The Affordable Care Act creates a whole host of new employee reporting and disclosure requirements. It also provides employers with a good opportunity to demonstrate to employees
the value of the benefits they are receiving. Active coordination and participation between
both parties will create a more efficient ease of transition in this significant reform adaptation period. In this session, you will learn:

Understanding PPACA starts with a basic understanding of what ERISA requires. After all,
existing rules under ERISA formed the building blocks for health care reform. Moreover, an
inadvertent ERISA or PPACA violation could expose the plan or its fiduciaries to massive liability. This session will cover background information intended to help form a basic understanding of ERISA principles, including:
What is a welfare benefit plan
What is a group health plan
Exceptions in for HIPAA excepted benefits and retiree only plans, and other common
exemptions
What are the plan document and participant communication requirements for welfare
plans
What claims and appeals requirements apply to ERISA group health plan

As employers struggle with technical compliance, there are a number of litigation hazards
that must be considered in implementing PPACA. From employee communications to the
provision of mandated benefits, employers and ERISA plan fiduciaries have litigation exposure under PPACA. Moreover, as employers realign their workforces to avoid a penalty under
PPACAs employer mandate, they may be opening themselves up to a significant litigation
downside that includes awards of special damages, emotional distress, back pay, reinstatement and other remedies. In this seminar you will learn:
The causes of action available to employees seeking mandated benefits and strategies to
avoid those actions
Claims to mandated benefits
How to develop an employee communication campaign that addresses key PPACA concerns while avoiding unnecessary litigation exposure
The litigation risks inherent with workforce realignment and how to minimize those

Bill Cassidy, US Senator from Louisiana

Dr. Kristin L. Kahle, CHRS


Dr. Bill Cassidy is a Senator from Louisiana. He is a physician, a teacher, a community leader, a father
and a husband. Bill grew up in Baton Rouge, Louisiana and attended Louisiana State University (LSU) for
undergraduate and Medical School.

For nearly three decades, Bill has provided care for uninsured and underinsured patients in Louisianas charity hospital system. In 1990, Bill joined LSU Medical School following his tenure at Earl K Long
hospital, where he taught medical students and residents while treating the uninsured.

James Jim Donelon, Commissioner of Insurance from Louisiana


Prior to becoming Commissioner of Insurance, Jim Donelon served the Louisiana Department of
Insurance in leadership positions as Chief Deputy Commissioner and Executive Counsel. He was a Jefferson Parish Council Chairman & a State Representative.

Jim was born in New Orleans. He is a graduate of Jesuit High School, the University of New Orleans
& Loyola School of Law. Commissioner Donelon retired as the State Judge Advocate after 33 years of
service in the Louisiana Army National Guard.
Jim is immediate past President of the National Association of Insurance Commissioners (NAIC). He
serves on the Executive Committee of the NAIC and is chairman of its Surplus Lines Task Force.

Angela Surra, CISR, CLTC, CIC, CHRS


Angela Surra is the General Manager of St. Marys Insurance Agency, Inc in St. Marys Pennsylvania
with a total of six locations and 40 employees. Obtained the following professional insurance industry
designations: Certified Insurance Service Representative (CISR), Certified in Long Term Care (CLTC), Certified Insurance Counselor (CIC) and Certified Healthcare Reform Specialist (CHRS) and am licensed for
Property, Casualty, Life, Accident, Health Insurance, Series 6 and 63 Securities Licensing in Pennsylvania,
Property & Casualty NonResident License for New York. I have been in the insurance business and with
St. Marys Insurance since 1997.

James Jim Napoli


Jim Napoli is Partner at Seyfarth Shaw LLP in Washington, DC. Jim has nearly 20 years of experience
counseling employers of all sizes on substantive employee benefit matters. Recognized by US Legal 500
as a leading lawyer in his field, Jim is adept at quickly identifying, analyzing and resolving employee benefit issues with an eye toward, both, substantive legal compliance and litigation avoidance.

