Engineer-in-Charge from time to time shall also be deemed to form part of the Contract. Note that these additional Drawings will be detalled Drawings for the ‘execution of the Work and it shall not constitute any delay to the Work. WORKING DRAWINGS ‘Two copies of working Drawings for Architectural’ Structural works marked ‘Good for Construction’ ‘and duly signed by the Engineer-in-Charge shail be issued by the Engineer-in-Charge from time to, time to the Principal Contractor during the Contract period, including MEP and other drawings including those of Other Specialty Works and Separate Works based on which the Principal Contractor shall prepare ‘shop drawings’, method statements, sequence of various activities. on the Project, related submission of materials and its warranties etc. as required for approval of the Engineer-in-Charge and proceed with the Works. Working drawings are diagrammatic but shall be followed as closely as actual construction permits. Any deviations made shall be in conformity with the direction ofthe Engineer-in-Charge and wit the prior approval of the Engineer-in-Charge. ‘The Principal Contractor will need to study the precedence documents and bring to the attention of the Engineer-in-Charge any discrepancies through RF! format (Request for Information) |. Architectural drawings shall take precedence over Structural, Services and other Drawings in regard to all dimensions. All openings, levels and dimensions to be indicated in general arrangement Drawings prior to commencement of Work and submitted to Engineer-in-Charge for approval li. GA Drawings to be updated periodically as and when the new Drawings are issued by Engineer- in-Charge to make sure that all instructions are executed ii The Principal Contractor shall verity all dimensions atthe Site and bring to the notice of the Engineer-in-Charge discrepancies, if any. Engineer-in-Charge’s decision in this respect shall be final and binding iv. The Engineer-in-Charge reserves the right not to accept any of the works performed by the. Principal Contractor or his Approved Sub Contractors or Other Speciality Contractors. and Separate Contractors due to discrepancies between drawings, services openings, structural constraints, etc. and Principal Contractors will bear sola responsibility for ll remedial works required at his cost and No time impact tothe original programme. REFERENCE DRAWINGS ‘The Principal Contractor shail maintain on Site one set ofall Drawings issued to him for reference. The reference set will include all Drawings that form a part of the Contract. It will be the Principal 8 10. vision & Delivery of Ireo's Mixed Use Projec Idings (Office & Retail) int, Coordination, Sups Hotel & Commercial Bu Contractor's responsibilty to keep an updated record of all approved and superseded Drawings. Principal Contractor shall use updated Drawings for construction at all imes. COMMENCEMENT OF WORK / PERIOD OF COMPLETION The Principal Contractor shall commence mobilization for the Works immediately after receipt of the Letter of Intent and instructions to mobilise from the Owner. The mobilzation shall be completed within 30 (thity) days thereafter and Works shall commence soon after mobilization or during mobilisation. Time is the essence of this Contract. All Works as per this Contract shall be completed within the time specified counted from the date commencing after the end of the mobilization period Target dates for completion of construction for specified areas as mentioned in this Tender Document must be strictly adhered to. Principal Contractor shall work out a detailed Master Programme of Construction, adhering to the target dates, and submit it to Owner for approval, within fifteen days from the date of award ‘As Work is to be executed in an expeditious manner, Principal Contractor shall furnish to Engineer- in-Charge progress reports twice in a month (Fortnightly) detailing stages of work completed, work in progress and work to be taken up, also the consumption and stock figures relating to the various items of materials. He shall also furnish to Engineer-in-Charge the details of his procurement action in respect of all materials INFORMATION REQUIRED BEFORE ACCEPTANCE OF THE TENDER: ‘The Principal Contractor should include the folowing with their offer: Site Logistics Plan forthe entire construction period and machineries location pan Detailed Master Programme with labour histogram & milestones Cash flow proposals and S curve indicating weightage of each activity, Site organization chart clearly mentioning roles & responsibilties of each person ‘Organisation. chart of Principal Contractor's corporate office supporting Site clearly mentioning the role & responsibilties of each person. ‘Material procurement plan.(mported items should be allowed with enough lead period) Principal Contractor management staffing profile and organization chart Proposals for Quality Control (A separate POP to be prepared forall trades of work indicating \various inspections required at various stages of work and clearly indicating the tolerances. POP to be approved by Engineer-in-Charge prior to work and all holding points for inspection to be adhered to. Qualty control departments organization chart to be submited, | HSE Statement specifically for the Work. A safety pian specialy designed for this job to be submitted including all poicies, inspection check lists, formats to be used etc. Detailed study on edge protection, fan hoardings, loading platforms ,iting operations, ingress and egress to be included. j. Method Statements of various activites on Site including Temporary Works k. Proposals for formworks systems, number of formwork sets . system formwork and other formwork quantities to be used at various areas for horizontal and vertical elements, Non typical floor area, scaffolding systems & shuttering systems and its quantities, extemal scaffolding on cantilever platforms and for Other Specialty Contractors and Separate Contractors. Detailed analysis ofthe slab cycle time 1m. Analysis of batching plant proposals/ use of RMC 1. Any other proposals as per the requirement ofthe Works Caesars REPORTS & CHECKLISTS BY PRINCIPAL CONTRACTOR Principal Contractor shall maintain and make availabe all the records pertaining to reports, returns ‘and checklist to the Engineer-in-Charge during audits (internal as well as extemal) and make necessary corrections, additions and actions based upon the findings / observations of the audits. ‘The quality plan requirements are oulined in Appendix-A to this Special Conditions of the Contract, WATCH & WARD a. The Principal Contractor shall provide and maintain at his own expense, all lighting, guards, ‘encing, warning notices, and watching wherever and whenever necessary to ensure the safe and effective execution of the Works, Other Specialty Works and Separate Works. and to ensure the safety of all persons at Site in whatever capacity, all visitors to the Works and Other Specialty Works and Separate Works, and members of the General Public within or adjacent to the Works and Other Specialty Works and Separate Works. 