UVU Safety iint! Production Guidelines


Most safbty on the set is just common sense, but in the pressures of filmmaking common sense often gets thrown to the
wind. Every film must have a safety meeting every day filming takes place outlining the potential dangers for the day'
and mentioning precautions that need to take place to avoid problems. This car be an intbrmal five minute meeting
between the assistant director ard film department heads [DP, sound, director, art). Often this meeting is part of a larger
production planning meeting that takes place every morning outlining the shot list shooting schedule tbr the day. You
need to conduct this sat'ety meeting everyday that you film, even if only briefly and intbrmally. Generally, danger on
the set comes from the following areas and you should take precautions accordingly. Normally, the Assistant Director
is the safety enlorcement officer on the set.
GENERAL CAUSALITY
This involves unsatb placements of sets, props, equipment, and cables so people trip and injure themselves
unnecessarily. The prop master should give a daily report as to that day's props and any and all hazardous threats
related to the same . Any sharp edged props (including knif'es) should be handled with great care. Horseplay should
never be tolerated at any time while cast and crew are present on the set. No person should be coaxed into handling any
prop that causes them concern.

ELECTRICAL HAZARDS
Since large amounts ofelectricity are used for lights - the danger ofblowing out circuits, overloading circuits and even
starting a tire or electrocuting someone are always a hazard. Your tighting person should be fhmiliar with capacity
limits and saf-e procedures tbr drawing and using electricity. If you are using more than two 650 uatt bulbs or one 1000
watt bulb on a single home electrical circuit, you zrre in danger of blo*ing out the circuit. There may be several wdl
plugs on one circuit - so don't just assume each wall plug is a separate circuit. A normal home has about five different
circuits, but this can vary. Become familiar with where the circuit breaker box is. or have extra fuses for the circuits.
Power should be tumed offwhen plugging or unplugging high wattage equipment. To unplug any equipment, always
grab the plug tirmty and pull, do not grab the cord.

FIRE HAZARDS
Placing powerful lights near flammable materials (e.g. curtains) for several hours on end can cause a hre. People
smoking (including in film smoking) on a set with scattered paper and flammable materials and set dressing around can
cause a fire. You should have a small fire extinguisher present on all sets. Obviously using a fire in the film (e.g.
campfire or part of a set burning) can be a hazard.

ANIMALS
Snakes and deadly animals can be a hazard on the set and you need to have an exotic animal handler on the set to work

with these- Rates per day for such people (who will often bring their o\rn animals) may ftmge liom $500 on up.
Ordinary household animals need to be treated satbly on the set or there could be legal action from the Humane
Society. Ifyou are doing anything other than very ordinary shots ofeven household pets on a set, the Humane Society
likes to be notified so they can be on the set. Make sure you have a place for the animals to rest apart out ofthe sun and
away from the cror,l'ded set where they could get hurt Have plenty of water and food for them.

CHILDREN, THE ELDERLY, AND THE DISABLED


Special precautions need to be made with children on the set to keep them from hazards that adults would normally
avoid. That is why a parent or guardian must be with them at all times. Minors can only be filmed so long without
having a break (usually inth..2-4 hour range depending on age). Also, special precautions need to be made on the set
for the elderly and disabled. Again this is common sense, but it is more likely that an unbalanced elderly person might
trip over power cables running everywhere than a grip. Passage from one part of the set to another may be impeded for
a disabled person. Preparations need to be made for these contlngencres.

STTINTS

Even what are considered normal actions in everyday life can be considered stunts in filmmaking; e.g. tripping. And
in performing your script, an actor attempts a minor fall and hurts themselves, you could be liable. Any stunts, even
minor ones need to be planned out and rehearsed so no one is hurt. Larger stunls should only be performed by licensed
stuntmen and only after very careful preparation and rehearsal. Fights should be carefully rehearsed so no one gets hurt
and should be staged by a professional stunlman. Truly dangerous stunts: falling liom buildings, car crashes. car hits,
death deling stunts, etc. should not be attempted in your short tilm.

