If the seized property is not claimed within six months, then the court orders that the seized property be turned over to the Commissioner of Emergency Services and Public Protection for appropriate use or destruction, If other grounds exist to continue holding all or some of the seized property, the seized property held shall not be transferred, turned over, or otherwise disposed as part ofthis order. This order also does not overrule, replace, or supersede any determination by the Commissioner of Emergency Services and Public Protection as to whether the respondent is eligible to possess the seized property.
