FIRST Email Follow-Up:

I want to follow up on a response to our demand package. As you know, we'd like to
engage
in settlement negotiations or early mediation. Attached you will find a list of
proposed private
mediators* in case your client is amenable to mediation. If you'd like to speak to
the attorney handling
this file, please call and ask for Della Shaker.
Thank you in advance for your attention to this matter.
SECOND Follow-up, provided that no response was received:
This is a follow up to my email below. Have you had a chance to discuss
it with your client? Please let us know if your client is interested to attend mediation
and if so,
please let us know if you are agreeable to using any of our proposed mediators
see attached.
Thank you in advance for your attention to this matter.
THIRD/FINAL follow-up, provided that no response was received:
Please know that your repeated disregard to our follow ups had
led us to believe that your clients are not taking this matter seriously.
As such and as indicated in our previous demand letter, we are ready,
willing and able to file the Complaint for the above-titled case.
Nevertheless, in fear of unwittingly doing our clients a complete
disservice by failing to exhaust potential early settlements, we are sending
this email as our last and final attempt of amicably resolving this matter.
We want to know if [DEFENDANT COMPANY] is amenable to mediate and if so,
please let us know if you are agreeable to using any of our proposed mediators - see
attached.
And if your clients have no interest in resolving this matter through early mediation
or negotiation,
we would appreciate the professional courtesy of letting us know.
Thank you in advance for your attention to this matter.
Best regards,