'b. The Principal Contractor will have to define labour management, security, strategy for entry and leaving the Site based on technology suitable for this purpose. Any instruction! requirement of the Engineer-in-Charge with regard to safety shall not relieve Principal Contractor of his absolute responsibilty under this or any other relevant provisions cof Contract conditions. d._ The Principal Contractor shall be held entirely responsible for the security of the Site and the protection of the Works and all Other Specialty Works and Separate Works at all times inclusive of non working hours, during the Contract period. He shall be deemed to have included for all costs associated therewith, ‘e. Principal Contractor to keep sufficient nos. of cameras and required ancillary equipment as per the approval of the Engineer-in-Charge, on perimeter, entrance and exit of the Project. Camera feeds to the head in equipment and monitors will be displayed and controlled from the office and 7 day data recording & storage facility will be provided. MAINTENANCE OF ROADS, PATHWAYS, TRAFFIC CONTROL & SITE ACCESS Principal Contractor shall be entirely responsible for maintaining public roads private entrance road to the Site and access within the Site. These areas shall be fee from any materials of whatever nature being delivered to or removed from the Site and kept in a generally clean and safe condition. Wheel washing shall be provided at all exits from Site to avoid dirt & debris from ‘being deposited on the public and private roads. Such dirt and debris that gets so deposited shall bbe removed by the Principal Contractor. With this in mind, Principal Contractor shall ensure ‘adequate traffic control at the entrance and at progress points of the Site ~ both temporary and permanent and ensure no parking on public roads, pavements or adjacent land. The Site access shall be only from the sector road on the west side of the development. The municipal right of way areas may be used for access as necessary to suit the Principal Contractor. ‘Any summons or penalties imposed by the local authorities due to spillage of concrete, mud ete con public roads while carrying out of site, to be paid by the Principal Contractor and any work stopped due to this issue will not be compensated. The roads will also be used free of cost by the Other Specialty Contractors and Separate Contractors engaged by the Owner. ‘COMMON FACILITIES ‘a. Sewage Treatment Plant (STP): A temporary STP shall be provided with all WCs from the Site taken to it to recover as much treated effluent. The Principal Contractor shall maintain and ‘operate the STP for duration of the Contract. ( The parameters for the treated effluent shall be BOD-10mgh:TSS-10mgf; Total Nitrogen <2 mgjl and Total Phosphorous <2mgyl) b. The general cleaning, security and general lighting shall be of general nature and all specific requirements of the Contract shall be fulfiled by the Principal Contractor, and the Principal Contractor shall be solely responsible for the same. Principal Contractor shall not be entitled to demand any specific facility from the Owner as a right. ‘Adequate toilet facilities, separate for male and female workers, will be provided by the Principal Contractor for the duration of the Works. One full WC toilet (portable) will be provided on every floor of the building with water facility and it shall be the responsibility of the Principal Contractor to maintain it and keep it clean at all times. There shall be hand washing facilities within the same location. In Basements these numbers shall be increased to 18 numbers for each basement at multiple locations to be approved by the Engineer-in- Charge. These facilities shall be used by Principal Contractor's labourers and labourers of Other Speciality Contractors and Separate Contractors working at Site. These facilities shall be kept operational at all times during the execution of the Work, Other Specially Works and ‘Separate Works. MOBILISATION ADVANCE ‘fier the issue of the Work Order, the Principal Contractor may be given an interest free Mobilisation ‘Advance against an irevocable Bank Guarantee & Performance Guarantee in the attached format Construe ion, Ma in & Delivery of Ireo's Mixed Use Project- Hotel & Commercial Buildings (Office & Retail) from a Scheduled Commercial Bank. This amount shall be utlized by the Principal Contractor ‘exclusively for the purpose of this Contract only. ‘The Mobilisation Advance Bank Guarantee will be kept valid til one month afer the full recovery of the complete Mobilisation Advance. Mobilisation Advance shall be subject to amaximum limit as mentioned in the Work order excluding the cost of materials to be supplied by the Owner, if any. Release of Mobilisation Advance to the Principal Contractor shall also be subject to following: ) i) iy » Payment representing an amount equivalent of 25% (twenty five percent only) of the Mobilisation Advance — on Contract Sum to be paid by the Owner after issuance of Letter ‘of Award and against submission by the Principal Contractor of a Bank Guarantee of an ‘equivalent amount from a Scheduled Commercial Bank along-with a Performance Bank Guarantee according to the Contract. Payment representing an amount equivalent of another 25% (twenty five percent only) of the Mobilisation Advance to be paid by the Owner against a submission of Bank Guarantee by the Principal Contractor of an equivalent amount from a Scheduled Commercial Bank. The important activilies that need to be done to be eligible for this ‘second installment of advance are: a. Site office and all fabrication yards, pumping systems for dewatering and ‘completion b. Delivery of plant & machineries(batching planUconcrete pump/transit mixers and tower cranes) ‘Set up labour camp as per requirement Approvalsilicenses from local authorty. Fencing/barricading of the Site/proper security arrangement. Adequate arrangement for electrcitylwater. Payment representing an amount equivalent of another 25% (twenty five percent only) of, the Mobilisation Advance to be paid by the Owner against a submission of Bank Guarantee by the Principal Contractor of an equivalent amount from a Scheduled Commercial Bank. The important activities that need to be done to be eligible for this ‘second installment of advance are: a. Alltower cranes stood up which are to be deployed for the Project operational b. 100% batching plant to be operational © 100% delivery of formwork for basement shuttering required for the Project and approved by the Engineer-in-Charge d. Successful tral of the design mix duly approved