SUBJECT : Letter dated August 3, 2011 of the Chairman, Civil Service
Commission, relative to the practice of some government
agencies of withholding payment of salaries to government
personnel pending approval/attestation of their appointment by
the CSC

Enclosed is a letter dated August 03, 2011 from CHAIRMAN FRANCISCO T.
DUQUE III, Civil Service Commission (CSC) expressing his concern over the practice of
some goverment agencies of withholding the salaries of newly appointed government
employees pending approvaVattestation of their appointments by the CSC. This
management practice, in tum, appears to have stemmed from the supposed action of
auditors questioning in audit the payment of such salaries of new appointees. As stated
by Chairman Duque, such practice is not in accordance with Section I, Rule 1V of the
Revised Omnibus Rules on Appointments and other Personnel Actions.
Accordingly, the Audit Groups/Teams are hereby directed to pass in audit claims
for salaries of appointed government employees who have assumed their positions,
without waiting for the CSC's attestation of said appointment. It should be understood
that all the cther requirements are in order.
Please be guided accordingly.

Greetings ‘rom the Civil Service Commission!
This refers to pending appointments of civil servants, currently being processed by the
Civil Service Comrnission. As provided for under Civil Service Rules, particularly Section 4, Rule
VI of the Revised Omnibus Rules on Appointments and other Personnel Actions, CSC
‘Memorandum Circular No, 40, s. 1998, as amended, an appointment shall be submitted to the
CSC for attestatio/approval. It Is provided further under Section 1, Rule IV of the same rules
that, “An appointment issued in accordance with pertinent laws and rules shall take effect
immediately upon its issuance by the appointing authority ond if the appointee has assumed the
duties of the position, he shall be entitled to receive his salary at once without awalting the
opproval of his appointment by the Commission. xx x"
In connect'on hereto, the undersigned received several reports of agencies withholding
the salaries and benefits of new or promoted appointees pending the CSC's attestation or
approval of thelr appointments. It was represented that purportedly COA auditors would
question the payment of salaries in the absence of a CSC-approved appointment. This alleged
action of agencies is therefore not in consonance with the aforequoted rules.
Thus, may we seek your office’s assistance on the matter, particularly to give advice to
your regional officers and resident auditors that payment of salaries and benefits tothese
appointees is allowed once they assumed duty, notwithstanding that the approval/attestation
of thelr appointments are still pending with the CSC.