DRTVING AND MOVING SHOTS


Careful preparation needs to be made for any moving shot. All trafFrc laws must be fbllowed, and the person driving the

ifit is an actor on camera) should never be distracted by too much direction or while he or she is
driving. Any moving shot on a public slreet requires a permit obtainable through the Mayor's Office and olten requires
police ollicers to be present. If a sizable number of crew are present on the street (e.g. more than trvo) during filming it
can create a distracting hazard to other motorists and cause accidents. This is why permits are required. Also, blocking
car (especially

a shot is not allowed unless police olficers are present. The production team needs to make sure shots are
planned out and rehearsed in advance so an accident knocking down heavy equipment does not happen.

OTHERHAZARDS
These will vary tiom lllm to film and you need to use corrmon sense to spot these. For example, if you are filming in
high places, you need to take precautions that all actors or crew are not put injeopardy offalling. Filming at night
presents its own hazards in terms ofpeople not seeing potential hazards early enough. You need to brainstorm potential
threats on the set and be prepared for them - e.g. rope offsections ofthe set to cast and crew when not in use. Be
careful in having a lot of guests on the set. Since they will be least fhmiliar with what you are doing they potentially
will stumble into the most danger. The sal'est thing is to close the set to guests; but lf you do have guests, assign one
crew member responsible for looking alter them

FIRST AID
The Assistant Director (or designated saf'ety offrcer) should have directions and phone numbers to the nearest
emergency room to all locations that the crew will be lilming. There should be a basic first aid kit on every set. These
are easily obtainable at most drug stores. There should be one person on the set who has some first aid training
designated as the first aid person who can see if a minor injury or medical condition that arises can be dealt with on the
set or if it needs immediate medical attention.

PERMITS & LOCATIONS RELEASES


Each location will require a sr'gned location release to be included in the production documents. Technically, permis
are required by the city for ALL locations (including filming in your own home) to insure that if any'thing the
filmmakers are doing is unsafe that they city can shut down the film shoot immediately. The only place permits are not
required are when a shoot is on the lot ofa registered film studio back lot or soundstage. Generally however, local
authorities will not check permits unless you are filming with a large crew and a lot of vehicles in a location where you
are creating "an attractive bazard" to automobile traffrc flow, or pedestrians on the streets, sidewalks. or in public
places where an accident could occur. YOA MAY NOT STOP TRAFFIC WTHOaT PERMITS AND A CREW

MEMBER TIUT IS CERTIFIED IN TRAFFIC CONTROL.


COMMON SENSE
Most of what has been said above is common sense. And if you apply common sense, anticipate possible dangers. do
all possible preparation to avoid them, and hire licensed professionals when the risk factor and state law requires it, you
should not get into trouble. Everyone on the set is responsible for safety. Don't let a driven director or producer push
anyone to do something that is unsaf'e. Any member of cast or crew who anticipates a danger on the set, or sees an
actual hazard should immediately report it to the Assistant Director or designated saf-ety oflicer on the set

Good films can be made in a week, but there are some limits to making a film in weekend, and doing it safely. You
may not be able to do everything just as the budget will limit you somewhat, so will the time limits on safety prep limit
you to making films that may not have some riskier shots in them. You need to be aware of and accept these to run a
sal'e set.

in accordance with the Immigration Reform and Control Act of 1986 and other applicable laws. Any offer: of
employment to Employee is conditioned upon satisfactory proof of applicant's identity and legal ability to work in
the United States.

guaranteed for a minimum period of one week and prorated thereafter in accordance with applicable collective
bargaining agreements. There is no other guarantee of the period of serrrices. All "ffavel only" and idle days shall
be paid at their rninimum guaranteed compensation or allowance as provided for in the applicable collective
bargaining agreements, if any.

Employee acknowledges that the production is not responsible for the theft, loss and/or damage of Employee's
personal propefty or box rental items.

