Petitioner, through
respectfully alleges that:

1. Petitioner is of legal age, married, and a Muslim Filipino residing in


Purok _____, Iligan City where she may be served with summons and other
court processes; and Respondent is also of legal age, married to Petitioner
and residing in the same house with Petitioner where he may also be served
with summons and other court processes.
2. Respondent married Petitioner on April 12, 2016 at Elena Tower Inn
Hotel in a ceremony held according to Shariah Muslim Rites as officiated by
Imam ____.
3 That the respondent failed to provide support, financially and
emotionally, to the petitioner outsetting shortly after the marriage. Hence,
the respondent was unfit to perform the essential marital obligations
mandated to be observed with each spouses.
4. That the respondent, in fact, has been abstaining from having carnal
relation with the petitioner despite of the latter's non - menstrual period
(Thur) and despite, further, for the purpose of conceiving a child but still

herein that he was impelled to go with the marriage and continued its
subsistence on account of his parent's wishes and that initially he never

WHEREFORE, premises considered, petitioner prays of this Honorable
Court that judgment be rendered as so shall be ordered that:
1. The marriage between Petitioner Ibrahim Unos and Respondent
Rocma Diribaten be
declared severed.
2. That an order be issued confirming the validity of Petitioners Tafwid
by virtue of Art. 51 of the Muslim Code of the Philippines.
3. That the marriage certificate of Petitioner and Respondent issued on
April 12, 2016
and kept with the Shariah Circuit Courts Register be
cancelled
4. Petitioner wishes to have the mahr remain lawfully with her, on
account of her financial well-being.
5. Other just and equitable remedies under the circumstances.
