ee ei R 1 ORDINANCE NO. 2016 - AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF BROWARD COUNTY, LORD PROHIBITING EXTREME WELL STIMULATION FOR PURPOSES OF RESOURCE EXTRACTION NC FRAN 3 AMENDING SECTION 27-193 OF THt COUNTY CODE OF ORDINANCES ("CODE"); AND PROVIDING FOR SEVERABILITY, INCLUSION IN THE CODE, AND AN EFFECTIVE DATE. (Sponsored by Commissioner Beam Furr) enw oa awn © WHEREAS, clean water is fundamental to the health of Florida's environment 10] and economy; and " WHEREAS, public and private water utilities across Broward County rely entirely 12| upon groundwater sources, including the Biscayne and Floridan Aquifers, for potable 13| water supplies; and 14 WHEREAS, extreme well stimulation, such as hydraulic fracturing, acid 15) fracturing, and cyclic steam injection (also known as “‘facking"), is the process of 16] pumping a complex mix of fluids and chemicals, including large volumes of water, under 17| very high pressure into or below the surface of the ground to create fractures or 18] weakness in oil- or gas-bearing geologic formations, for the purpose of producing or 19] recovering oil or gas or to otherwise facilitate the mobility of oil and gas for extraction; 20) and 24 WHEREAS, many of the chemical constituents injected during fracturing have documented adverse effects on human health and the environment; and x 8 23 WHEREAS, there have been more than one thousand (1,000) documented 24] cases of water contamination near fracking sites in the United States; and Coding: Words in struck-through type are deletions from existing text. ON Oar wn Oo "1 12 13 14 15 16 7 18 19 20 21 22 23 24 WHEREAS, the oil and gas industry is not required by federal or state law to Publicly disclose chemical formulas of well stimulation and fracturing fluids; and WHEREAS, the use of well stimulation fracturing mixes may expose groundwater, adjacent land, and surface waters to the risk of contamination through open pit storage, truck transport on roadways, and activities during well development; and WHEREAS, much of Florida's water supply comes from aquifers in highly-permeable limestone formations which are vulnerable to contamination from hydraulic rock-fracturing activities designed to extract hydrocarbons; and WHEREAS, Florida's oil and gas regulations, Chapter 377, Florida Statutes, and Rules 62C-25 through 62C-30, Florida Administrative Code, make no reference to extreme well stimulation techniques; and WHEREAS, extreme well stimulation poses potential risks for contaminating the Floridan Aquifer, the source of drinking water for nearly ten million (10,000,000) Floridians and an essential water supply in Broward County; and WHEREAS, Florida's water supplies and resources are better protected through the prevention of contamination and environmental degradation, rather than the cleanup of contamination and restoration of degraded environments after the fact; and WHEREAS, on June 23, 2015, the Broward County Board of County Commissioners adopted Resolution 2015-340, opposing the use of extreme well stimulation methods in the State of Florida and urging the Florida Legislature to enact legislation prohibiting the use of extreme well stimulation for purposes of resource extraction within the State of Florida; and Coding: Words in struck-through type are deletions from existing text. Words in underscored type are additions. 2 WHEREAS, Broward County's federal and state legislative programs presently include opposition to extreme well stimulation methods, such as hydraulic fracturing and acid fracturing, in Florida, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF BROWARD COUNTY, FLORIDA: ON Omron a Section 1. Section 27-193 of the Broward County Code of Ordinances is 9| hereby amended to read as follows: 10/ Sec. 27-193. If any Court determines that this Ordinance, or any portion hereof, cannot be legally applied to any individual(s), group(s), entity(ies), property(ies), oF circumstance(s), such determination shall not affect the applicability hereof to any other individual, group, entity, property, or circumstance. Section 3. INCLUSION IN CODE. It is the intention of the Board of County Commissioners that the provisions of this Ordinance shall become and be made a part of the Broward County Code; and that the sections of this Ordinance may be renumbered or relettered and the word "ordinance" may be changed to "section," "article," or such other appropriate word or phrase in order to accomplish such intentions. Section 4, EFFECTIVE DATE. This Ordinance shall become effective as provided by law.