by the Engineer-in-Charge Payment representing the balance amount equivalent of remaining 25% (twenty five percent only) of the Mobilisation Advance to be paid by the Owner after the start of reinforcement concrete work for raft foundations at Site and against a submission of Bank Guarantee by the Principal Contractor of an equivalent amount from a Scheduled Commercial Bank. The important activities that need to be done to be eligible for this second installment of advance are: ‘a. Deployment of full Site staff including the safety staff as per Contract. b. 100% delivery of specialized and conventional shuttering required for the Project approved by the Engineer-in-Charge and complete scaffolding required for other areas. Submission of detailed quality assurance and Project progress programme. d. Setting of quality lab as per Contractrequirement. Complete safety system (ambulanceffire fighting systemirst aid arrangement). f. Completion of reinforcement work in 2 tower rafts. ‘The Mobilisation Advance wil be recovered from the Principal Contractor's running bils on pro rata basis, The deductions will start from the 2nd Running Account Bill and the Mobilisation Advance will be fully recovered by the time 80% of the Contract Sum is certified, If at any time, the Principal Contractor fails to effectively mobilize and/or execute the Work to the satisfaction of the Owner, for any reason whatsoever, the Owner shall be ented to recall forthwith the enti amount so advanced andlor recaver the whole or balance amount, as the case may be, from the bis, if any, payable tothe Principal Contractor, or by encashing the Bank Guarantee 16. CERTIFICATES and PAYMENTS : 16. Special ¢ Interim invoice/Running Account Bills ‘The Principal Contractor shall prepare and submit interim invoices! Running Account Bills to the Engineer-in-Charge once a month throughout the duration of the Contract, in a {format to be agreed with the Engineer-in-Charge /Project QS and shall be supported by but not necessarily limited to detalled certified joint measurements done beforehand, item wise as per Bill of Quantities, and consumption statements for materials supplied by ‘Owner and for materials for which advance has been paid by Owner to the Principal Contractor. ‘The Interim invoices will also show all deductions including safety penalties to be made from the gross amount and other dues from the Principal Contractor to the Owner, as provided for in this Contract. Invoices along with all the enclosures shall be submitted to the Engineer-in-Charge in ‘one original and two copies thereof. The enclosures wil also include a certificate from the Principal Contractor that all dues like provident fund, wages etc due to be paid to the workers and the Government have been paid and any liability arising there of shall be to the account of Principal Contractor. It will also include a certificate from Owner's safety department that no NCs/ major safely issues are pending at Site. ‘The Engineer-in-Charge shall process the bill as per procedure specified in the General Conditions of Contract and make the necessary recommendations to the Owner making a certificate for payment. The Owner shall make payment to the Principal Contractor by means of account payee cheque drawn on a bank in DelhiNCR, within 21days of the issue of certificate for payment by the Engineer-in-Charge and after deducting previous payments, other deductions / recoveries as provided in this Contract including statutory deductions at source like Income Tax, etc ‘Al interim payments made to the Principal Contractor shall be considered as advance payments made to him towards the final bill, Any interim Certificate of Payment made by the Engineer.in-Charge relating to the work done or the materials delivered may be modified or corrected by any subsequent interim certificate or the final certificate of payment. No certification or the Engineer-in-Charge supporting an interim payment shall itself be conclusive evidence that any work or materials to which it relates is/are in ‘accordance with the Contract, ‘Managem (, Coordination, Supervision & Delivery of Ireo’s Mixed Use Project- Hotel & Commercial B ss (Office & Retail) 16.3 16.4 Final Invoice ‘As soon as possible but not more than three months after the issue of the Certificate of, ‘Substantial Completion, the Principal Contractor shall submit to the Engineer-in-Charge, his “Final Invoice" drawn in an approved manner on the basis of the ‘Measurement! Dimension Sheet’ certified by the Engineer-in-Charge.. The final bill shall be ‘accompanied by all abstracts, vouchers, etc. supporting it. No further claims shall be ‘made by the Principal Contractor or will be allowed by the Owner after submission of his final bill. The final bill shall be accompanied by all substantiating documentation as required for interim bills with the addition of the following items that shall be supplied by the Principal Contractor: Al written guarantees and warranties as required under the Contract. Operation and maintenance manuals and instructions for equipment and apparatus One (1) soft copy in CD in Auto CAD & PDF, and four (4) prints (A1 size) of all requisite As built drawings. ‘The Engineer-in-Charge shall process the bill as per procedure specified in the General Conditions of Contract and make the necessary recommendations to the Owner vid certificate for payment. The Owner after his own further checking and verification, shall make the payment to the Principal Contractor by means of account payee cheque/DD/PO drawn on a bank in Delhi/NCR, less any deductions recoveries as provided in tis contract including Income Tax to be deducted at source, within twenty eight (28) days of the issue of certificate for payment by the Engineer in-Charge. Final bill shall not, however, be paid until the Principal Contractor has cleared the Site to the satisfaction of the Engineer-in-Charge Owner and has issued a NO DEMAND. CERTIFICATE in the format as given under, duly signed and stamped on his letterhead 18 noted below “We hereby declare that we have no claim whatsoever against the work carried out by us against the Contract aS per our final bill dated ‘and as cerlified by the Engineerin-Charge, vide his letter dated. ‘Signature ofthe Principal Contractor: Company Seal Name and address of the Principal Contractor" Warranties! Guarantees All writen guarantees and warrantees and maintenance manuals from vendors, installers, ‘and manufacturers to be submitted in the name of the Owner prior to the issue of Substantial Completion Certificate. Retention Money ‘At the time of making any payment to the Principal Contractor for Work done under the Contract, Retention Money @ 5% of gross value of Work done shall be deducted from Construction, Manag nent, Coordination, Supervisi Hotel & Con -y of Ireo’s Mixed Use Project- 165 166 the interim and final bills from the gross value of Works done/certified, including approved variations. 