DETAILED ACTION

The present application, filed on or after March 16, 2013, is being examined
under the first inventor to file provisions of the AlA.

Claim Rejections - 35 USC 103


In the event the determination of the status of the application as subject to AlA 35
U.S.C. 102 and 103 (or as subject to pre-AlA 35 U.S.C. 102 and 103) is incorrect, any
correction of the statutory basis for the rejection will not be considered a new ground of
rejection if the prior art relied upon, and the rationale supporting the rejection, would be
the same under either status.
The following is a quotation of 35 U.S.C. 103 which forms the basis for all
obviousness rejections set forth in this Office action:
A patent for a claimed invention may not be obtained, notwithstanding that the claimed
invention is not identically disclosed as set forth in section 102 of this title, if the differences
between the claimed invention and the prior art are such that the claimed invention as a whole
would have been obvious before the effective filing date of the claimed invention to a person
having ordinary skill in the art to which the claimed invention pertains. Patentability shall not
be negated by the manner in which the invention was made.

Claims 1, 2 and 17 are rejected under 35 U.S.C. 103 as being unpatentable over
Tiscareno et al. (US 2009/0202097) herein Tiscareno in view of Smailagic et al. (US
2012/0321103) herein Smailagic.

Regarding claim 1, Tiscareno discloses an intra-canal earphone (in-ear


earphone of Figs. 1-6), comprising:

a housing having a chamber (housing 104 with a chamber 107, Figs. 1, 2), a nozzle
having a nozzle lumen (tube 108 interpreted to meet nozzle having a lumen 111,
Figs. 3, 4), wherein the nozzle is rigid (tube 108 is rigid, [0018]);

a driver located in the chamber and having a driver port (driver 106 located in
chamber 107 having a driver port 103, Figs. 1, 2), the driver being configured to

receive an electrical audio signal and to emit sound from the driver port (driver
receives an electrical audio signal and emits sound from the driver port, [0014]);

and
a resilient joint having an elastomeric body and a joint channel (flexible sleeve 213 has
a joint channel inside, [0018], Fig. 2), wherein the nozzle is pivotally coupled with the

housing through the elastomeric body (the tube 108 is pivotally coupled with
housing 104 through flexible sleeve 213, Figs. 1,2, [0018]), and wherein the nozzle

lumen is acoustically coupled with the driver port through the joint channel (tube 108
lumen 111 (acoustic pathway) is acoustically coupled with driver port 103 through
the flexible sleeve 213, Fig. 2), but lacks wherein the housing is rigid.

Nevertheless, Tiscareno teaches rigid earphone components and it is well known


in the earphone art to have rigid housing as demonstrated by Smailagic (housing 120
of headphone 105 is rigid, Smailagic: Fig. 1 B, [0036]). Therefore it would have been

obvious to a person having ordinary skill in the art prior to the effective filing date of the
claimed invention to modify the housing of Tiscareno to be rigid as demonstrated by
Smailagic in order to better protect the driver and electrical components inside.

Regarding claim 2, in the combination of Tiscareno and Smailagic, Tiscareno


discloses wherein the elastomeric body is elastomeric to allow the nozzle to pivot
relative to the housing from an initial state when an external load is applied to the nozzle

(the flexible sleeve 213 allows for pivoting of the articulation of acoustic tube 108
with respect to the housing 104, Tiscareno: Figs. 1, 2, [0018], if an external load is
applied to the tube 108 the tube 108 would pivot) and the nozzle returning to the
initial state when the external load is removed (since the nozzle of Tiscareno is

elastomeric/flexible it has the explicitly implied ability to return to its initial state
once a load is remoxed).

Regarding claim 17, Tiscareno discloses a method, comprising:


forming a housing having a chamber (housing 104 is formed with a chamber 107,

Figs. 1, 2),
forming a nozzle having a nozzle lumen (tube 108 interpreted to meet nozzle having

a lumen 111 is formed, Figs. 3, 4), wherein the nozzle is rigid (tube 108 is rigid,