In addition to his litigation practice, Jim partners with clients to assist them in the design, implementation and maintenance of their employee benefits programs. He also is experienced in representing clients before the IRS. Jim is a prolific writer and speaker on all things employee benefits. He speaks before
local, regional and national groups regarding various employee benefit matters. He has been quoted or
had articles published in a number of national publications. Jim is a member of the Health and Welfare Task Force of the American Benefits Council; the Employee Benefits Committee of the Labor Section of the American Bar Association; the Steering Committee for the Healthcare Reform Center and Policy Institute; and the Steering Committee for the Public Health Law and Policy
Health Law and Policy Center at University of Akron School of Law.

Jeff Miles, CHRS


Jeff Miles is a 36-year veteran of the healthcare & insurance industries, acting as consultant, broker,
and plan administrator for employer plans as President and Founder of The Miles Organization.

In 2007, famed Washington-insider and columnist Robert Novak pronounced that Jeff Miles is an
oracle of health care!

Dr. Kristin L. Kahle is the founder and CEO of NavigateHCR., a company that is focused on Healthcare
Reform (HCR) compliance solutions for brokers and employers. Kristin spent 20+ years as a benefits
broker and has always been dedicated to educating her groups and helping them develop best practices.
Kristin is a nationally recognized speaker for insurance advisors as well as employer groups. She spoke
in 2014 at the Benefits Selling Expo in Colorado Springs, as well as at the Most Influential Women in Benefits Advising, where she also earned an award in October 2014. Additionally, she will be speaking at the
Benefits Technology Summit for benefitsConnect, in 2015.

Wayne Sakamoto

Wayne Sakamoto is the President of Health Insurance Interactive, Inc., a holding company of over
200 insurance related portals providing personalized and online health insurance services to businesses
and individuals, in Florida, the US, and worldwide. As an independent agent and Internet entrepreneur,
Wayne has launched successful health insurance websites, such as www.InternationalHealthPlans.com
and www.HealthInsuranceMarketplace.com.

Wayne was named Insurance Person of the Year by the Florida Association of Health Underwriters
and received the 2014 David Saltzman Award for Journalism. He also served on Collier Countys Health &
Human Services Committee identifying health care resources for the indigent population and addressing
concerns regarding the delivery of healthcare services in Southwest Florida. Currently, he is the Communications Chair for the
Florida Association of Health Underwriters and a proud HAFA member. He is a past Media Relations Chair for the National Association of Health Underwriters and a Past President of the Florida Association of Health Underwriters. Wayne resides in Naples,
Florida with his wife Patricia Richmond, who is the Interim Director of Medical Staff Services for St. Cloud Medical Center.

Michael Keegan, CHRS


Michael Keegan brings more than 15 years of health care and lobbying experience to Health Agents
for America. Before joining HAFA, Michael was the Director of State Affairs for the National Association of
Health Underwriters (NAHU) based in Washington, DC. Prior to joining NAHU, Michael served as Director of State Government and Public Affairs at DCI Group, a Washington-based consulting firm, where he
managed lobbying and public relations campaigns for Fortune 500 clients in the firms communications
practice. Previously, Michael worked at the American Legislative Exchange Council, the nations largest
individual membership association of state legislators, managing policy and strategy on insurance issues
and financial services modernization. Michael also managed state lobbying efforts at the former Health
Insurance Association of America. Michael is a graduate of LeMoyne College and Cornell University.

A. This session will test the comprehension of attendees to see how well they retained the information presented to them. This cumulative summary will be guided by the instructor and will play similar to a game
of Jeopardy! The instructor will host the game to ensure that attendees remain focused and can answer any
questions that may appear.

B. The attendees will be broken into teams. The host will keep track of answers through a spreadsheet. The
host will call on the first person to raise their hand. The group will have 5 seconds to settle on an answer.
Should the answer be incorrect the other teams may raise their hand to steal. The team with the most points
gets bragging rights. This fun interaction will add to the experience of the day allowing for the participants
to truly comprehend the complex materials.