100% of Retention Money shall be refundable on issue of a Completion Certificate by the Engineer-in-Charge JOwner on completion of Defect Liability Period or rectification of defects, if any, whichever is later. However the Principal Contractor will have an option to get only 50% of the Retention Money released on Substantial Completion of the Project by submitting an equivalent Bank Guarantee on the approved format and which shall be valid til end of the Defect Liability Period and the same will have to be extended if, required on the directions of the Engineer-in-Charge to comply with the time duration for the Retention Money given in this clause. Retention monies deducted as above shall not carry any interest. Income Tax, Works Contract Tax, Service Tax TDS for Income Tax Works Contract Tax and Service tax at the prevailing rate plus surcharge as specified by the Tax authorities on the gross value of Work done, shall be deducted from all payments made to the Principal Contractor and remitted to the Government Treasury/ Reserve Bank of India in accordance with section 194 C of the 1.T. ‘Act and the latest laws of the land. The Principal Contractor shall be provided with the ‘copies of such remittances. The Principal Contractor shall deposit the service tax to the relevant tax authorities and will provide the copies of remittances to the Owner. ESCALATION / FLUCTUATIONS Escalation Clause will not operate on the Contract. No escalation on Contract Sum / Rates shall be applicable during the tenancy of the Contract period including extensions thereof. Only the fluctuation in the base rates of Cement, Reinforcement Steel, Structural Steel, tendons for Post tension work for which base rates are mentioned in the Contract; will be to Owner's account. The process for price difference in the basic rates is defined as under: The basic rates for the Material Items mentioned in the Contract Documents are inclusive of all taxes, transportation to Site, loading, unloading, handlings, royalty etc. Material tems have to be procured by the Principal Contractor against 'C’ Form issued by the Principal Contractor. This shall be used by the Principal Contractor to work out the prices of Material items FOR. Site. In the alternative the Owner and/ or Engineer-in-Charge can identify the source/vendor and finalize basic rates, Rates shall be negotiated with the suppliers in the presence of authorized representative of the Owner and! or Engineer-in-Charge, in case of the Principal Contractor arranging the quotations. The negotiated rates, thus concluded in the presence of the Owner, shall be applicable on the Works for the duration as mutually agreed to between the Principal Contractor, the supplier and the Owner and/ or Engineer-in-Charge. ‘The Principal Contractor shall continue to arrange the quotes for the said Materials at ‘regular fortnightly intervals as above, to keep a watch on the market rates of the ‘Material Items, even though the rates are already finalized for certain duration. The Principal Contractor shall keep the Owner and/ or Engineer-in-Charge apprised on this continuing process. ‘The Owner and/ or Engineer-in-Charge may arrange direct quotes from the ‘suppliersimanufacturers and finalize the rates with them, as well, The Principal Contractor shall give his opinion on the quality of such materials from Owner and/ or Engineer-in.Charge’s chosen parties/vendors, in case it has apprehension, before placement of orders; however, the Owner and/ or Engineer-in-Charge’s decision in this regard shall be final and the Principal Contractor shall abide by such decision. ‘The Materials shall, however, be arranged by the Principal Contractor (on the basis, of the above exercises being done jointly) as per the delivery schedule already submitted by it to the Owner and in turn approved by the Owner and/ or Engineer-in- Charge. If there is any change in already approved delivery schedule: the Principal Contractor shall take prior approval of the Owner andi or Engineer.in-Charge for that change citing reasons for the change. It willbe the responsibilty of the Principal Contractor to inform the supplier / vendor the schedule of supplies (as per requirements of the Project) to be effected. The Principal Contractor shall be responsible for the quaily of materials being dispatched by the identified supplier. The Principal Contractor shall keep the Owner informed about the quantities being ordered! received at Site, with measurements and quality- samples as dispatched. As such the Principal Contractor shall take utmost care to do the following, 41. The floor slabs are cast to level with zero tolerance. 2. There are no concrete uneven surfaces after casting 3. Thorough checking of level using laser instrument during and after pouring of concrete to ensure levels are within limits. 4. All concrete joints are constructed with methods approved by Engineer-in-Charge. 5. No damages to surfaces during construction of upper floors and no fall / impact with scaffolding and other materials, 6. Any undulations that may occur to be leveled by floor grinding after approval by Engineer-in-Charge. It will be the sole discretion of the Owner! Engineer-in-Charge to accept the quality of the floor finishing work and in case of any rejection due to unsatisfactory work / finishes, the Principal Contractor to remedy the floor with methods approved by the Engi Charge at its. own cost. The Principal Contractor will not be entitled to any additional time for such remedial works. Setting Out & Tools for Construction: Setting out the Site and buildings shall be carried out using a professionally calibrated total station instrument, Building elements such as slabs, walls, ceilings etc shall have line, level and verticality established and checked using professionally calibrated rotating lasers, spint levels. Cost of all equipment, calibration and any training shall be borne by the Principal Contractor. Principal Contractor is expected to assess, and where appropriate, take advantage of modem international techniques and construction methodologies such as: + Jump formwork Sip formwork Table formwork Preformed column shuttering Preformed rebar cages CNC bar bending 19. Laser technology for level and vertcality * Spirit levels for general use ‘The use of water levels will not be allowed. SCAFFOLD GUIDELINES detalled at Appondix-8 to those Special Conditions of the Contract EXTERNAL WORKS ‘The Site will be kept tidy and clear ofall waste and debris at all times. ‘A clean and clear access and egress route for the main construction will be maintained at all times. ‘The isolated storage areas will be kept in a tidy manner at all times. There will also be the need {for a rejected quarantine area on the Sit. All completed areas