[0018]); and
molding a resilient joint having an elastomeric body and a joint channel over at least a
portion of the housing and the nozzle (flexible sleeve 213 having a joint channel

inside and elastomeric body, [0018], Fig. 2 is molded over at least a portion of the
housing 104 and tube 108), such that the nozzle is pivotally coupled with the housing
through the elastomeric body and the nozzle lumen is acoustically coupled with the
chamber through the joint channel (the flexible sleeve 213 allows for pivoting of the

articulation of acoustic tube 108 with respect to the housing 104, Figs. 1, 2,
[0018], and (tube 108 lumen 111 (acoustic pathway) is acoustically coupled with
driver port 103 through the flexible sleeve 213, Fig. 2), but lacks wherein the

housing is rigid.
Nevertheless, Tiscareno teaches rigid earphone components and it is well known
in the earphone art to have rigid housing as demonstrated by Smailagic (housing 120
of headphone 105 is rigid, Smailagic: Fig. 1 B, [0036]). Therefore it would have been

obvious to a person having ordinary skill in the art prior to the effective filing date of the
claimed invention to modify the housing of Tiscareno to be rigid as demonstrated by
Smailagic in order to better protect the driver and electrical components inside.

Claim 13 is rejected under 35 U.S.C. 103 as being unpatentable over Tiscareno


et al. (US 2009/0202097) herein Tiscareno in view of Smailagic et al. (US
2012/0321103) herein Smailagic and Silvestri et al. (US 2012/0039500) herein Silvestri.

Regarding claim 13, while Tiscareno and Smailagic does not specifically teach

wherein the elastomeric body comprises a thermoplastic elastomer, it is well known in


the earphone art to have an elastomeric body comprise a thermoplastic elastomer as
demonstrated by Silvestri (elastomeric body comprising thermoplastic elastomer,
Silvestri: [0046]).

Therefore it would have been obvious to a person having ordinary skill in the art
prior to the effective filing date of the claimed invention to modify the elastomeric body

of Tiscareno and Smailagic to further comprise a thermoplastic elastomer in order to
reduce manufacturing costs (Silvestri: [0046]).

Claims 14-16 are rejected under 35 U.S.C. 103 as being unpatentable over
Tiscareno et al. (US 2009/0202097) herein Tiscareno in view of Smailagic et al. (US
2012/0321103) herein Smailagic and Takai (US 2011/0164777).

Regarding claim 14, while Tiscareno and Smailagic does not specifically teach
wherein the driver includes a balanced armature transducer, it is well known in the art to
have an earphone with a driver that includes a balanced armature transducers as
demonstrated by Takai (driver unit 6 is a balanced armature driver unit, Takai: Fig.

1, [0020]).
Therefore it would have been obvious to a person having ordinary skill in the art
prior to the effective filing date of the claimed invention to modify the driver of Tiscareno
and Smailagic to be a balanced armature transducer as taught by Takai in order to
advantageously be able to size a sound transducer to be small enough to fit into small
earphones (Takai: [0005]).

Regarding claim 15, in the combination of Tiscareno, Smailagic and Takai,


Tiscareno discloses further comprising a compliant tip having a tip lumen acoustically
coupled with the driver port through the nozzle lumen, wherein a tip outer surface is
configured to seal against an ear canal (ear tip 304 having a tip lumen 306 that is

acoustically coupled with the driver port via the tube 108 lumen 111, with the tip
304 outer surface configured to seal against an ear canal 309, Tiscareno: Fig. 3).

Regarding claim 16, in the combination of Tiscareno, Smailagic and Takai,


Tiscareno discloses further comprising: an audio jack; and a cable electrically
connected to the audio jack and to the driver, the cable being configured to transmit the
electrical audio signal from the audio jack to the driver (it is explicitly implied that
cable 604 connects the audio jack 606 to driver 106 and transmits electrical audio
signal from the audio jack to the driver 106, Tiscareno: Fig. 6, [0024]).

Allowable Subject Matter


Claims 3-9, 10-12, and 18-20 are objected to as being dependent upon a rejected base
claim, but would be allowable if rewritten in independent form including all of the
limitations of the base claim and any intervening claims. The prior art of record lacks
having "wherein the resilient joint is attached to a housing inner surface of the housing,
and wherein the resilient joint is attached to the nozzle" as required by claim 3 and lacks
having "wherein the resilient joint includes a driver receptacle, and wherein a driver
outer surface of the driver is located within the driver receptacle" as required by claim
10 and further lacks "wherein the resilient joint includes a driver receptacle in fluid
communication with the joint channel, and further comprising installing a driver in the

driver receptacle such that a driver port of the driver is acoustically coupled with the
nozzle lumen through the joint channel" as required by claim 18.