All results and ptoceeds of Employee's services will

be deemed to be a work made for hire specially commissioned


by and for Producer within the meaning of the copyright laws of the U.S. or any similar or analogous law or statute
of any other jurisdiction. Accordingly, Producer will be the sole and exclusive owner of the Results for all purposes,
including, but not limited to, all copy'ights to the Results (and any renewals or extensions thereot) together with the
right to exploit the Results in the Program and otherwise in connection with the distribution, exhibition, advertising
and exploitation of the Program or any part of the foregoing in any and all media and by any and all means, now
known or hereafter devised, throughout the universe in perpetuity.

Employee acknowledges that this picture may be the subject of "behind the scenes" photography, which may be
used in connection with the exhibition, distribution, advertising, publicity, promotion and./or other exploitation of the
picture and hereby consents to such photography and use of the Employee's name, voice or likeness therein without
any further compensation to Employee and hereby consents to such usage.
Employee agrees not to participate directly or indirectly in the dissemination of information concerning Producer or
the Program to individuals or entities, including without the limitation, texting, blogging by Employee or otherwise,
or the use of social networking seryices including without limitation, Twitter, MySpace, Facebook and the lke
without the Producer's prior written consent in each instance.

If Producer breaches this Agreement, Employee's sole remedy will be an action at law for money damages. In no
event will Employee be entitled to seek injunctive or other equitable relief nor will Employee have the right to
enjoin the production, exhibition, or other exploitation of the Program. Furthermore, Employee rvill; not have the
right to terminate the rights granted under this Agreement or rescind this Ag eement by reason of such breach. This
Agreement constitutes the entire understanding between Producer and Employee with respect to the subject matter
of this Agreement and cannot be modified except by a written amendment signed by the parties.

used in connection with the exhibition, distribution, advertising, publicity, promotion and/or other exploitation of the
picture and hereby consents to such photography and use of the Employee's name, voice or likeness therein without
any further compensation to Employee and hereby consents to such usage.
Employee agrees not to parlicipate directly or indirectly in the dissemination of information concerning Producer or
the Program to individuals or entities, including without the limitation, texting, blogging by Employee or otherwise,
or the use of social networking services including without limitation, Twitter, MySpace, Facebook and the like
without the Producer's prior written consent in each instance.

If Producer breaches this Agreement, Employee's sole remedy will be an action at law for money damages. In no
event will Employee be entitled to seek injunctive or other equitable relief nor will Employee have the right to
enjoin the production, exhibition, or other exploitation of the Program, Futhermore, Employee will; not have the
right to terminate the rights granted under this Agreement or rescind this Agreement by reason of such breach. This
Agreement constitutes the entire understanding between Producer and Employee with respect to the subject matter
of this Agreement and cannot be modified except by a written amendment signed by the parties.

services hereunder me subject to the ternrs and conditions of any applicable collective bargaining agreement and
in accordance with the Immigration Reform and Control Act of 1986 and other applicable laws. Any oflcr of
employment to Employee is conditioned upon satisfactory proof of applicant's identity and legal ability to worft in

the United States.

If a daily rate is indicated, services

are for a minimum period of one day. If a Weekly rate is indicated, services are
guaranteed for a minimum period of one week and prorated thereafter in accordance with applicable collective
bargaining agreements. There is no other guarante ofthe period of services. All "travel onlt'' and idle days shall
be paid at their minimum guaranteed compensation or allowance as provided for in the applicable collective
bargaining agreements, if any.

Employee agrees that no sixth (6s) or seventh (76) day, holiday, forced call or overtime prior to call or after wrap
be paid unless authorized in advance by the UPM.

Employee acknowledges that the production is not responsible for the theft, loss and/or damage of Employee's
personal property or box rental items.

All results

and proceeds of Employee's services will be deemed to be a work made for hire specially commissioned
by and for Producer within the meaning of the copyright laws of the U.S. or any similar or analogous law or statute
of any other jurisdiction. Accordingly, Producer will be the sole and exclusive owner ofthe Results for all purposes,
including, but not limited to, all copyrights to the Results (and any renewals or extensions thereof) together with the
right to exploit the Resuhs in the Program and otherwise in connection with the distribution, exhibition, advertising
and exploilation of the Program or any part of the foregoing in any and all media and by any and all means, now
known or hereafter devised, tlroughout the universe in perpetuity.