will be cordoned off to avoid any damage. Proper sanitation shall be provided for operatives use on Site. It shall at all times be kept clean, The Principal Contractor shall plan his working in such a manner that enough work-space and storage yards (either in basements or in other structures being built which are in its scope) is created for its use and for the use of the Approved Sub-contractors, Other Specialty Contractors, Separate Contractors and their sub-contractors. These work spaces and storage yards shall be allocated by the Owner for proper storage of materials being brought to the Site for incorporation in the Project. EFFICIENCY IN OPERATIONS. The Owner may, but shall not be obligated to, engage itself with a method statement of how the Principal Contractor, Approved Sub Contractors, Other Specialty Contractors. and Separate Contractors need to function to bring about efficiency in the operations (leading to avoidance of ‘rework’. BIM Modelling BIM Enabled Process from Principal Contractor: ‘Owner has used Autodesk Revit BIM in conjunction with Tekla and Navisworks software to assist in the coordination of the Architectural, Structural and MEP elements of the Project. In order to maintain the level of coordination with all the project elements throughout the shop drawing and the construction phase, Owner expects the Principal Contractor to use Autodesk revit BIM with Tekla and Navisworks software (as applicable) and to adopt the Project BIM database for their own use as the basis for their shop drawings and ‘The provided BIM model shall have the details til Tender Drawings or GFC Stage. The Principal Contractor acknowledges that Owner is not responsible for any inaccuracy in the model vis avis the Drawings and that the Principal Contractor shail consult with the Engineer-in-Charge for such, discrepancies, Construction, Manag (, Coordination, Hotel & Commercial rervision & Delivery of Ireo's Mixed Use Project dings (Office & Retail) The BIM model would be provided in Revit 2013 format. Further enhancement to the BIM model shall be carried out by the Principal Contactor to incorporate the changes as authorised by the ‘Owner/ Architect, The Principal Contractor shall be required to submit the enhanced BIM model (on periodic basis for review and acceptance. All the new elements or the modified elements shall hhave the correct attribute information fed into the model for BOQ extraction, specification and. facility management integration purposes. The final submission would comprise of the As-Built Revit BIM model in 2013 or later versions. ‘The BIM model layers and naming conventions would be followed as per the original provided. BIM model and if any new layers are to be modeled, the same shall be discussed and the corresponding legends and naming nomenclature agreed beforehand in consultation with the ‘Owner! Engineer-in-Charge. ‘The BOQs extracted from the BIM models may be used for billing purpose and could form as a preferred submission from the accuracy point of view 23, Mass Excavation: The Principal Contractor shall acknowledge that the mass excavation will be carried out by other agency appointed by the Owner and at the time of commencement of Work by the Principal Contractor, the Site would have been excavated upto 227 level or 8 meter below the ground level The Principal Contractor will then continue with further excavation and necessary dewatering if encountered, for construction of the raft foundation. ‘The Principal Contractor acknowledges that it shall accept the Site conditions with slopes and access made by the mass excavation agency and shall provide necessary and adequate plastic. Covering to slopes to avoid erosion and shall also protect all the slopes with proper shoring, strutting and shest piles if necessary. ‘The Principal Contractor should remove any boulders upto 1.2 mtr dia during excavation and if ‘any rocks are encountered these shall be measured separately and immediately notify the Engineer-in-Charge for further instructions. 24, Water Table: ‘The Principal Contractor shall importantly take note of the existing ground water levels measured. recently by the Owner's specialist agency and a copy of the peizomenter readings is attached in the Geotechnical Report as a part of the Tender documents. However any variations of ground. ‘conditions or water level encountered on Site, shall not absolve the Principal Contractor from his responsibilities to achieve the required levels for construction of rafts and other footings and no additional claim will be paid in this regard. 25, Adjacent Property! Project: The Principal Contractor acknowledges that the Owner or its affiiate shall commence another project very close to this Project and as such the Principal Contractor shall extend his fullest Cooperation and agree to share all common areas and access, and shall maintain good relationships with the neighbouring contractors as per the instructions and advice of the Engineer- in-Charge! STANDARD SITE RULES 1. Safety boots will be worn at all times. Anyone not wearing safety boots will be refused admission to the Site. 2. All operatives will wear hard hats at all times unless stated in the specific method statements for agreed works. Owner specified colour coding for hard hats for various tradesmen and code numbers of workers to be displayed on the hard hat. 3. Any operative found not using the designated toilet facilities will be removed from Site on a permanent basis, ‘Smoking will nt be allowed within the Project boundary. Operatives caught smoking, using any kind of prohibited drugs, indulging in fighting and ‘unethical behaviour will be removed from Site permanently Chewing of pan masala and other tobacco or non tobacco products will not be permitted at any cost. Safety gloves and eye protection will be worn for hazardous operations. Al operatives will be inducted to Site prior to commencing Works. All operatives will abide by the Site rules at all times, 10. Scaffolds will not be used until inspected and passed by a competent person and safety tag put on the scaffold 11. Any operative smeliing of alcohol will be removed from Site for that days works. 12. Food will only be consumed in the designated areas. 18 All excavations will be done in a safe working manner as per instructions issued by the Engineer-in.Charge and Owner's safety department. 