CONSTITUTION AND BY - LAWS
PREAMBLE
We, the undergraduate students of Batangas State University, imploring the
aid of Almighty God, desirous in establishing a democratic representative
Supreme Student Councils Confederation and will create an environment that
will unite and uplift the diverse condition of the whole student body, secure
the blessings of autonomy and independence, promote and protect students
rights and welfare, recognize mutual understanding by means of open
communication and consensus, instill an effective link between students,
faculty, administration and other sectors of the University in order to foster
strong academic community and national consciousness, attain inclusive and
greater opportunities and development towards initiative, accountability,
integrity and self-governance in accordance with the core values and ideals of
the University do hereby declare and promulgate this constitution.
ARTICLE I
GENERAL PROVISIONS
Section 1 This Constitution and By Laws shall be known as the
Constitution and
By Laws of Batangas State University
Supreme Student Councils
Confederation.
Section 2

The Supreme Student Councils Confederation with the aid of the


Supreme Student Council of each Campus as mandated by the
students
shall be the official representation of all bona fide
students of all the
campuses of Batangas State University in
pursuing their rights, welfare
and concerns.
Section 3 The Supreme Student Councils Confederation may adopt a logo
for the
organization which shall all be truly reflective and
symbolic of the ideals,
principles and culture of the whole
student body. Such amendments
shall take effect only
upon its ratification by the studentry in a general
assembly/referendum.
Section 4 For the purposes of this Constitution and By Laws, the
following words
used shall have meaning as ascribed to them
in this section.

Constitution and By Laws, CB-L means the constitution of


Batangas State University Student Councils as
amended from time to
time.

University signifies the Batangas State University.
BatStateU refers to the official and registered abbreviated
form of
Batangas State University.

4.4.1 VPAA refers to Vice President for Academic Affairs;

SSCC, SSC Confederation refers to the Supreme Student
Confederation.
SSC refers to the Supreme Student Council.
The Supreme Student Councils Confederation shall be the
highest student government, which is, comprised of the
Executive Council, Consultative Council and the General
Assembly.
ARTICLE II
NAME AND DOMICILE

Section 1 The government of the student body of Batangas State


University shall
be known as the Supreme Student Councils
Confederation which shall
hereinafter be referred to as
the SSCC / SSC Confederation.
Section 2

The office of the SSCC shall be located at Batangas State


University Gov. Pablo Borbon Campus I.

ARTICLE III
DECLARATION OF PRINCIPLES, POLICIES AND OBJECTIVES
Principles
Section 1

1.1

The SSCC shall have the power which emanates from the
student body. It shall be sole, unified, autonomous and highest
democratic representative student government.

1.1.2 Fiscal Autonomy
The SSCC shall exercise control over its financial matters
accordance with related guidelines.

Power resides in the students and all student leaders emanates


from
them. Internal school regulations that concern the
students shall be
subject to their consent through their duly
elected representatives.
Section 2 The SSCC shall uphold and adhere with the ideals (vision,
mission, goals,
objectives and core values statement) of
the University geared towards
ensuring
a
physical,
intellectual, spiritual, social, political and academic
development of the students.
Section 3 The Norms of Conduct for College Students provided by the
OSAS shall
serve as guide and basis of the SSCC in working to
serve the best
interest of the student body.
Section 4 The SSCC believes that all decisions should be arrived at in a
democratic
manner through open communication and
consensus as a valuable
decision making tool. The will of the
majority shall always prevail
without infringing on the right of the minority.
Section 5 The SSCC believes in the principle of collective leadership,
participatory
democracy,
responsible
servant

