AHMEDABAD:AtatimewhenNarendraModi'sdevelopmentmodelisundernationalspotlight,theComptrollerandAuditorGeneral(CAG)hascriticizedhis
governmentinGujaratforimprudentfiscalmanagement.Ithasunderlinedaneedforgreaterprofessionalismandaccountabilityinthefunctioningofthegovernment
andaskedittobemorealertandresponsive.
Thenationalauditorhassaidthestategovernmenthasincurred41%higherdebtthanthepreviousfiscalandburdenedtheexchequerwithheavyinterestliabilityata
higherrate.
ThestategovernmenthadtakenaloanofRs15,083croretoadjustthemonitorydeficitofRs11,027crore,leavingabalanceofRs3,645crore,whichispoordebt
management,saidCAG.
IthasinvestedRs39,179croreincorporations,boards,governmentcompanies,ruralbanksandjointventures.Inthelastfiveyears,theaveragereturnonthis
investmentwas0.25%whilethestategovernmenthaspaidinterestattherateof7.75%.

TheCAGreport,whichislikelytobetabledintheongoingsessionofthestateassembly,alsocriticizedthegovernmentfornotfurnishingutilizationcertificateof
Rs9,066.34crore.
TheCAGhasalsoobservedthatcomparedtootherstates,Gujarattraditionallyspendslessoneducationandhealth.Though,in2011,theamountspentonhealth
wasadequate.
IthasalsoridiculedthegovernmentoncomputerliteracyandeducationRs292crorewasallocatedbutonlyRs88.24crorewasused.Similarly,forspecial
courts,Rs629crorewasgranted,butonlyRs252.45crorewasused.
Intheroadsandbuildingsdepartment,Rs957.95crorewasallocatedforconstructingoffices,butnotevenhalftheamountwasspentforvariousreasons.Sighting
manysuchexamples,CAGhasobservedthatthereiswidevariation,practicallyundereverymajorheadofaccount.
Althoughtheentirestategovernmenthasbeencriticized,thefinanceandpublicsectorshavebeenshownasleastefficient.Forexample,savingsundereachmajor
headsclearlysuggestnonperformanceofgovernmentdepartments,forwhichnoreasonshavebeengiven.

"OurownprojectionswerethattheallIndiaslumpopulationwouldbe27.5%by2011,sothenewdatacomesasapleasantsurprise,"ArunKumarMisra,secretary
intheministryofhousingandurbanpovertyalleviation,said.TheslumpopulationsinindividualcitieslikeMumbaiwasalsolowerthanexpected,Mishrasaid.
Thecensusdefinesaslumas"residentialareaswheredwellingsareunfitforhumanhabitation"becausetheyaredilapidated,cramped,poorlyventilated,unclean,or
"anycombinationofthesefactorswhicharedetrimentaltothesafetyandhealth",registrargeneralofIndiaCChandramoulisaid.
Roughly1.37crorehouseholds,or17.4%ofurbanIndianhouseholdslivedinaslumin2011,datareleasedbytheregistrargeneralandcensuscommissioner'soffice
showed.Thenewdataisdifficulttocomparewithpreviousyears,becausethe2011Censuscoversall4,041statutorytownsinIndia,ascomparedto2001whenonly
statutorytownswithpopulationover20,000werecovered.The2001datahadsetIndia'sslumpopulationat15%ofthetotalpopulation.
Thecensuscountedslumsnotifiedundervariousacts,thoserecognizedbygovernmentsbutnotnotified,andthosethatwereinnowayacceptedbystate
governments,butfitthedefinitionofaslum.HousingandurbanpovertyalleviationministerAjayMakensaidthatthehighproportionover37%ofslum
householdsinthislast,unrecognized,categorywasaseriousproblem,andcommittedtohisministryextendingbenefitsliketheRajivAwasYojanatosuchslums
too."Stategovernmentsareunwillingtoadmittotheirbeingmoreslumsintheircitiesbecausethentheywillhavetoprovidetheseslumsbasicserviceslikewater
anddrainage,"Makensaid.
Withtheexceptionofsanitation,theindicatorsonhousingamenitiesforslumandnonslumhouseholdsinmostofIndiaaremoresimilarthanmostwouldexpect.
Over77%arepermanentand70%areowned,andnotrented.Closetohalfaremadeupofjustoneroomandmostarehometoonemarriedcouple.
Over70%ofslumhouseholdsgettheirwaterfromatapbutjusthalfgetwaterinsidetheirhomes.Over90%getelectricityandmostuseLPGforcooking70%
haveaTVand10%evenacomputer.Thecensusdataseemstoindicatethatthe"morecellphonesthantoilets"linemightbewrongforurbanIndia:twooutofthree
slumhouseholdshaveatoiletwithinthepremises,whileslightlyfewerhaveamobilephone.
MorethanoneinfiveurbanhouseholdsinAndhraPradesh,Chhattisgarh,MadhyaPradesh,Odisha,WestBengalandMaharashtralivesinaslum.Inabsoluteterms,
Maharashtrahasthehighestnumberofslumblocksofanystateover21,000outofatotalofjustover1lakhforthewholecountry.
OverathirdofIndia'sslumpopulationlivesinits46millionpluscities.Ofthemetros,Mumbaihasthehighestproportionofslumdwellinghouseholds(41.3%of
itspopulation).Kolkataisnextatnearly30%withChennainotfarbehind.Delhihas14.6%ofitshouseholdslivinginslumswhileBangaloreisthebestoffofthe
fivemetrosatlessthan10%.