14 All workers to have an identity card and attendance shall be through biometric machine. All supervisors and also Site management will be expected to abide by these rules. This applies to all visitors to Site at all times. Security will have the power to refuse entry to Site for non compliance of the Site rules in any form. The Site will be inspected daily by the Engineer-in- Charge’s representative and any issues will be informed to the Principal Contractor and action taken, Principal Contractor's Labour Accommodation Requirements. (Owner is keen to ensure that workers have the best possible living conditions. This requires that Principal Contractor and Approved Sub Contractors will comply with guidelines in respect of health, psychological, and social conditions for workers. Land for labour accommodation shall not be provided by the Owner. Labour accommodations shall be provided outside the Site areas by the Principal Contractor. However the construction of these shall be as per the standards of the ‘Owner and subject to inspection for compliance by Owner. Principal Contractor will be encouraged to get their labours registered with construction workers welfare boards, ‘The Principal Contractor shall provide adequate and proper accommodation for the Site labour as. ‘outlined in Appendix. C DEWATERING AND FLOODING CONTROL: ‘The Principal Contractor is deemed to have allowed for any and all temporary dewatering, during the execution of the Work. Such Work shall include but not necessarily be limited to the safe Construction, Ma .gement, Coordination, Supervision & Delivery of Ireo’s Mixed Use Project Hotel & Commercial Buildings (Office & Retail) disposal of the resulting water, removal, replacement andlor re compaction of the water logged soils/surfaces; backfiling plugging of all temporary sumps, ditches, temporary materials and devices. ‘The Principal Contractor shall be deemed to have allowed for al costs associated with removal of flood waters and any associated sludge debris etc. from the basement level or any other part of the building so effected in the event of flooding due to heavy rains during its construction activities. until basement, superstructure work is completed until such time as Principal Contractor has ‘completed and handed over all the Works under the Contract. ‘Any damages to the public roads due to settlement because of dewatering to be repaired by the Principal Contractor at his own cost. All the tools for monitoring ground water table, settlement ‘monitoring as required by Engineer-in-Charge and including their costs will be the responsiblity of the Principal Contractor. 29, HANDING OVER WORK TO OWNER ‘The handing over of the property to the Owner will be Principal Contractors responsibility and nothing shall be paid extra if some of the activities (coat of paint, polish, replacement of floortwall, tiles, hardware etc) has to be re-worked based on observations of Owner and technically approved by Owner representative, Responsibility of the Principal Contractor also extends to ‘general housekeeping of Work and other works and respective floor/lobby/ staircase at the time of handing over. 30, Office for Owner and Consultants Principal Contractor shall build the Site office for the Owner and the Consultant as per the Drawing provided with Tender Documents. The building shall be provided with the following The building shall have partitions and reasonable finishes. sanitary and electrical, uninterrupted ower supply, fitures and fitings, The offices shall be the property of the Owner. The loose fumiture, computers, printers etc shall be provided by the Owner and wil not be in the scope of the Principal Contractor. Air-conditioning of the offices, water and electricity shall be provided til the end of the Defect Liability Period by the Principal Contractor. Drinking water till the end of the Defect Liability Period will be arranged by the Principal Contractor free of cost, Necessary sanitation arrangements should be done to maintain neat and ‘lean environment of the offices. Two cleaners and two office boys shall be provided by the Principal Contractor til the end of the Defect Liability Period Principal Contractor's Office. OBJECTIVE The Principal Contractor shall produce and submit a project quality plan (PQP) for approval to the Engineer-in-Charge, defining quality assurance and quality control requirements to ensure that all quality related activities are planned adequately and implemented to cover all activities within the Contract, B, PROJECT QUALITY MANAGEMENT SYSTEM ‘The project quality system shall be well defined in the Principal Contractor's contract procedure, ‘manuals adhering to the requirements of ISO 9001:2008 Quality Management Systems. The QA/QC Manager shall ensure that no inspection form is submitted to the Engineer-in-Charge {for approval, until all relevant activities as specified in the inspection & test plan have been completed and checked by Principal Contractor's representative. Non-conformances shall be Tecorded along with the corrective action required and submitted to Engineer-in-Charge, get approval and once corrective action is accomplished, request for witnessing to Engineer-in- Charge. Engineer-in-Charge is not obligated to inspect any works which are claimed to be ready by the Principal Contractor, twice within 24 hours. As such the Principal Contractor is is to ensure that all the works are completed in all respects before request for inspection is made. C-7 Quality Report: The report shall contain a record of inspections and test forall work accomplished subsequent to the previous report and shall include the following information. ‘+ Phase(s) of construction underway during the time frame of the report (ie. earthwork concrete work, structural steel erection, etc.) ‘+ Phase inspection (preparatory, initial and or follow-up), phase of construction and location of inspections and /or tests that were made. ‘+ Results of inspection, including nature of deficiencies observed and corrective actions taken of to be taken. ‘= Report of test performed including those specified, with the results of the tests, including ‘all computations shall be attached to the report form. ‘+ Result of inspection materials and equipment upon arrival at the Site and prior to incorporation into the Work for compliance with submittal approvals, damage and proper storage ‘+ _ Instruction received from the Engineer-in-Charge’s Representative. ‘+ Report should be reviewed by QA/QC manager and Engineer-in-Charge. Approved Sub Contractors, Other Specialty Contractors and Separate Contractors quality management systems shall be audited by the Principal Contractors QA/QC Manager on a regular basis, C-41 Project Closeout A Project closeout schedule shall be prepared by the Principal Contractor scheduling the key closeout activities of the Project. INVENTORY CONTROL The Principal Contractor shall maintain the inventory control at Site right from material receipt and, Inspection through to demobilization aspects at the end of the Project. The Principal Contractor shall submit the Inventory Control management system to the Engineer— in- Charge for approval Material shall be stored, stacked, labeled and traceability maintained at all stages. In general, adequate storage facilities, segregation of material, maintenance of