This Agreement is made effective for all purposes in all respects as of _______________ (current date) by and

between Shannon Pressler Photography, hereinafter referred to as the PHOTOGRAPHER and

___________________, hereinafter referred to as The CLIENT relating to ___________________ (name of
event) on _________________ (event date), hereinafter referred to as The EVENT(S).
ENTIRE AGREEMENT: This agreement contains the entire understanding between the PHOTOGRAPHER
and the CLIENT. It supersedes all prior and simultaneous agreements between the parties. The only way to add
or change this agreement is to do so in writing, signed by all parties. In the event that any part of this
agreement is found to be invalid or unenforceable, the remainder of this agreement shall remain valid and
enforceable. Any agreement to waive one or more provisions of this agreement or any failure by one or both
parties to enforce a provision of this agreement shall not constitute a waiver of any other portion or provision
of this agreement.
EVENT SCHEDULE (If Applicable): The client agrees to confirm the schedule three days prior to the
EVENT(S). Notification of any changes in schedule or location must be made before the cancelation grace
period of 48 hours before the EVENT(S), otherwise a $15 (fifteen) cancellation fee is due.
SAFETY: The PHOTOGRAPHER reserves to right to terminate coverage and leave the location of the
EVENT(S) if the PHOTOGRAPHER experiences inappropriate, threatening, hostile or offensive behavior
from person(s) at the EVENT(S); or in the event that the safety of the PHOTOGRAPHER is in question.
SERVICE TIME / ADDITIONS: The CLIENT and the PHOTOGRAPHER agree that cooperation and
punctuality are essential to accomplish the goals and wishes of all parties. Photography services commence at
the scheduled start time and ends at the scheduled end time. If the CLIENT does not arrive at the appointed
time for the EVENT(S), the PHOTOGRAPHER will wait fifteen (15) minutes. If the CLIENT arrives before
15 (fifteen) minutes has passed the shoot will commence under the specified time frame with full
compensation. If the CLIENT does not show up after 15 (fifteen) minutes, the PHOTOGRAPHER reserves the
right to leave and a $30 (thirty) no-show fee is due. All additional time beyond the scheduled end time will be
billed to the CLIENT.
The CLIENT and the PHOTOGRAPHER hereby agree that the EVENT(S) are to be scheduled in one (1) hour
increments. The CLIENT will be billed each hour on the hour and the PHOTOGRAPHER will work within
that timeframe. The CLIENT and the PHOTOGRAPHER agree that the CLIENT will be billed for 1-hour
increments, even if the EVENT(S) run shorter than 1-hour increments. For example: if the PHOTOGRAPHER
is only required for 45 minutes, the CLIENT will still be billed for one (1) hour.
RESPONSIBILITIES: The PHOTOGRAPHER is not responsible for compromised coverage due to causes
beyond the control of the PHOTOGRAPHER including but not limited to obtrusive guests, lateness of the
CLIENT or guests, weather conditions, schedule complications, incorrect addresses provided to the
PHOTOGRAPHER, rendering of decorations, acts of God, or restrictions of the locations. The
PHOTOGRAPHER is not responsible for backgrounds or lighting conditions which may negatively impact or
restrict the photo coverage. The PHOTOGRAPHER is not held liable for missed coverage of any part of the
EVENT(S). The PHOTOGRAPHER will not be held accountable for failure to deliver images of any
individuals or any objects at the EVENT(S).

MODEL RELEASE: The CLIENT hereby assigns the PHOTOGRAPHER the irrevocable and unrestricted
right to use and publish photographs of the CLIENT or in which the CLIENT may be included, for editorial,
trade, advertising, educational and any other purpose and in any manner and medium; to alter the same without
restriction; and to copyright the same without restriction. The CLIENT releases all claim to profits that may
arise from use of images.
The photographs taken by the PHOTOGRAPHER are hereby permitted for use in the PHOTOGRAPHERS
personal portfolio or selection of images for any manner and medium as specified by the PHOTOGRAPHER.
The CLIENT hereby releases all legal rights and restrictions upon the photographs taken by the
PHOTOGRAPHER in terms of PHOTOGRAPHERS personal use.
LIMIT OF LIABILITY: In the unlikely event that the assigned PHOTOGRAPHER is unable to perform to
the guidelines of this contract due to an injury, illness, act of God, act of terrorism, or other cause beyond the
control of the PHOTOGRAPHER, the PHOTOGRAPHER will cancel the shoot with no fees due, and
reschedule if possible at a discount of 50% (fifty) off of the original rate.
In the unlikely event that digital files have been lost, stolen, or destroyed for reasons beyond the
PHOTOGRAPHERs control, including but not limited to camera, hard drive, or equipment malfunction, the
PHOTOGRAPHER liability is limited to the return of all payments received for the EVENT(S). The limit of
liability for a partial loss of originals shall be a prorated amount of the exposures lost based on the percentage
of total number of originals. The PHOTOGRAPHER is not liable for the loss of images beyond the lesser of
the final delivery of all products included in the package or one year.
CAPTURE AND DELIVERY: The PHOTOGRAPHER is not liable to deliver every image taken at the
event. The determination of images delivered to the CLIENT is left to the discretion of the
PHOTOGRAPHER.
All images, edited or otherwise, delivered to the CLIENT will be delivered through digital means; most often
in the form of a Google Drive Folder. Should the CLIENT request delivery of images on a CD or USB drive in
addition to the Google Drive Folder, the CLIENT will be billed an additional twenty (20) dollars.
The PHOTOGRAPHER and the CLIENT agree that the client has full rights to every image. The
PHOTOGRAPHER will include every selected original image along with a folder of edited images, which will
amount to (but not always exactly) 10%-25% (ten to twenty-five) of the original photos. If further editing is
requested, there will be a fee of $3 (three) an image. However, the CLIENT has full rights to further edit how
they please.
POST PRODUCTION AND EDITING: The final post production and editing styles, effects, and overall
look of the images are left to the discretion of the PHOTOGRAPHER unless otherwise specified in agreement
with the PHOTOGRAPHER and CLIENT. The PHOTOGRAPHER and the CLIENT agree that upon selection
of images by the CLIENT, the PHOTOGRAPHER has a week (7 days) from the date of selection to edit the
images.
PAYMENT SCHEDULE: The full balance is payable in full prior to or one (1) week after the EVENT(S).
After one (1) week, the PHOTOGRAPHER will bill the CLIENT an additional sum ($10) for each day the
CLIENT is late in rendering payment, unless prior agreement is worked out between the CLIENT and the
PHOTOGRAPHER. In the event the CLIENT fails to remit payment as specified, the PHOTOGRAPHER shall
have the right to immediately terminate this agreement without further obligation, and retain any monies
already paid.

If payment is not rendered within one (1) month of the EVENT, and attempts to make payment or work out a
payment schedule are not made, the PHOTOGRAPHER reserves the right to revoke access to the images. Any
images used by the CLIENT are no longer considered the property of the CLIENT and must be removed from
all properties owned by the CLIENT (including but not limited to: website, social media, advertising or
promotional materials). If payment is not rendered, the copyright claim of the images reverts to the
PHOTOGRAPHER and any use by the CLIENT will be considered infringement of copyright, with the full
legal and financial ramifications.
Additionally, the PHOTOGRAPHER reserves the right to contact the appropriate authorities about refusal of
payment or use of unlicensed images.
The CLIENT and the PHOTOGRAPHER, upon signing this document, confirm that they are fully aware of the
rights and responsibilities afforded to them by this Agreement. The signing of this Agreement signifies full
agreement with and responsibility to adhere to all clauses and obligations of both parties as specified in this
Agreement.
