‘And Whereas, the forest of this Sanctuary intercept rainfall and belp recharge ground water aquifer, protect rivers and streams against siltation by minimising soil erosion and. has well-knit network of perennial or semi-perennial and seasonal streams, nalas oF rivers which feed minor irrigation projects and water harvesting structures and are tributaries to the river Brahman = ‘And Whereas, the sanctuary is an excellent habitat for AsianElephants and some of the most endangered species ike Elephan(Elephasmasimus), Hyena (Hgaenahyaena), Spotted Deer (Axix axis). Sambar (Ceruus wnicolor), Wolf (Canis lupus), Bears (Melursusursinus!), Sloth Bears, Common Longoors, Jackal (Canisaureus), Tox (Vulpeshengalensis), Hares (Lepusnigricowus), Wikd Boar (Susscrofa), porcupines (Hfystrixindica), Peacocks (Pavocristatus), Varieties of Birds, Snakes, Lizards etc: ‘And Whereas, the sanctuary is an excellent habitat for flora with Sal ie Shorearobustaas the dominant species along with the associates like Kasi (Brdeliaretusa), Simul (Bombaxceiba), Kangara (Xyliaxylocarpa), Sidha(Albizialebbeh), Phasi (Anogeissusaccuminata), Kendu (Diospgrousmelanorylon), Jamu(Syzygiumanminfi), Amla (Emblicaoffcinalis), Mango (Mangiferaindica).Asan (Terminaligalata), Bija (Pterocarpusmarsupium), Kurum (Adinacordifulia), Teak (Tectonagrandis), Dhaura (Anogeisustatifolia).Kadamba (Andhocephaluskadamba), Karanja (Pongamiapinnata). Kusum (Schleicheraoleosa), Mundi (Sphacranthusindica), Mabul(Madhucaindica), Bela (Aeglemarmelos), Gmabhati (Gmelinaarborea),Kanchan (Bauhinia acuminata), etc: (ST are 3¢)) STO: TO u ‘And whereas, its necessary to conserve and protect the KapilashWikdlife Sanctuary and propagate improvement of develop wild life therein and its environment; And whereas it has become nevessary to specify certain areas around the Kapitash Wildlife Sanctuary as lco-sensitive Zone and to prohibit industries, operational or process or class of industries, operations or processes in the said e0- sensitive Zone, Now, therefore, in exercise of the powers conferred by sub-section (1) clause (v) and clause (xiv) of sub-section (2) and suih-scetion (3) of seetion 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Govemmment hereby notifies an area up to 13.15kilometersfiom the boundary of the Kapilash Wildlife Sanctuary in the State of Odisha as the Eco-sensitive Zone, details of which are as ‘under, namely: 1. Extent and Boundaries of Eeo-sensitive Zone.~(1) The Eco-sensitive Zone varies from 500 meters to 13.15 kilometers all around the Kapilash Wildlife Sanctuarycovering geographical area of 393.87 sq. km. with total perimeter of the Feo sensitive Zone boundary of 245.85 km. (2) The Eco-sensitive Zone is bounded by 20° 43° 55.S18"N latitude and 85°55’ 30.586"FIongitude towards East(Reference point pill No.200 of map); 20° 38° $0.930"N tatitude and 85° 41° 11.524°E longitude towards west(Reference point pill No.1 of map); 20° 41° 44.559°N latitude and 85° 48° 42.827°E longitude towards north(Reference point pill No.100 of map) and 20° 38° 20:399°N latitude and 85° 44° 55.087"E longitude towards south Reference point pill No.300 of map). 3) The map of Eco-sensitive Zone boundary together with is latitudes and longitude of extremes and extent is appended to this notification as Annexure I. (The list ofvillages falling within the Kapilash SanctuaryEco-sensitive Zone alongwith their longitude and Jatitudesat prominent pointsisappended to this notification as Anmexure II: «Provided that the Annexure IT shall be subject to list of villages confirmed by the State Government in the Zonal Master Plan, 2 Zonal Master Plan for the Keo-sensitive Zone.-(1)The State Government shall for the purpose of etfective ‘management of the Lco-sensitive Zone, preparea Zonal Masicr Planwithin period of one year fom the date of publication of this notification in the Official Gazette, for consideration and approval of the Central Government in the Ministry of Environment and Forests in consultation wit local people and with the approval of the followingconcerned Se Depurunents namely:-(i) Forest and Environment) Tourist (ii)irrigation(iv) Housing and Urban Development, (v) Public Works Department (Building and Roads);(vi) RevenueDepariment and Odisha State Pollution Control Boat (2) The Zonal Master Plan shall provide for restoration of degraded areas, conservation of exis ‘management of catchment areas, watershed management, ground water management, soil and moist needs of local community and such other ecological and environmental aspects ing. walcr bodies, conservation, (3) The Zonal Master Plan shall demarcate all the existing and proposed urban settlements, village settlements, worshipping places, types and kinds of forest, agriculture areas, horticultural areas, fertile lands, green areas, orchards, lakes and other water bodies excluding all canal and drainage works, (4) ‘The Zonal Master Plan stall lay down the terms und conditions and such other measeres as may be specified by the Central Government or the State Government from time to time, for the