ANALYST'S NOTE: House Bill 382 will broaden the list of veterinarian non-disciplinary violations to
include situations where Board Statues or rules have been violated but there is not a public safety
concern.
Point No. 10: Does it directly or indirectly create or increase penalties for victimless crimes or for
non- violent crimes? Conversely, does it eliminate or decrease penalties for victimless crimes or
non-restorative penalties for non-violent crimes?
ANALYSIS: House Bill 382 eliminates mandatory disciplinary action when the infraction is a
victimless crime and not a threat to public safety. Additionally, it will provide the
opportunity for the State Board of Veterinary Medicine to provide a more appropriate
resolution. An example of a non-disciplinary action would be failure to correctly fill out
paperwork. (0)1

1 It may be worth noting that the language on Page 2, lines 12-18 in which felony charges are pending against a
licensee, could be troubling in that it is rather subjective. A better approach would be to identify specific felony
charges that one might reasonably conclude should exclude a person from the alternative disciplinary action.

AMENDMENT: The amendment to House Bill 382 provides that only the liaison officer can offer an alternative
to discipline. This amendment does not change the score.
