AFFIDAVIT OF DESISTANCE

We, RUBINA S. MUSTAPHA and PARIDO M. MANIBPEL, of legal ages,

Filipino, single and married, respectively, and both residents of Buluan,
Maguindanao, after having been duly sworn in accordance with law, hereby
depose and say:
That we are the complainant in a traffic incident on March 12, 2009 that
resulted to a loss of life of ZENAIDA MANIBPEL, daughter of herein affiant
PARIDO M. MANIBPEL;
That sometime on March 12, 2009, on or about 11:00 AM., the deceased
ZENAIDA MANIBPEL rode on a motor vehicle of SKYGO Make and with plate
no. ____ 7011 driven herein by affiant RUBINA S. MUSTAPHA for the purpose of
going to Koronadal City;
That upon reaching New Ilolio, Tantangan, South Cotabato, a Honda motor
vehicle with plate no. MG 5962 which was driven by ____________________
and wherein passenger Mrs. Shirley Cordova was riding apparently going also to
Koronadal City, collided with the former motor vehicle;
That we found out that the aforementioned incident was due to the fault of the
driver of Honda vehicle, thus, a clear case of reckless imprudence resulting to
homicide;
In view of the foregoing, we manifest our intention for amicable settlement to
finally end to a foreseeable litigation, civilly or criminally, thus, pronouncing our
disinterest in prosecuting the aforementioned case, and thereby desist from
pursuing the same before any tribunal, board or court;

legal age, married and residents of San Enrique, Iloilo City, after having duly sworn to in

1. That we personally know spouses RAMON CABILITASAN and
CONSORCIA BARBA, for being our close family friends;
2. That we are witnessed to the fact that RAMON CABILITASAN and
CONSORCIA BARBA were married on December 10, 1946 in Pototan, Iloilo City;
3. That we have personal knowledge of the fact that the said marriage was
registered with the Office of the Local Civil Registrar of the said place;
4. That we know for a fact that during World War II several offices were burned
and among those were the Office of the Local Civil Registrar of Iloilo City and National
Statistics Main Office;
5. That we surmised that all the records thereat were also razed by fire;

4. That the said card was given to the school as a requirement for her enrolment
thereat;
5. That upon my request for retrieval of the said card, it was no longer to be
found;
6. That a diligent inquiry and search was made to locate the missing card but all
our efforts prove futile as it is now beyond recovery;