leadership, accountability and

Section 7 The SSCC believes that there should be amicable ties with
other schools,
universities and organizations nationwide
and abroad.
Section 8 The SSCC believes in the development of the individual
students
potential to effect change which can be
achieved by advancing and
defending his/her rights and
welfare.
Section 9 The SSCC believes in academic freedom as a prerequisite to a
scientific,
nationalist and mass oriented education and the
development of the
BatStateU student as a total person.
Section 10 The SSCC believes that education is a right and definitely not a
privilege.
Section 11 The SSCC believes that at all student leaders should remain at
all times
faithful to the office he/she is serving.
Section 12 The SSCC believes in the independence of SSCs, College
Student Councils, University Based Organizations, as mandated
by the students, shall be the official representative of all bona
fide students of their respective campuses, colleges, groups in
pursuing their rights, welfare, concerns, aptitudes, interests,
talents and abilities.
Section 13 The SSCC recognizes the importance of different student
groups in the
university which includes the Performing
Arts, Varsity, Reserve Officer
Training
Corps,
Students
Publication, Cultural Groups, Political Parties
and other groups established not contrary to the provisions of
this
Constitution.
Section 14 The SSCC is founded with the principles of representation,
participatory
democracy, decentralization, collaboration,
equitability, accountability,
unity and cooperation and
efficiency and efficacy in the delivery of
services.
Objectives
Section 1

The SSCC shall actively participate in the formulation,


implementation and evaluation of school policies on matter

affecting the student body through a representation in the
Board of Regents.
Section 2

The SSCC shall act as the pillar of all Supreme Student Councils
within the Batangas State University systems. Thus, shall
provide a forum for the ventilation of the student queries,
problems and needs.

Section 3 The SSCC shall serve as a mediator between the student body
and any
sectors of the BatStateU community in case of
differences.
Section 4 The SSCC shall be the forefront of student rights and welfare,
and shall
be the model of the students excellence,
grounded on good character,
and deep sense of moral
values.

Section 4

The SSCC shall remain at all time, accountable and transparent


with all of its transactions involving the interest of its
constituents who they must serve with utmost responsibility,
integrity, loyalty, efficiency and professionalism.

Section 5

The SSCC shall strive to pursue an independent stand, not


dictated by any other sector, other than the students, as long
as these are not contrary to the Mission, Vision, Goals,
Objectives and Core Values statements of the University.

Section 6 NON DISCRIMINATION POLICY. The council shall not


discriminate, and
shall discourage discrimination on the basis
of ancestry, citizenship, creed,
economic background or status, ethnic identity, gender
expression, gender identity, intellectual and physical disability,
national origin, philosophy, political affiliation or ideology, race,
religion, sex or sexual orientation. In adhering to this policy. The
Council will not advocate the restriction of any ones freedom of
public speech, assembly, expression or association.
Section 7 The SSCC shall help advocate and promote programs for
Gender Equality,
Sensitivity and Development, Environmental
Promotion and Protection,
Bullying in all forms, and other programs supported by the
University.
ARTICLE IV
DUTIES AND RESPONSIBILITIES OF THE SSCC
Section 1

The SSCC shall employ its own governing laws as may be


provided by this constitution with the consent of the academic
community.

ventilation of ideas in the campus and the provision of
necessary avenues

The SSCC shall adopt and implement a student education and


entrepreneurial

scholarship,
financial
assistance and other
affirmative action program to
assist financially challenged but deserving
students.

ARTICLE V
MEMBERSHIP AND CONTRIBUTION
Section 1

All SSC officers of BatStateU shall be the members of SSCC.

paying member.
ARTICLE VI
BILL OF RIGHTS

The SSCC, in reference with the Norms of Conduct for College Students shall
adopt the Bill of Rights of Students stated therein. However, this section is
subject for amendment if some provision related to the Bill of Rights of
Students from the Norms of Conduct for College Students was revised,
updated or amended.

ARTICLE VII
DUTIES AND RESPONSIBILITIES OF STUDENTS
The SSCC, in reference with the Norms of Conduct for College Students shall
adopt the Duties and Responsibilities of Students stated therein. However,
this section is subject for amendment if some provision related to Duties and
Responsibilities of Students from the Norms of Conduct for College Students
was revised, updated or amended.
ARTICLE VIII
THE SUPREME STUDENT COUNCILS
Section 1 The Supreme Student Council established in every Campus
shall be
governed by its own Constitution and By Laws
and shall be guided
with the provisions declared by this Constitution in which they
are
autonomous in management and implementation of its
programs and
activities.
Section 2 The SSCs shall be the highest governing body of the students
of each
campus. It shall have the power which emanates
from the students.
Section 3 All elected President of each SSC shall be automatically
member of the
SSCC Consultative Council.
Section 4

The SSC shall serve as an effective link of the SSCC to the


students, faculty, administration and other sectors of the
University.