regulation of activities specified under column (2) of the table in paragraph 3. (5) The State Government shall, while drawing up the Zonal Master Plan, comply with the following namely:~ (a) Land Use-Forests, horticulture ateas. agricultural areas, parks and open spaces earmarked! for recreational Drposes in the Eco- sensitive Zone shall not be used or constructed into areas for commercial or industrial related development activities: Provided tha the conversion of agricultural lands within the Eco-sensitive Zonemay be permitted on the recommendation of the State Level Eco-sensitive Zone Monitoring Committee (SESZMC) and with the constituted under paragraph 4 and with the prior approval of the State Government, 10 meet the residential needs of the local residents.and for the activities listed at item numbers 11, 27, 28, 32 and 33specified under column (2) of the table in Paragraph 3, namely'- (i) rainwater harvesting, (i)Cottage industries including village artisans, etc. (ii) Small scale 2 TH 2 GAZETTE OF INDIA: EXTRAORDINARY (Paxr sec. 39) industries not causing potlution,(v)Fco-tourism facilities like, home stays, ropeways, kiosks, funiculars, ete., and (v) Security Forces Camp, Provided further that no use of tribal land shall be permitted for commercial or industrial related development ‘activities without the prior approval ofthe State Government and without compliance of the provisions of the law for the time being in force, incloding the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act,2006(2 of 2007). ‘The Central Government and the State Goverment may specify such other measures, as may be considered necessary, for giving effect to the provisions ofthis notification, (b) Natural springs.-The catchment areas ofall springs Shall be identified and plans for conservation and rejuvenation Of springs shall be incorporated in the Zonal Master Plan and strict guidelines be drawn up for the prohibition of development activities at or near these areas {(€) Tourism.-the activity relating to tourism within the Eco-senstive Zone shall be as under, namely: (all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in ‘accordance with the guidelines issued by the Central Government in the Ministry of Environment and Forests and the Ministry of Tourism and by the National Tiger Conservation Authority, with emphasis on eco-tourism, eco-education sand eco-development and based on carrying capacity study of the Eco-sensitive Zone; (i) new construction of any kind shall not be allowed within the Beo-sensitive Zone except the activity listed at item No 32 relating to Eco Tourism specified under column (2) of the able in paragraph 3; ii) Gl the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall he penmitied by the concerned regulatory authorities hased on the actual site specific seruitinisation and on the recommendation of the SESZMC; (a) Natural heritage.» All sites of valuable natural beritage in the Eco-sensitive Zone such as gone pool reserve arcas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides cliffs, ete. shall be identified and be preserved andproper plan be drawn up for their protection and conservation, within six months from the date of publication of this notification (€) Noise pollution.-The Environment Department or the State Forest Department ofOdishashall draw up guidelines and regulations for the control of noise pollution in the Fco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981(14 of 1981). (6) Air pollution.-TheE:nvironment Department or the State Forest Department ofOdishashall draw up guidelines and regulations for the control of air pollution in the Eco-sensitive Zone in accordance with the provisions oF the Air (Prevention and Control of Pollution) Act, 1981(14 of 1981), (@) Discharge of effluents.- Thedischarge of treated effluent in Eco-ensitive Zone shall be in aecordance with the provisions of the Water Prevention and Control of Pollution) Act, 197446 of 1974). (h) Solid wastes.- (i) The solid waste disposal in Eco-sensitive Zone shall be carried out as per the provisions of the “Municipal Solid Waste (Management and Handling) Rules, 2000 published by the Central Government vide notification ‘number §.0. 908 (E), dated the 25* September 2000; (Gi) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non-biodegradable ‘components; (Gi) the biodegradable material shall be recycled preferably through composting of vermiculture; (iv) the inorganic material shall be disposed of in an environmentally acceptable manner. (@ _Biosmedical waste-The biomedical waste disposal in the Peo-semsitve Zone shall be carried out as per the provisions of the Bio-Medical Waste (Management and Handing) Rules, 1998 published by the Central Goverment vide notification numberS.0.6304E), dated te 20° July, 1998 Vehicular Traffic The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal master plan is [prepared and approved by the Ministry of Environment and Forests, the SES7MCshall monitor the compliance of vehicular movernent as per the rules and regulationsfor the time being in fore. 3.
