Egg Shell Skull Rule- final aspect of remoteness of damage

- as long as the damage or injury is reasonably foreseeable, it does not matter that the
extent of damage suffered by the Pf is unusual or unforeseeable that it is lesser or greater
than an ordinary person would suffer
-it means the Df must take their victims as they find them
- victim is particularly vulnerable or has a pre-existing condition, Df is responsible for the
full extent of injury
- Page v Smith
Application
- Jack who has a previously undiagnosed thin skull, hit the head and suffers severe brain
damage
- by applying the Egg Shell Skull Rule, Daud has to take Jack, his victim, as he finds Jack
- it in immaterial at all whether Jack has a pre-existing condition
- Daud has to be responsible for the full extent of injury Jack suffered in the accident