governmentonThursdayfinallyrestoredthestatusofotherscheduledlanguagesbybringingpartialchangeintheMarch5thnotificationallowingaspirantstotake
theirtestinanyregionallanguage.
Besides,aspirantscanalsooptforliteratureofanyofthe22eighthschedulelanguagesandEnglishastheiroptionalsubjecteveniftheydidn'tstudythemduring
theirundergraduatecourses.
Underthefreshnotification,themarksofEnglish(100marksasspecifiedbyMarch5thnotification)willalsonotbecountedformakingmeritlistofselected
candidatesforeliteserviceslikeIAS,IFS,IPSandothercentraljobs.
TheUPSC,however,increasedthemarksofessaypaperfromexisting200to250.ThetotalmarksintheMainexamwillnowbe1,750fourpapersofgeneral
studies(1,000),twopapersofanoptionalsubject(500)andessay(250).
Announcingtheamendmenttothecommission'sMarch5notification,ministerofstateforpersonnel,VNarayanasamy,said,"Acandidatewillbeallowedtouse
anyoneregionallanguagefromthe8thScheduleoftheConstitutionofIndiaorEnglishasthemediumofwritingtheexaminationasbefore.Theconditionalityofa
minimumof25candidatesinthatmediumandtherequirementtohavethatlanguageasthemediumofexaminationatgraduationlevelisproposedtobedropped".
Aspertheamendment,theEnglishcomponent(of100marks)fromtheessaypaperwillalsobedroppedandthetwoqualifyingpapersof300markseachinany
modernIndianlanguageandinEnglishasinpreviousyearswillberestored.
"Theessaypaperwillnowbeof250markstobewritteninthemedium/languageofcandidate'schoice,"theministersaidinParliament.
Hesaidthegovernmenthadrelookedatsomeaspects(thelanguagesection)ofthenewlynotifiedpatternofthecivilservices(Main)examinviewoftheconcerns
raisedbythemembersinbothHousesofParliament.
BesidesgivingweighttotheEnglishlanguagepaper,theMarch5thnotificationhadcarriedthecontentiousprovisionsrelatingtoregionallanguages,prohibiting
candidatestooptforliteratureofanyparticularlanguageastheiroptionalsubjectiftheydidn'tstudyitintheirgraduationcourse.Similarly,italsoprohibitedthem
towritetheirexaminaparticularregionallanguageiftherearelessthan25candidatesoptingforthatmediumofinstruction.
Inthatcase,theywouldhavetowritetheirexamineitherEnglishorHindi,whichwasvehementlyopposedbymanyaspirantsinnonHindispeakingstates.
TheMarch5thnotificationhadalsodrawnseverecriticismfromchiefministerswithanumberofthem,includingShivrajSinghChauhan(MadhyaPradesh),J
Jayalalithaa(TamilNadu)andNarendraModi(Gujarat),writingtoPrimeMinisterManmohanSinghdemandingwithdrawaloftheorder.
NoneoftheCMsorpoliticalparties,however,hadopposedthenotificationforitsnonlanguagerelatedchangeswhereitgivessubstantialweighttogeneralstudies
papersintherevampedsystem.

