DESCRIPTION
Amends the definition of fair market rental value. Increases
the transient accommodations tax imposed on resort time
share vacation units by 1 per cent each year to gradually
achieve a rate of 9.25 per cent of the fair market rental value.
Amends Chapter 328J, Hawaii Revised Statutes, to prohibit the
use of electronic smoking devices in places where smoking is
prohibited.
Creates a limited purpose driver's license, limited purpose
provisional driver's license, and limited purpose instruction
permit. Provides that limited purpose driver's licenses, limited
purpose provisional driver's licenses, and limited purpose
instruction permits shall not be acceptable for federal
identification and voting purposes. Requires satisfactory proof
of identity and Hawaii residency. Effective 1/1/2016.
Requires a public accommodation that owns, leases, leases to,
or operates a motion picture theater in more than two
locations in the State to provide open movie captioning during
at least two showings per week of each motion picture that is
produced and offered with open movie captioning. Requires a
public accommodation that owns, leases, leases to, or
operates a motion picture theater in the State to provide,
upon request, audio description of any motion picture that is
produced and offered with audio description. Effective
January 1, 2016 and sunsets January 1, 2018.
Strengthens reporting requirements for organizational
reports, noncandidate reports, and late contributions reports
submitted by noncandidate committees making or receiving
large contributions.
Authorizes the B&F to issue $35,000,000 in reimbursable
general obligation bonds and to deposit the proceeds into the
Turtle Bay conservation easement special fund. Appropriates
$35,000,000 out of the Turtle Bay conservation easement
special fund for the DLNR to acquire a conservation easement
and other real property interests at Turtle Bay, Oahu.
Allocates TAT revenues of $1,500,000 annually to the Turtle
Bay conservation easement special fund. Provides that a
nonprofit land conservation organization shall file an
application annually with the BLNR requesting $1,500,000
from the land conservation fund to be used for the
reimbursement of debt service on the Turtle Bay reimbursable
general obligation bonds. Appropriates $3,000,000 out of the
Turtle Bay conservation easement special fund to reimburse
the state general fund for payment of debt service on the
reimbursable general obligation bonds. Appropriates
$500,000 from the TAT revenues to the DLNR to pay for
appraisal costs, due diligence costs, and closing costs relating
to the acquisition of a conservation easement and other real
property interests in Turtle Bay, Oahu.

Authorizes fines to be deposited into the tax administration


special fund. Increases the balance that may be retained in the
tax administration special fund in each fiscal year. Authorizes
DOTAX to enforce civil penalties for operators and plan
managers who fail to display the certificate of registration and
registration ID numbers for transient accommodations and
resort time share vacation plans. Authorizes DOTAX to issue
citations for failure to provide the registration identification
number or link to the number and the contact information of
the local contact in an advertisement for a transient
accommodation or resort time share vacation plan. Takes
effect 1/1/16.
Allows an ignition interlock permit holder to take necessary
tests to apply for relicensing during the final 30 days of the
revocation period. Prohibits operating a vehicle with an
ignition interlock permit without a state identification card.
Prohibits operating a vehicle once a notice of administrative
revocation that serves as a temporary permit has expired
unless the driver has a valid driver's license. Effective January
1, 2016.
Reduces from less than $500 to less than $100, the aggregate
contribution amount a candidate may receive from ten or
more anonymous persons at the same political function. Takes
effect on 1/1/2016.
Increases the minimum age for sale, possession, consumption,
or purchase of tobacco products or electronic smoking devices
from eighteen to twenty-one. Defines "tobacco products" to
include electronic smoking devices.
Prohibits the approval of an electronic device manufacturer's
recycling plan that provides only a mail-back option for the
collection, transportation, and recycling of a manufacturer's
covered electronic device. Authorizes the approval of an
electronic device manufacturer's recycling plan if a
manufacturer of exclusively mobile covered electronic devices
whose products are voluntarily accepted at no charge by at
least fifty retail locations in the State submits a recycling plan
that documents these locations. Takes effect on 01/01/2016.
Allows voter registration at absentee polling places beginning
in 2016 and late voter registration, including on election day,
beginning in 2018. Appropriates funds.
Adopts revisions to the National Association of Insurance
Commissioners' model laws on Credit for Reinsurance Model
Act (Part I), Standard Valuation Law (Part II), Standard
Nonforfeiture for Life Insurance (Part III), and Insurance
Holding Company System Regulatory Act (Part IV). Part I takes
effect 01/01/2015. Part IV takes effect 01/01/2016.
Eliminates the deduction for state taxes paid for taxpayers
with income above specified thresholds. Places temporary
limitations on claims for itemized tax deductions. Delays the
standard deduction and personal exemption increases
approved under Act 60, SLH 2009, while also making those
increases permanent.