Section 5

The SSC shall coordinate its plans, programs and activities with
the Office of Student Affairs and Services (OSAS) at all times.

Section 6

Copies of respective Constitution and By Laws and


accomplishment and financial report at the end of first and
second semesters shall be forwarded and submitted to the
SSCC for records purposes.

Scholarships shall:

8.1. Manage the Student Financial Assistance, Loans and

Section 9

The Secretary shall:

9.1.

Record and keep the minutes and narrative reports of the


proceedings of the council or assembly.
9.2. Prepare communications pertaining to the activities of the
council or the
assembly and coordinate with the public
information officer for its
dissemination.
9.3. Perform such other duties of the President that the council may
delegate to him.
9.4. Prepare the accomplishment report at the end of every
semester.
9.5. Keep an inventory and take charge of all SSCC properties.
9.6. Perform such other acts as may be required of him by the
Council or
Assembly.
Section 10 The Auditor shall:
10.1. Audit financial transactions made by the treasurer and require
production of supporting documents.
10.2. Certify to the legalities of the expenses incurred by the council.
10.3. Assure that the approved guidelines in the decentralization of
SSC Fund
is properly observed and strictly implemented.

and the
Assembly.

ARTICLE X
THE CONSULTATIVE COUNCIL
Section 1

The Consultative Council is composed of the President of each


Supreme Student Council.

Section 2 The powers, duties and responsibilities of the Consultative


Council shall
be:
2.1. To legislate rules and regulations of student nature.
2.2. To appear on the presentation of the activities and the budget
proposed
by the Executive Council.
2.3. To act on the grievances, requests and recommendations
presented by
the student body.

Carry out, support and promote the Mission, Vision, Goals and
Objectives of the SSCC and the University as well.
2.5. Discuss matters affecting each SSC and recommend solutions
and
actions.
2.6. Prepare guidelines, rules and regulations affecting the Council
and the
student body.
2.7. Review, amend and exercise jurisdiction in settling actual
controversies
involving
the
interpretation
of
the
Constitution and By laws of the
SSCC.
ARTICLE XI
THE GENERAL ASSEMBLY
Section 1 The General Assembly refers to the gathering of all its
members to
discuss pertinent matters concerning students rights and
welfare, endorsement of programs and activities of the
administration inclusively intended for the student body etc..
Section 2

The General Assembly shall be a forum for information and


consultations, from which decisions shall be significantly
considered.

ARTICLE XII
COMMISSION ON STUDENT ELECTIONS

The Commission on Student Election hereinafter referred to as


(ComSElec) which shall have the exclusive power

functions which maybe conferred upon by its own
Confederation Election Code.

ARTICLE XIII
ELECTION, QUALIFICATIONS AND TENURE OF OFFICE OF THE SSCC

Section 1 The officers of the SSCC are the duly elected President, Vice

Resource Management,
Student Development, Student Rights
and Welfare, Student Financial
Assistance,
Loans

Scholarships, Secretary and Auditor.
Election
Section 2 The elections shall be conducted annually by the authorize
members of
the ComSElec. The election procedures shall be
conferred upon by the
Confederation Election Code of the
ComSElec.
Section 3 The election shall be done during the first week of March. In
case of
conflict with the University calendar, the subject
matter shall be decided
upon by ComSElec.
Section 4

The manner of election shall be by secret balloting system.

Section 5 A maximum of seven (7) officers of each campus shall be
allowed to vote.
Qualifications
Section 6
6.1.