NEWDELHI:Inabidtoplacatedepartingally,DMK,theUPAgovernmentplayedoutafarceattheUNHumanRightsCouncil(UNHRC),wherebyIndiamoved
sevenamendmentstoaUSsponsoredresolutionagainstSriLanka,andallofwhichweredulyrejectedbytheUS.Intheend,Indiavotedinfavourofthefinaldraft
resolutionthathadbeenwatereddown,largelyduetoNewDelhi'sownefforts.
Pakistanvotedagainsttheresolution.SupportingSriLanka,thePakistanienvoysaidtheysympathizedwithColombowhichhad"facedterrorism,fundedandarmed
fromabroad".ItwasathinlyveiledattackonIndia,whichfrequentlyattacksPakistanforcrossborderterrorismintoIndia.
OnWednesday,asthegovernmentstruggledtokeepDMKbackandsavetheUPA,ithadorderedministryofforeignaffairstomovesevenamendmentsagainst
LankaalongwiththeUSandothersponsors.ThiscameoutofameetingbetweenPM,externalaffairsministerSalmanKhurshid,financeministerPChidambaram,
nationalsecurityadvisor(NSA)ShivshankarMenon,foreignsecretaryRanjanMathaiandIndia'spermanentrepresentativetoUNDilipSinha.Theseamendments
weretoughenoughthatwouldhaveensuredaseriousdownturninIndoLankanties.
ThesewrittenamendmentswererejectedbytheUSandothersponsors,onthegroundsthatatighterresolutionwouldreducethenumberofsupportersforthe
resolution.Incidentally,theinitialdraftoftheresolutiontookatoughlineagainstLanka.ItneededalotofquietnegotiationsbyIndianofficialstowaterdownthe
textoftheresolutiontomakeitreasonablyacceptabletobothNewDelhiandColombo.
ForIndiatoattempttoamendtheresolutionyetagain,fordomesticpoliticalconsiderations,isanewlowinNewDelhi'sforeignpolicy.
NotcontentwiththeUSrejection,thegovernmentthenorderedthatIndiamoveanoralamendmentattheUNHRConThursdaymorning.OnWednesdaynight,
OppositionpartieshadrefusedtoaccedetoagovernmentmovetopassaparliamentaryresolutionagainstLanka.Thatreducedtheneedforanoralamendment,
particularlysinceIndiariskedgettingisolatedintheCouncil,sinceitwasunlikelythatothersponsorswouldbacktheresolution.
Intheend,Indiavotedfortheresolutionthathadbeenrevisedonlyacoupleofdaysearlier.Theresolutionwentthroughwith25votesinfavour(onemorethanlast
year),13against,eightabstentionsandGabon,whichwasabsent.ThecountriesthatstoodwithSriLankaincludedeightAsiannations,twofromLatinAmericaand
threefromAfrica.
Inaswiftreaction,LankangovernmentannounceditwouldtakebacksomeofthetanksfromtheIndianOilCorporation'sstrategicreservefacilityinTrincomalee.
LankaninformationministerKeheliyaRambukwellaonThursdayannouncedplanstoretakeunutilizedtanksfromLankaIOC.

