Appellee, Marie R. Cote, filed a complaint in January, 1984, against the Union
and her former employer, the James River Corporation, alleging causes of
action under the Age Discrimination in Employment Act of 1967, 29 U.S.C.
Sec. 621, et seq. (ADEA) and the Civil Rights Act of 1964, 42 U.S.C. Sec.
2000e et seq., (Title VII). Prior to bringing this action, Cote had filed a
complaint with the Equal Employment Opportunity Commission (EEOC)
alleging illegal discrimination for having been passed over for promotion. The
Union was not named as a party in this complaint. After reviewing the
complaint in the lawsuit, the Union's counsel notified Cote's attorney that the
court had no jurisdiction over the Union in this matter, because it had not been
named as a party in her administrative action. When the plaintiff's attorney did
not act upon this information, the Union filed a motion requesting that the
claim against it be dismissed on these grounds.