For Presidency he/she:


Must be a bona fide student of the Batangas State University.
6.1.1. Must be the duly elected officer of his/her respective

SSC.
6.2. Must be a resident of the University for at least two years.
6.3. Must be a non-graduating student at the time of the election
period.
6.4. Must have a General Weighted Average of at least 2.75 and
has no any
deficient subject during the last term attended and
enrolled with an
academic load of at least 18 units during
the electoral period and the
succeeding semesters or as
prescribed by their curriculum.
6.5. Must not have any failing grade from the preceding term.
6.6. Must have a certification of good moral character duly issued
by the
Office of Student Affairs of his respective campus.
6.7. Must be a non OJT student for the next academic year.
Section 7

For Vice Presidency, Auditor and Secretary he/she:

7.1.

Must be a bona fide student of the Batangas State University.


7.1.1 Must be a SSC officer of his/her campus
7.2. Must be a resident of the University for at least one for fouryear course
and two years five-year course.
7.3. Must be a non-graduating student at the period of the election.
7.4. Must have a General Weighted average of at least 2.75 and
has no any
deficient subject during the last term attended and
enrolled with an
academic load of at least 18 units during
the electoral period and the
succeeding semesters or as
prescribed by their curriculum.
7.5. Must not have any failing grade from the preceding term.
7.6. Must have a certification of good moral character duly issued
by the
Office of Student Affairs of his respective campus.
Section 8

The secretary possessing the qualifications mandated by this


constitution shall be appointed by the duly elected President.

Section 9 Any elected SSCC Officer shall not hold any position in the
student
publication otherwise; s/he must resign from the
student publication
where s/he is involved.
Section 10 All duly elected SSCC shall automatically resign their post in
any
organization, except SSC in their respective
campus.
Tenure of office
Section 11 The induction of council members shall take place within a
month after
their proclamation by the ComSElec, the oath to
be administered by the
University President or his duly
authorized representative.
Section 12 Every member of executive council shall hold office for one (1)
academic
year.
Section 13 The term of Office of all SSCC Officers shall commence on the
first day of the Academic Year and will end on the last day of
the month before the starting of the Academic Year. No SSCC
officer shall be entitled for re- election.
Turn over
Section 14 All existing resolutions, codes, guidelines and policies
consistent with
this Constitution shall remain operative until amended,
repealed or revoked.
Section 15 All remaining funds, files, documents, records, supplies,
facilities,
properties and other assets of the SSCC
under the custody of the
incumbent officers shall be
properly turned over to the succeeding
officers.
ARTICLE XIV
ADVISER
Section 1

SSCC

The SSCC Adviser shall be endorsed to the Director of Student


Affairs and Services from among the three (3) regular full time
faculty nominees submitted by the newly elected SSCC
Officers through a resolution.
The term of the SSCC Adviser shall be coterminous with the
Executive Council.

Section 4

The SSCC Adviser shall have the following qualifications:

4.1. Have experience in organizational management;


4.2. With good character and reputation in the school and

Section 2 All SSCC Elected Officers may be removed from office, on

for, and conviction of, culpable violations of

betrayal of public trust.

The following may be the grounds for impeachment:

3.1. Any willful violation of this Constitution and By Laws.


3.2. Gross negligence of duties and responsibilities.
3.3. Incurred three (3) consecutive absences on the announced

for all discussion and will be given an opportunity to defend
him/herself to the assembly.

filled, within ten (10) school days from the day the
position is rendered
or considered vacant, by the appointment of the President from
among the qualified members of the SSCC. Immediately upon
appointment, the appointee shall serve the remaining period.
Section 17 The ComSElec shall certify as to the vacancy occurring in the
SSCC and
the SSCC Adviser shall certify the fact of
appointment of the officer to
the vacant position.