JuvenileJusticeActof2006ashewasaminoratthetimeofcommittingthecrime?
Qureshi'scounselhadinvokedtheprovisionsofJuvenileJusticeActtoseekleniencyforhim.However,abenchofJusticesPSathasivamandBSChauhanrejected
theargumentandupheldlifetermawardedtohimbythetrialcourtandsaidterroristscouldnotbedifferentlyclassifiedas"majors"and"minors".
"Thereisnojustificationwhatsoevertorestrictthemeaningof'anyperson'and'whoever'onlytoamajorornonjuvenileassuchaninterpretationwouldhavea
potentialitytodefeattheobjectofTerroristandDisruptiveActivities(Prevention)Act,"thebenchsaid.
WhatweighedonthebenchwasthatTADAhadlapsedbythetimeJJAct,withthemandatetooverrideallexistinglaws,cameintoforce.However,Justices
SathasivamandChauhandidsay,"WecannotacceptthecontentionthatJJActwouldoverridetheprovisionsofTADAinallcircumstanceswithoutanyexception."
Thebenchsaid"endsofjustice"wasveryimportanttothesurvivalofruleoflawinthecountryandlawshadtobeinterpretedkeepingthisinmind.
"Antisocialoperationoftheappellantswasnotdesignedagainstanyindividual,ratherprovedtobesecurityriskwhichimperiledaverylargenumberofinnocent
personsanddamagetothepropertiesworthaverylargeamount,"itsaid.
ThecourtskirtedthequestionofcomparativeforcebetweenthelegislationswithaneasyconclusionthatTADAwasnotinforcewhenJJActcameintobeing.
Thebenchsaid,"ItisclearthatQureshifromhisconductreferredtoabovecannotbyanystretchofimaginationqualifyasachildinneedofcareandprotectionas
theactscommittedbyhimaresograveandheinouswarrantingthemaximumpenaltybutthedesignatedcourtafterconsideringallthesefactorsawardedhimlesser
punishmentwhenthecoaccusedwhoaccompaniedhimtofisherman'scolonyandcommittedsimilaractswereawardedwithmaximumpunishmentforheinousacts

KatjusoughtpardonforDuttunderArticle161oftheConstitutionsayingthathehadnotbeenfoundguiltyofhavingplayedaroleinthe1993blastsandhad
sufferedalot.
SeekingpardonforDutt,thePCIchiefcitedhowtheactorhadthroughhisfilmrevivedthememoryofMahatmaGandhiandthemessageofthefatherofthenation
anapparentreferenceto"Gandhigiri"inhisMunnabhaifilms.
Inastatementissuehere,thePCIchiefsaidtheSupremeCourt,havingfoundthatDutthadinhispossessionaprohibitedweaponwithoutalicence,awardedhimthe
minimumimprisonmentwhichwasprescribedunderlaw.
"Section25(1(A)oftheArmsActstatesthatifapersonhasinhispossessionaprohibitedweaponwithoutalicence,heshallbeawardedpunishmentofnotless
than5yearsimprisonmentandnotmorethan10years,"Katjusaid.
HeaddedthepowerofpardonunderArticle161bytheConstitutionisdifferentfromjudicialpowerastheGovernororthePresidentcangrantpardonorreducethe
sentenceofthecourtevenifaminimumisprescribed.
"Hence,thereisnodoubtthattheGovernorcangrantpardon/reducethesentence.Forexample,inthecaseofCommanderNanavatiwhowasheldguiltyofmurder,
theGovernorgavehimpardonalthoughtheminimumsentenceformurderislifesentence,"Katjusaid.
HesaidtheSupremeCourthadnotfoundDuttguiltyforthe1993bombblastsbutonlyfoundhimguiltyofhavinginhispossessionaprohibitedweaponwithout
licence."Surely,thisisalesseroffencethanmurder.WhentheGovernorofMaharashtragrantedpardontoNanavati,surelyhecangrantpardontoSanjay,"Katju
said.
HeaddedthoughDutthadcommittedanoffencethere,areextenuatingcircumstanceslikethattheeventhappened20yearsago."Duringthisperiod,Duttsuffereda
lotandhadacloudhoveringoverhisheadthroughout.Hehadtoundergovarioustribulationsandindignitiesduringthisperiod.Hehadtogotocourtoften,hehad
totakethepermissionofthecourtforforeignshootings,hecouldnotgetbankloans,etc,"Katjusaid.

internationallyandthefirstoneinvolvingtheuseofRDXwhocouldbetried.