Enrployee aclurowledges thatthis picture may be the subject of "behind the scenes" photogmphS which may be
used in connection with the exhibition, distribution, advertising, publicity, promotion and/or other exploitation of the
picture and hereby consents to such photography aild use of the Employee's name, voice or likeness therein without
any further compensation to Employee and hereby consents to such usage.

Employee agrees not to participate directly or indirectly in the dissemination of information concerning hoducer or
the Program to individuals or entities, including without the limitation, texting, blogging by Employee or otherwise,
or the use of social networking services including without limitation, Twitter, MySpace, Facebook and the like
without the Producer's prior writren consent in each instance.

If Producer breaches this Agreement Employee's sole remedy will be an action at law for money damages. In no
event will Employee be entitled to seek injunctive or other equitable relief nor will Employee have the right to
enjoin the production, exhibition, or other exploitation of the Program. Furlhermore, Employee will; not have the
right to terminate the rights granted under this Agreement or rescind this Agreement by reason of such breach. This
Agreement constitutes the entire rmderstanding between Producer and Employee with respect to the subject matter
of this Agreement and cannot be modified excpt by a written amendment siped by the parties.

Dear Ladies and Gentlemen:

1. I, the undersigned owner or agenL whichever is applicable, hereby irrevocably grants to [uVt{ ("Producer"),
and its agents, employees, contractors and suppliers, the right to enter and remain upon and use the property, both
real and personal, located at: 12203 Cariage ln. Holladay, UT 841 I 7l (the "Property"), including without
limitation, all interior and exterior areas, buildings and other structures of the Property and owner's name, logo,
trademark, service mark and/or slogan, and any other identiffing featrues associated therewith or which appear in,
on or about the Property, for the purpose of photographing (including without limitation by means of motion
picture, still or videotape photography) said premiseso sets and structues and/or recording sound in coilnection
with the productiorl exhibition, advertisiog and exploitation of the [Short Film] tentatively entitled fNoel] (the
"Pictufe").

2. Producer may take possession of said premises commencing on or about [March 15, 2016] subject to change
because of weather conditions or changes in production schedule, and continuing until the completion of all
scenes and work required.

3. Charges: As complete and full payrnent for all of the rights granted to Producer hereunder, koducer shall pay

charges are payable on completion of all work completed, unless specifically agreed to the contrary. Producer
is not obligated to actually use the property or produce a [Short Film] or include material photographed or
recorded hereunder in the Picture. Producer may at any time elect not to use the Property by giving Owner or
agent24 hours written notice of such election, in which case neither pafi shall have any obligation hereunder.

4.

Producer may place all necessary facilities and equipment, including temporary sets, on the Property, and
agrees to remove same after completion of work and leave the Property in as good condition as when received,
reasonable wear and tear from uses permitted herein excepted. Sips on the Property may, but need not, be
removed or changed, but, if removed or changed, must be replaced. In connection with the Picture, Producer may
refer to the Property or any part thereof by any fictitious name and may attribute any fictitious events as occurring
on the Property. Owner irrevocably grants to Producer and Producer's successors and assigns the right, in
perpetuity, throughout the universe, to duplicate and recreate all or a portion ofthe Property and to use such
duplicates and recreations in any media and./or manner now known or hereafter devised in connection with the
Picture, including without limitation sequels and remakes, merchandising, theme parks and studio tours, and in
connection with publicity, promotion and/or advertising for any or all of the foregoing.

5. Producer agrees to use reasonable care to prevent damage to the Property and will indemnify and hold Owner
harmless from and against any claims or demands arising out of or based upon personal injuries, death or property
damage (ordinary wear and tear excepted), suffered by such person(s) resulting directly from any act of
negligence on Producer's part in connection with the work hereunder.

