PLEASE TAKE NOTICE that, upon the annexed Declaration of Elizabeth A.

McNamara, sworn to on December 23, 2015, and the exhibits annexed thereto, the
accompanying memorandum of law and all other pleadings and proceedings, Defendants Rolling
Stone LLC, Sabrina Rubin Erdely, and Wenner Media LLC will move this Court, before the
Honorable P. Kevin Castel, on a date and time to be set by the Court, for an order dismissing
Plaintiffs Second Amended Complaint with prejudice for failure to state a claim for relief under
Rule 12(b)(6) of the Federal Rules of Civil Procedure, and for such other and further relief as to
this Court shall seem just and proper.
PLEASE TAKE FURTHER NOTICE that, under the Courts November 13, 2015
Order, Plaintiffs answering papers, if any, shall be filed and served no later than January 27,
2016, and Defendants reply papers, if any, shall be filed and served no later than February 10,
2016.