Pronouncingitsfinalverdictintheterroristatrocity,plottedasanextensionofcommunalviolencethatbrokeoutinMumbaiinthewakeofBabridemolitionin
December1992,theapexcourtblamedPakistanforencouragingandhelpingtheterrorists.
Inaunprecedentedlylongjudgmentrunningintoover2,000pages,abenchofJusticesPSathasivamandBSChauhansaidthatwhileYakubparticipatedinthe
conspiracywithTigerMemonandDawoodIbrahimanddeservednoleniency,theother10,thoughresponsibleforplacingexplosiveladenvehiclesatseveral
places,neededtobeevaluatedonadifferentplaneastheybelongedtolowerstrataofsocietyandweresuckedintotheconspiracytobeusedas"arrows"bythe
mastermind"archers".

Ofanother19sentencedtolifeimprisonmentbythetrialcourt,theapexcourtupheldthepunishmentfor17.Oftheremainingtwo,thelifesentencewasreducedto
10yearsimprisonmentinonecase,andtotheperiodalreadyservedintheother.
Significantly,itallowedappealsofMaharashtraPoliceagainstacquittalofsixaccusedandimposedlifesentenceonthem.ThesixareUttamSPotdar,IssaqMohd
Hajwane,SharifAbdulGafoor,ManojKumarBhanwarlal,FarooqIlliyasMotorwalaandMohdRafiqUsman.
Thisbroughtthenumberofthosesentencedtolifeinthecaseto33.Thecourtstressedthattheywillstayinjailfortherestoftheirlives.
Thebenchalsoconfirmedthesentenceofcustomsofficialsandpolicepersonnelwhofacilitatedtheconspiratorsinreturnforbribes,andcensuredtheCoastGuard
fornotbeingvigilantenoughtoblocktheshipmentsofarmsandexplosivesthatwereusedtoattackMumbai.
Commentingontheenormityofthecrime,thejudgessaid,"ThiswasthefirsteverterroristattackintheworldwhereRDX(ResearchDepartmentExplosives)was
usedonalargescalebasisafterWorldWarII."
However,thereweredoubtsthattheverdictwouldbringclosuretothevictimsofmassmurderinMumbai20yearsago,consideringthatthemasterminds
underworlddonDawoodIbrahim,hisbrotherAneesIbrahimandYakubMemon'sbrotherTigerMemonhavenotbeenbroughttojusticeyet.Byallindications,
thethreeareleadingacomfortablelifeinPakistanwhichhasshelteredthemsincetheblasts.
Infact,thesensethatjusticehadnotbeendonemayonlybereinforcedbywhatJusticesSathasivamandChauhansaidtojustifytheuseofdifferentapproaches
towards"mastermind"Yakubontheonehand,andthe10"pawns"ontheother."Sentenceshoulddirectlyreflecttheroleoftheaccusedinthecrime,"thebench
said.
Itelaborated,"These10accusedparkedexplosivefilledvehiclesintherespectivedestinations.However,ifwelifttheveil,itisactuallythemastermind'sstrategy,
whichwasexecutedbythesubservientminions.Thismaynothelpincompleteexonerationoftheliabilityofthese10appellantsbutthedegreeofpunishmentmust
necessarilyreflectthisdifference.Itisvitaltorememberthatbutforthemasterminds,theseblastsshouldhaveneverseendaylight.Wecontemplatethattheendsof
justicewouldbeservedifthedeathsentenceofthese10appellantsbecommutedtolifeimprisonment."
Pronouncingthejudgment,JusticeSathasivamreadoutitsbriefsummaryformorethan90minutes,asapackedcourtroomlistenedinraptattention.
OnYakub,thebenchsaid,"Aperusaloftheaboveconfessionsbythecoconspiratorswouldshowthattheappellant(A1)wasplayingakeyroleinfurtheranceof
theabovesaidconspiracy.TheaboveevidencealongwithfurthermaterialreliedonbytheprosecutionshowthatA1alsoplayedanactiveroleingenerationand
managementoffundsforachievingtheobjectbehindtheconspiracyandinallsubsequentevents."
Itadded,"YakubleftforDubaion11.03.1993withanIndianpassportandthereafterheenteredPakistanwithaPakistanipassport.Thoughhewasnotoneamong
thepersonswhocarriedarmsandammunitionusedfortheblastbutitwashewhostoodbehindthemfromstartingtilltheend,forexampleconspiracy,planningand
makingallthearrangementsforsendingcertainpersonstoPakistanfortraininginhandlingofarmsandammunition.
"WearesatisfiedthattheprosecutionhasestablishedallthechargesleveledagainstYakubandthedesignatedcourt,afteranalyzingallthematerialincludingoral
anddocumentaryevidenceandtheindependentwitnesses,rightlyconvictedhim."
Theother10givendeathsentencewereZakirHussainNoorMohdShaikh,AbdulKhanakaYakubKhanAkhtarKhan,FirozakaAkramAmaniMalik,Mohd
MustaqMoosaTarani,AsgarYusufMukadam,ShahnawazAbdulKadarQureshi,MohdShoebMohdKasamGhanasar,AbdulGaniIsmailTurk,ParvezNazir
AhmedShaikhandMohdFarooqMohdYusuf.
Thebench,however,wasquicktoaddthatlesserpunishmenttothecoaccusedwouldnotbetreatedasaprecedent."Thelessersentenceonthese10appellants
cannotbeaprecedentinothercasesandeverycasemustbedecidedaccordingtotheirfactsandcircumstances,"itsaidandclarifiedthatlifesentencemeantthe
convicthastospendhisrestofthelifeinprisonsubjecttothepardoningandremissionpowersofthePresidentorgovernorofastate.
ImmediatelyafterdemolitionofBabriMasjidonDecember6,1992,TigerMemonandDawoodIbrahim,thenlivinginDubai,plannedaterrorstrikeinMumbai.
DawoodsentarmsandammunitionfromabroadanditwasreceivedbyTigerMemon,whoalsosentsomeoftheaccusedpersonstoDubaiandfromthereto
Pakistanfortraininginhandlingofarmsandammunition.
OnMarch12,1993,inaspanofabouttwohoursbetween1.33pmto3.40pm,aseriesof12bombexplosionstookplaceoneaftertheotheratBombayStock
Exchange,KathaBazaar,SenaBhawan,CenturyBazaar,MahimCauseway,AirIndiaBuilding,ZaveriBazaar,HotelSeaRock,PlazaTheatre,JuhuCentaurHotel,
AirPortBay54andAirPortCentaurHotel.Intheblasts,257peoplewerekilled,713injuredandpropertyworthRs27croredestroyed.