accessibility, protection from environmental damage, expiry date considerations of relevant material, etc will be carefully ‘monitored by the Principal Contractor. Effective controls shall be operated over plant, machinery, and vehicles check for the availabilty of valid test certificates, insurances and operator details. Equipment Control Cards indicating the Usage of the equipment at Site shall be maintained as records for inspection of the Engineer-in- Charge. QUALITY ASSURANCE / QUALITY CONTROL: E-4 Owner Complaints. The Project QA/ QC team shall ensure that complaints received from the Engineer-in-Charge during Project execution as well as during the Defects Liability Period of the Work are effectively Management, Coordination, Supervision & Delivery of Ireo’s Mixed Use Project- Hotel & Commercial Buildings (Office & Retail) dealt with and that suitable corrective and preventive actions are drawn and implemented to prevent recurrence, The Principal Contractor shall log complaints received, follow up for rectification and record corrective actions taken. A log of complaints shall be maintained to reflect the status of complaints received, 2 Internal Quality Audits Internal quality audits shall be formally scheduled at least twice in a month by the Principal Contractor, and the Project activities shall be audited by the Principal Contractor with staff that are independent of the activities being audited. This audit team shall consist of Principal Contractor's senior management other than the site staff, Engineer-in-Charge and his team, ‘Owner or Owner's representative ‘log of any Corrective Action Requests (CAR) shall be maintained by the Principal Contractor to indicate the status of CARS raised. Internal audit reports and proposals of corrective action and completion time shall be forwarded to the Engineer-in-Charge. E:3 Calibration of Test Equipments: The Principal Contractor shall ensure that inspection, measuring and test equipment are professionally calibrated and controlled in order to ensure conformance of the product to specified requirements. ‘The Principal Contractor shall be directly responsible for ensuring that equipment used by the subcontractor(s) is calibrated and controlled in accordance with stated requirements, Equipment shall be calibrated periodically in accordance with manufacturer specifications and Prior to expiry of the validity of the calibration certificate. However, additionally the Principal Contractor shall ensure checkingirecalibration at any time when there occurs any doubt as to the integrity of the equipment. The Principal Contractor at his own cost shall additionally carry out any calibration checks required by the Engineer-in-Charge ‘The certificates of calibration received shall be scrutinized for the following ‘+ Traceability to national/intemational standards, Where no such standards exist, the basis used for calibration shall be documented, © Tolerances ‘© The status of the equipment before as well as after calibration Certificates of calibration shall be reviewed by Principal Contractor and issued to the Engineer-in- Charge for record purposes. Copies of the calibration certificates shall be maintained on Site as ‘well as copies placed in the instrument case for ready reference Stickers bearing instrument reference/serial numbers, date the instrument was last calibrated and the next calibration due date shall be placed on the instrument. A list of compulsory minimum nos. of test equipments to be provided by the Principal Contractor at Site is given as Appendix E to this Special Conditions of the Contract Independent Testing Laboratories: Independent testing laboratory approved by Engineer-in-Charge will be established for the performance of on and off Site testing. They will follow the requirements of ASTM E 329, Project Specification and relevant IS codes. Project QA/QC Manager will coordinate with laboratory and ensure following duties are followed by independent test laboratory. Duties of independent test laboratory: Provide adequate and acceptable plant and calibrated equipment to perform the required testing service, + Develop qualfied procedures forall required test. ‘= Perform specified sampling and testing of materials and method of construction. © Promplly notify Engineer-in-Charge of observed irregularities of deficiencies of work or products. © Maintain accurate and complete records of all test performed and promptly forward criginal and copies to Engineer-in-Charge. + Provide access to facilities and records to the engineer at all reasonable times for the purpose of verifying qualifications of personnel, suitability of equipment, adequacy of ‘methods, analysis of results and reporting method. E4 Control of Non- Conforming Products ‘The Principal Contractor shall identify nonconforming materialiworks at the following stages: Receipt of material/ manufactured items from the supplier-Sub-contractor-Owner During subsequent inspection of the material after receipt + During work in progress During final inspection, testing and commissioning During off-Site inspection and testing activities, Once it is verified that the non conformance actually exists, wherever possible / practicable, the item shall be quarantined’ clearly identified by means of a tag, sign or other appropriate means as soon as possible and maintain a log of non conformance reports. Corrective action shall be proposed to the Engineer-in-Charge within 7 days of receipt of non conformance report and action it to be closed, LABOUR QUALIFICATIONS AND EXPERIENCE ‘The Principal Contractor shall ensure’ that all staff and labour are adequately qualified and experienced for the job they are to perform. All scaffolds greater than 38 metres in height must be designed by a registered structural engineer and got approved by the Engineer-in-Charge. Any scaffold that requires structural attachment must be vetted by structural engineer and any extra cost on account of the same will be bore by the Principal Contractor. No Scaffold shall be tampered with at any time unless operative is trained to do so. rms Each platform must be fully planked or decked. Platforms should be a minimum of ‘300mm wide. Each platform unit (¢.g., scaffold plank, fabricated plank, fabricated deck, fabricated platform) shal be installed so that the space between adjacent units and the space between the platform and the uprights is no more than 25 mm wide, except where the employer can demonstrate that a wider space is necessary (for example, to fit around "uprights when side brackets are used to extend the width ofthe Platform) Platform Loading: Distribute the weight evenly. Place the heaviest load over vertical members. Scaffold platforms cannot deflect greater than 1/60 of the span distance when loaded, Platform Overhang: Ifa platform is less than 3 metres long, the maximum overhang