ARTICLE XVII
FUNDS AND FISCAL CONTROL
Section 1 The Supreme Student Councils Confederation fund will be
collected,
disbursed and properly accounted by the elected
officers specifically by
the Vice President for Finance and
Resource Management under the
strict supervision of the President and the other members of
the organization using the guidelines indicated by the
constitution.
Funds and Monetary Control

elected Supreme Student Councils Officers specifically by the
Treasurer under the strict supervision of the President and the
other members of the organization using the guidelines

their campus; there will be a standard
receipt that will be issued for the
students
that
will
identify their payment at the Registrars office. (The
payment cut-off is every 5:00 PM after the officer had their tally with
the
number of the students who paid that day and the total
amount of
collection.)

Section 11 The provisions of this section are parallel and aligned with the

Section 14 Automatically, as part of the procedures, there will be an

auditing that will be made after recommendation of the person
to audit by the University Official(s).
Section 15 The final result of the auditing process will be endorsed

Accountability of the Officers
Section 17 In cases where the officer/s of the SSC and the Confederation
exhibited
act/s in any form of misconduct such as bribery,
graft and corruption,
malversation of funds, etc. which
exhibits damages on the portrayed
image of the councils
are subjects for impeachment proceedings as
stipulated
in the Article XVI Accountability of Officers. (The
Constitution and By Laws of the SSC Confederation and the
Norms and Conduct for College Students (NCCS) provides the
provisions regarding the aforementioned matter.)

ARTICLE XVIII
AMENDMENTS AND REVISIONS
Section 1 The amendment and the revision of the Constitution may be
made
through a motion proposed in the form of a draft
constitution by a
member of the SSCC Executive Council
and/or Consultative Assembly,
subject to the approval of the
two thirds (2/3) or majority of its
(Executive
and
Consultative Council) members entitled for one vote each
through a constitutional assembly organized by the SSCC Officers and
an
amended copy shall be sent to each campus.
ARTICLE XIX
SEPARABILITY CLAUSE
Section 1 In case one or more sections of this Constitution and By Laws
have been
declared null and void by any competent authority, no
other section,
provision or part thereof shall be affected
and the same shall remain in
full force and effect.
ARTICLE XX
EFFECTIVITY
Section 1 The amendments/revisions on this Constitution and By Laws
shall take
effect immediately after ratification by majority of
casted votes from the
SSCC Officers and afterward be
presented to the University President.
The
ratification
shall not exceed sixty (60) days after the adoption of this
constitution.
The above stated proposed Amended Constitution of Supreme
Student Councils Confederation by the SSCC Constitutional
Convention of 2016 on the 24th day of January, Two Thousand and
Sixteen and accordingly signed a month after the said amendment
at the SSCC Office, Batangas State University, GPB Main Campus I,
Rizal Avenue, Batangas City by the delegated whose signature are
affixed in a separate resolution adopting the same.

A RESOLUTION APPROVING THE PROPOSED 2016 SUPREME
STUDENT COUNCILS CONFEDERATIONS CONSTITUTION AND BY
LAWS.
WHEREAS, Supreme Student Councils Confederation (SSCC) is defined as
the highest and independent governing body of the students of Batangas
State University;
WHEREAS, the SSCC Officers saw the need to amend its own Constitution
and By Laws;
WHEREAS, as provided by Section 1 of Article XII entitled as General
Provision of the 2009 SSCCs Constitution and By Laws The proposed
amendment presented in a written form may only be amended by
agreement of at least 2/3 of all SSC members through a general assembly
organized by the SSCC Officers and an amended copy shall be sent to each
campus.
WHEREAS, the Supreme Student Councils Confederation approved the
motion to convene a Constitutional Convention to draft and approve a
proposed constitution;

WHEREAS, the proposed constitution and by laws shall hereinafter be
referred to as the 2016 Amended Supreme Student Councils Confederations
Constitution and By Laws;
WHEREAS, the Constitutional Convention called for the purpose of
amending a constitution and by laws for the Supreme Student Councils
Confederation hereby approves the said document;
NOW THEREFORE RESOLVED, AS IT HEREBY RESOLVED, that the
Amended 2016 Supreme Student Councils Confederations Constitution and
By Laws was approved by the members of the SSCC on 24 th day of
January, Two Thousand and Sixteen at the Lecture Room 1, International
