The Board declares it to be the policy of this


district to provide an equal opportunity for all
children to achieve their maximum potential through
the programs offered in these schools regardless of
race, color, creed, religion, sex, ancestry, national
origin or disability/handicap.
A.

The policy of the Hatboro-Forsham School District


trict shall be to provide educational programs
for students as needed on the basis of individual
interests, values, abilities, and potential. No
student shall, on the basis of race, color, national origin, religion, sex or disability/handicap, be excluded from participation in, be denied
the benefits of, or he otherwise subjected to
discrimination under any academic or non-academic
program or activity. The Hatboro-Horsham School
District shall take all necessary actions to comply with the letter and spirit of State and Federal laws 1 prohibiting discrimination in education
programs.

National Origin Discrimination. National origin


discrimination may include, but is not limited
to, determinations made on the basis of a students ancestors, place of birth, or because of
physical, cultural or linguistic characteristics
of a national origin group.

Religious Discrimination. Religious discrimination may include, but is not limited to, determinations made on the basis of an individuals or
groups religious practice or beliefs. Religious practices shall -in addition to traditional religious beliefs) include an individuals or
groups moral or ethical beliefs which are sincerely held with the strength of traditional religious views.

Race or Color Discrimination. Race or color discrimination shall include, but is not limited
to, any determination based solely or in part on
an individuals or groups race or color and may
include a determination based on:
1.

Stereotyped characteristics of any race or


color.

2.

Preference of fellow students based on race


or color.

3.

Racial, physical, cultural or linguistic


characteristics.

Handicap Discrimination. Handicap discrimination may include, but is not limited to, determinations that are based on disability/handicap
which:
1.

Deny a disabled/handicapped student the opportunity to participate in or benefit from


aid, benefits or services.

2.

Afford disabled/handicapped students an opportunity to participate in or benefit from


aid, benefits or services that is not equal
to that afforded others.

3.

Provide a disabled/handicapped student with


aid, benefits or services that are not as
effective as that provided others.

Provide different or separate aid, benefit


or services to disabled/handicapped students
or any class of disabled/handicapped students unless such action is necessary to
provide such students with aid, benefits or
services that are as effective as those provided to others, including special educational aids, benefits or services.

5.

Aids or perpetuates discrimination against


disabled/handicapped students by providing
significant assistance to any agency, organization or person that discriminates on the
basis of disability/handicap in providing
aid, benefits or services to beneficiaries
of School District programs.

6.

Otherwise limits disabled/handicapped students in the enjoyment of any right, privilege, advantage or opportunity enjoyed by
others.

Grievance Procedures. Any student or group of


students alleging discrimination may use the student complaint procedures or may complain directly to the building Principal, guidance counselor
or the Affirmative Action Coordinator.
The right to confidentiality will be respected
consistent with the School Districts legal obligation and with the necessity to investigate the
complaint.
A substantiated charge of discrimination against
a staff member shall subject such staff member
to discipline.
It shall be the duty of the Affirmative Action
Coordinator to report all suspected incidents of
discrimination to the Superintendent and the
Board of School Directors.
