This is a petition for certiorari to set aside the order of the respondent judge

denying the motion to dismiss the complaint and on the ground that respondent
judge acted without or in excess of the courts jurisdiction.

FACTS:
The ground for motion to dismiss filed by the petitioner is
that the complaint of the respondents does not state facts sufficient to
constitute a cause of action, because the plaintiff has no right to
demand payment of the defendants alleged debts until after
termination or legal cessation of the moratorium no. 32 but said
motion to dismiss wa denied.
Petitioner filed a petition for certiorari before the Supreme Court.

ISSUE:

Whether or not the respondent judge acted without or in excess

of courts jurisdiction.

RULING:

Executive Order no. 32 did not have the effect