Temporarily replaces the motion picture and film production


tax credit with the motion picture, digital media, and film
production tax credit which provides an income tax credit
amounting to 15% of qualified production costs incurred, in
any county of Hawaii with a population over 700,000, and 20%
in any county of Hawaii with a population under 700,000.
Establishes criteria to qualify for the tax credit. Caps credit at
$8,000,000 per production. Repeals 1/1/2016
Subject to exceptions, requires all plans, designs, and
specifications for new or renovated landscaping of Statedeveloped buildings, complexes, facilities, or housing to
incorporate specified percentages of Hawaiian plants. Sec 2 of
bill takes effect on 6/30/16
Authorizes a limited meeting where any number of county
council members may attend a board's or community group's
meeting to discuss council business, provided that certain
requirements are met. Repeals 6/30/2016
Provides systematic reentry programming for nonviolent, lowrisk drug offenders by establishing and funding a reentry pilot
project for nonviolent, low-risk drug offenders. Repeals

Provides that compromises for workers' compensation claims
reached as a result of a third-party liability claim or action do
not require the approval of the Director of Labor and
Industrial Relations. Effective July 1, 2014. Repeals 6/30/2016.
Temporarily requires additional reporting by the University of
Hawaii on special and revolving funds that carry an
unencumbered cash balance of $1,000,000 or more or a cash
deficit of $1,000,000 or more, at the end of the previous fiscal
year, where that balance or deficit is greater than twenty-five
per cent of the previous fiscal year's expenditures. Repeals on
6/30/2016.
Expands the authority of the aloha tower development
corporation to assist in the development of the statewide
harbors modernization plan by establishing the Harbors
Modernization Group. Authorizes the department of
transportation to issue revenue bonds to finance the harbor
improvements. Appropriates or authorizes moneys from the
harbor revenue bond funds. Specifies that on June 30, 2016,
any moneys or funds under the management of the harbors
modernization group pursuant
to section 206J-5.5, Hawaii Revised Statutes, shall be
deposited into the department of transportation harbor
special fund.
Authorizes the use of certain transient accommodations tax
revenues for beach restoration and conservation. Makes
appropriations for fiscal year 2014-2015 and 2015-2016.
Effective upon approval, except for part 1 which is effective
7/1/2016.

Transfers OIP from LG to DAGS. Clarifies the independence of


OIP as an administratively attached agency. Clarifies the
employment status of OIP attorneys and the civil service
exemption for OIP personnel.

deaths have been recorded by DOH, to state agencies that
maintain official lists of persons and are prohibited by federal

Authorizes the Dean of the College of Tropical Agriculture and
Human Resources at the University of Hawaii at Manoa to
establish a two-year industrial hemp remediation and biofuel
research program. Requires a final report to the legislature
prior to the convening of the regular session of 2016. Defines
industrial hemp. Repeals 07/01/2016.
Clarifies the permissible divulging of adult probation records
by probation officers to treatment service providers. Sunsets
on July 1, 2016.
Establishes registration and licensure requirements, including
training, instruction, and continuing education for guards and
individuals acting in a guard capacity. Directs the board of
private detectives and guards to make rules. New registration

Prohibits the use of seclusion in public schools; establishes
conditions and procedures for the use of restraint in public
schools; and requires collection and review of data. Requires
reports. Makes an appropriation.
Updates voter registration laws, including authorizing the
acceptance of electronic applications to register to vote;
applies to all primary, special, nonpartisan, and general
elections, beginning with the primary election of 2016. Makes
an appropriation.
Amends chapter 461J, Hawaii Revised Statutes, by mandating
that physical therapists practicing in the State of Hawaii shall
submit evidence of continuing competence at each renewal
period.