ThegrimdevelopmentisparfortheundulatingcoursewhichDutt'slifehasfollowed,takinghimthroughbleakphasesofdrugaddiction,deathofmotherandwife
duetocancer,imprisonmentandanilladvisedpoliticalcameoinAmarSingh'scompanyaswellastherecentpurplepatchmarkedbytheMunnabhaifranchise.
Ashestaresatanotherspellinjail,thepossibilityofDuttstagingacomebackcannotberuledoutasthegrittysonofNargisandSunilDutthasshowntenacityto
fighthiswaythroughadversity.
BarelyamonthafterserialblastsshookMumbaionMarch12,1993,DuttwasarrestedonApril19,1993fromMumbaiairportonhisarrivalfromMauritius.The
SupremeCourthadgrantedhimbailonOctober16,1995.HewasagaintakenintocustodyafteraTADAcourtsentencedhimtosixyearsimprisonmentinJuly
2007.However,theSupremeCourtagaingrantedhimbailinAugust2007.
DuttwasaccusedofbeingpartofthecriminalconspiracybehindtheMumbaiserialblastsand,"duringtheperiodfromJanuary1993toApril1993,agreedto
illegallykeepinhispossessionthreeAK56riflesanditsammunition,one9mmpistolanditscartridgesandhandgrenades,whichwerepartoftheconsignment
smuggledintothecountrybyDawoodIbrahimandhisassociatesknowingthattheseweresmuggledintothecountryforthepurposesofcommittingterroristacts".

deliveredthreeAK56riflesand250roundsofammunitionandsomehandgrenadesatDutt'sresidence.OnJanuary18,1993,outoftheabovethreeAK56rifles
andammunition,tworiflesandsomeammunitionweretakenawaybycoaccusedpersonsincludingMansoorAhmed."