6. All rights of every nature whatsoever in and to all still pictures, motion pictures, videotapes, photographs

and
sound recordings made hereunder, shall be owned by Producer and its successors, assigns and licensees. and
neither Owner nor any tenant, or other party now or hereafter having an interest in said property, shall have any
right of action against Producer or any other party arising out of any use of said still pictures, motion pictures,
videotapes, photographs and or sound recordings, whether or not such use is or may claimed to be, defamatory,

untrue or censurable in nature. In addition, neither Owner nor any tenant, nor any other party now or hereafter
having an interest in the Property, shall have any right of action, including, but not limited to, those based upon
invasion of privacy, publicity, defamation, or other civil rights, in connection with the exercise of the permission
and/or rights granted by Owner to Producer. If there is a breach by Producer hereunder, Owner shall be limited to
an action at law for monetary damages. In no event shall Owner have the right to enjoin the development,
production, distribution or exploitation of the Picture.

7. Force Majeure: If because of illness of actors, director or other essential artists and crew, weather conditions,
defective film or equipment or any other occurrence beyond Producer's control, Producer is unable to start work
on the date designated above and/or work in progress is intemrpted during use of the Property by Producer, then
Producer shall have the right to use the Property at a later date to be mutually agreed upon and/or to extend the
period set forth in Paragraph 2, and any such use shall be included in the compensation paid pursuant to
Paragraph 3 above.

8. At any time within six (6) months fiom the date Producer completes its use of the Property hereunder,
Producer may, upon not less than five (5) days prior written notice to Owner, reenter and use the Property for
such period as may be reasonable necessary to photograph retakes, added scenes, etc. desired by Produeer upon
the same terms and conditions as contained in this agreement.

9.

Owner warrants neither he or anyone acting for him, gave or agreed to give ary.thing of value, except for use
of the Property, to Producer or anyone associated with the production for using said Property as a shooting

location.
10.Owner represents and warrants that he/she is the owner and/or authorized representative of the Property, and
that Owner has the authority to grant Producer the permission and rights granted in this agreement, and that no
one else's permission is required. If any question arises regarding Owner's authority to grant the permission and
rights granted in this agreement, Owner agrees to indunrnifu Producer and assume responsibility for any loss and
liability incurred as a result of its breach of the representation of authority contained in this paragraph, including
reasonable attorneys' fees.

1l lf there is a dispute between the parties, Owner's remedies will be limited to an action at law for money
damages, and in no event will Owner have the right to seek injunctive or equitable relief or to otherwise eqioin the
production distribution, marketing or exploitation of the Picture.
This agreement constitutes the entire understanding between the parties, supersedes any prior understanding
relating thereto and shall not be modified except by a writing signed by the parties.

To the Producer:

I, the undersigned owner or agent (collectively. "Owner") hereby acknowledges that the Property as
referred to in the LOCATION AGREEMENT between Producer and Owner dated [DATE INDICATED
ON LOCATION AGREEMENT], (the "Agreement") has been returned to Owner in substantially the
same condition as it was in prior to Producer's use thereof:
Owner hereby acknowledges that:

no additional restoration work is required in connection with the Property;

Owner and any individual who entered the Property at the invitation or on behalf of
Owner, suffered no personal loss or damage in connection with the use of the Property by
Producer; and

Producer has no other responsibilities in connection with the Property other than to continue
to hold Owner harmless from any and all third-party suits, claims, or loss or liabilities
directly resulting from Producer's use of the Property.

Owner hereby releases and forever discharges Producer, its parent. subsidiary. affiliated and associated
companies and its and their officers, employees and agents, and their successors and assigns of and from
any and all claims, debts, demands, liabilities, obligations, costs, expenses, damages, actions and causes
of action of whatsoever kind or nature, whether known or unknown, which Owner has ever had, now has
or which Owner or any of its successors or assigns hereafter can, shall or may have against Producer
based on or arising out of, relating to or in connection with the Agreement.
Producer may assign, transfer, license, delegate andlor grant all or any part of its rights, privileges and
property hereunder to any person or entity. This Agreement shall be binding upon and shall inure to the
benefit ofthe parties hereto and their respective heirs, executors, administrators, successors and assigns.
This Agreement and Owner's rights and obligations hereunder may not be assigned by Owner.
