To whom it may concern,

In response to your statement dated, June 19, 2016, concerning the actions of your
Deputy Police Commissioner Joseph Spiezio.

As Acting Police Commissioner and a member of the Thomas Administration, I
assume you understand the penalty of making false official statements. A false
report is a crime governed by federal and state laws, involving a person who, with
intent to deceive, knowingly makes a false statement that is material to the criminal
investigation of a crime.

Our organization is in possession of the full audio of the confrontation between
alleged Deputy Police Commissioner Spiezio and Councilman Wallace. What we
have on audio and what you have described in your official statement is
contradicting.

Even if your claim had validity, which it does not, a Deputy Police Commissioner,
Joseph Spiezio actions are unbecoming of any law enforcement officer. No
professional would call anyone a fag or cross dresser in the capacity of Deputy
Police Commissioner and it is evident from the full audio that Acting Police
Commissioner Fatigue stood by and allowed his Deputy to go out of control.

How can Mr. Spiezio be Deputy Police Commissioner and have a carting company in
the same city? You are aware that Competition Carting, R&S Waste Services LLC are
own by Mr. Spiezio? It is also clear from the video that Mr. Spiezio was not working
in his capacity of a Deputy Commissioner he was responding as the owner of the
two companies. Are you aware that per the City Charter that is a conflict of interest?

Article 4, Section 19 Restrictions; Officers Not To Be Interested In Contracts
No member of the City Council or other officer or employee of the City, or person
receiving a salary or compensation from funds appropriated by the City, shall be
interested directly or indirectly in any contract to which the City is a party, either as
principal, surety or otherwise; nor shall any such member of the City Council, City
officer or employee or person, or his partner, or any agent, servant, or employee of
such officer, employee or person, or of the firm of which he is a partner, purchase from
or sell to the City, or any officer thereof, any real or personal property for the use of the
City, or any board or officer thereof, nor shall he be interested directly or indirectly in
any work to be performed for, or services rendered to or for it, or in any sale to or from
said City, or to any officer, board or person in its behalf. Any contract made in violation
of any of these provisions shall be void.

You are also aware that as Acting Police Commissioner you have a sworn duty to
uphold the laws of the city, the state Constitution and the Constitution of the United
States. It is clear that there is a pattern and practice in the Thomas administration to
disregard the law when it comes to its officials.

We will be forwarding all our findings to county, state and federal authorities and
requesting a further investigation into the facts of your Deputy Police
Commissioner, Joseph Spiezio making apparent physical threats to an elected
official.

As we discuss the gang problem amongst our youth in Mt. Vernon, it seems clear
before we solve the little gang problem we must confront, control and eradicate the
criminal gang that has taken control or our police department.