is restricted to 300mm on platforms longer than 3metres; the maximum overhang is 450mm Planks: ‘Scaffold planks must be made from scaffold-grade lumber or be laminated planks. Planks. that are cut, spit, chemically damaged, or painted are not to be used. Plank overlap must be by 300mm uniess restrained. Ends should always be cleated or restrained. Ifthe end overhang is less than 150mm, the ends must be cleated or restrained. Planks must be a ‘minimum of 50mm by 300mm (nominal). A minimum of two planks no further than 25mm apart must be used, Fabricated Wooden or Metal Decks: Load bearing limits and dimensions are determined by the scaffold deck manufacturer. The deck must be marked with its carrying capacity. Decks are not to be dropped from scaffolds. Never use bent or damaged decks. Standard lengths are 1.8 metres and 3 metres. No overlap is required. Base Support: ‘A firm, level foundation is required for all supported scaffolds. Scaffold base plates or casters are to be used on all scaffold legs. Plates and casters must be pinned or secured to the frame at all times. The size of mud sils used is based on ground support conditions and maximum anticipated loads on the scaffold legs. Scaffold planks are sometimes used as mud sills. Working planks for mud sills. are not to be used since this practice could damage planks ‘Scrow Jacks: Screw jacks are designed for leveling the scaffold. The recommended maximum extension for fixed Scaffolds is 450mm while 300mm is the maximum for mobile scaffolds. ‘Side Brackets: Metal frame scaffolds may be used. Manufacturers shall determine the requirements. Side brackets are designed only to support personnel unless engineered otherwise ‘Truss Bearers: ‘These may be used when it shall be necessary to span greater than standard distances such as doorways. The manufacturer will set limits to the length and capacity. Truss bearers may require additional bracing on the scaffold system. Manufacturer's requirements to be followed when truss bearers are used Ties provide protection against toppling. Ties are secured at the junction of the vertical ‘and horizontal scaffold members. They must be of rigid construction. A positive anchor is required. Guys, ties, and braces must be installed according to the scaffold manufacturer's recommendations ‘Additional ties may be required under special circumstances, such as loads not centered, winds, hoisting, or on covered scaffolds. Guys are required if the scaffolding is free standing and are greater than four times the minimum base width in height. Guys must bbe 2 minimum of 10mm wire rope and should be tied at a 45° angle to the scaffold. ‘Supported Metal Scaffolds Welded Frame Scaffolds These consist of end frames and braces. All components must be inspected for damageldefects prior to being used. Erection of scaffolding shall start at the highest point of the run and work downhill. Cross braces will automatically square the scaffold frames and ensure that the scaffold is level, square, and plumb. Pin connections on all frames to be used to prevent separations of frames. Ladders shall be provided to gain access 10 the scaffolds. Ladders shall not be used on scaffolding unless it is secured top and bottom. The scaffold should be secured from any movement and the platform is stabilized to prevent deflection. Mobile Scaffok Mobile scaffolds have restricted reach unless 2 guy wire secures them. They are more susceptible to overtuming and require a smooth, level working surface. Additionally, they . A complete quardral system must be used at elevations above 1.8 metres and shall be used at all working levels. Scaffold should be moved when unoccupied and only by pushing from the base. Wheel brakes must be set when scaffold is in use. Base dimensions may be extended with outrigger. ‘Swin it Platforms shall not be less than 600mm. The platform shall be securely fashioned to the hangers. Hangers shall be capable of sustaining four times the maximum rated load and shall be designed with suppor for guard railing. Roof irons or hooks shall be of mild ste! ‘or equivalent material. Tiebacks of 18mm manila rope or equivalent shall serve as a ‘secondary means of anchorage, installed at right angles to the face of the building and. ‘secured to a structurally sound portion of the building. All scaffold components must be Inspected before each use and periodically while in use. On suspension scaffolds designed for working load of 750 kgs, no more than two employees shall be permitted to ‘work at one time. On suspended Scaffolds with a working load of 1000 kgs, no more than three employees of the Principal Contractor shall be permitted to work at one time. Each employee of the Principal Contractor shall be protected by an approved safety line attached to a safety hamess. The safety line shall be securely attached to substantial members of the structure independent of the scaffold. A minimum of stack in the lifeline must be maintained. Guardrail System/Fall Protection Fall protection is required on all scaffolds where the working height is above 1800mm. A, guardrail is required above 1800mm on all scaffolds. Guardrails must be able to withstand 200 kgs of force. Top rails shall be about 1200mm in height. Mid rails and toe boards are required. Toe boards must be a least 100mm in height. Cross braces may be Used as mid rails if the cross height is 500mm to 750mm above the platform. Interior guardrails are not required when the working face is less than 400mm from the platform, Guardrails must be installed on all open ends and sides of platforms more than1 800mm im height. Upright supports must be no more than 2.4 metres apart. Scaffold Access ‘All metal frame scaffolds must have a means of access. This access can be gained from attached or portable ladders, stairways, or the adjacent structures. Ladders must extend, ‘90mm above the working platform. There will be a full set of Site rules for the Works that will be agreed upon prior to the Works proceeding. This lst will bbe made by the Engineer-in-Charge and the Principal Contractor will be expected to abide by thom at all times once agreed, A The Site rules will be incorporated into the Site induction that will be given to all operatives prior {to any Site operations being carried out by the operatives, AA full health and safety induction will have to be taken by any operative or visitor that wishes to ‘access the working Site area. The inductions will be given at an allocated time twice a day by Qualified HSE staff. ‘Any person not adhering to the Site health and safely rules and not wearing personal protective equipment will be ejected from Site immediately The Principal Contractor will supply qualified first aiders at a ratio to be decided by Owner! Engineer-in-Charge. These willbe distinguishable by a white cross with a green background on their helmets.
