SECTION2.FINDINGS

Congressherebyfindsanddeclaresthat,
A)

Resultsofastudyindicatedthatalargeamountofinschooltimeandattentionisdevotedtoteachingstudents
thetestedobjectivesratherthanfocusingontheirowncurriculum.
B)
Onestudyfoundthatteacherslosebetween60to110hoursofinstructionaltimeinayearbecauseof
testingandtheinstitutionaltasksthatsurroundit.
C)Curricularequiredtobetaughtinorderforstudentstodowellonstandardizedtestsrequireteacherstouse
preparedmaterialswhichtheydidnotdevelopandwhichmaynotaddresstheneedsofactualstudentsintheir
classes.
D)

ResearchshowsthatGEDrecipientsperformaboutaswellashighschoolgraduatesonstandardizedtestsbut
havemuchworselifeoutcomesbecausetheyoftenlackimportantqualitiessuchascuriosity.

SECTION3.STATUTORYLANGUAGE
A)
ThetermStandardizedtestingisdefinedasanyformoftestingthatrequiresalltesttakerstoanswerthesame
questionsinthesameway,whicharethenscoredinaconsistentmannermakingitpossibletocomparetheindividual
performanceofstudentsinspecificsubjectmatters.TolessentheamountofthesetestsintheUnitedStates,the
StrategicUtilizationofInschoolMinutesActof2016shallalloteachstateagivenamountofmoneyfortheirdistrict
budgetsbasedonthepercentageofschoolsreducinghourssurroundingStandardizedtesting.Once75percentof
schoolsinagivenstatereducetheirstandardizedtestinghoursby50percent,thestateshallreceive15dollarsper
studentforimplementingtheAct.
B)
ThislawshallbeenforcedbytheU.S.DepartmentofEducation.Allfundingforincentivisingeachstatewill
comedirectlyfromtheU.S.DepartmentofEducationBudget,whichcurrentlystandsat$67.1billionforthe
20151016schoolyear.
C)
EachStateshallbeallotted25dollarsperstudentforimplementingthislawifatleast75percentoftheirpublic
schoolsreducetheamountoftimestandardizedtestingbyatleast50percent.ThislawshallgoineffectAugust1,
2016.
