Tuwein Kamilya Muhammad who was earlier reported to have been


executed in Somalia, is alive, well and a free woman. The mother of
three was reunited with her family in Sharjah, United Arab Emirates
after a 74-day horric nightmare in Kenya, Somali and Ethiopia.
And she announced that legal action will be taken against the Kenyan
government for her illegal detention at the hands of the terror police.
She was released last week from a secret Ethiopian detention facility
where she was repeatedly questioned by American intelligence personnel. Kamilya was never charged with any crime, and was found
innocent of all the accusations made against her in the three countries.
Her business Associate Millie Muthoni Gakuo said in February that
Kamilyas family had received unconrmed reports stating that she
was executed by Somali henchmen after her deportation by the Kenya government. They were both detained with two Omani businessmen, Ahmad Musallam al Mashaani and Hassan Salim Kashub.

Kenyas role in Somali renditions

Kenya played a shameful role in a secret detention program for


people who had ed the recent conict in Somalia, a human rights
watchdog said. The individuals were held with no regard to legal procedures and in clear violations of charters embodied in Kenyan and
International law.
In a letter to the foreign ministry, New York-based Human Rights
Watch (HRW) accused Kenya of playing an active role in the arbitrary detention, expulsion and enforced disappearance of dozens of
individuals who ed the ghting between the Union of Islamic Courts
and the joint forces of the Transitional Federal Government (TFG)
and Ethiopia from December 2006 through January 2007. Each of
these governments has played a shameful role in mistreating people
eeing a war zone, said Georgette Gagnon, deputy Africa director of
Human Rights Watch.
In its research, the rights body said, Kenyan security forces arrested
at least 150 individuals from 18 different nationalities at the Liboi and
Kiunga border crossing points with Somalia. The individuals were
later then transferred to Nairobi where they were detained incommunicado and without charge for weeks. The government went on
to facilitate foreign intelligence agencies to interrogate some of the
detainees, said the rights body.
At least 85 people, some of them Kenyan nationals were then secretly
deported from Kenya to Somalia in what appeared to be a joint rendition operation of the TFG, Ethiopia and the US governments. For

Madrassas, a thorn in the esh of the Americans

They have been described by top US policy makers as breeding


grounds for terrorism. The 9/11 commission, in its nal report last
year, branded madrassas as the worst incubators for violent extremism.
Yet even with these hard hitting remarks, the United States embassy
is involved in a programme which ostensibly aims at supporting
madrassas in the country. What could explain these?
The strategy is part of the soft weapon programme as described
by Margaret Tutwiler, the former undersecretary of state for public
diplomacy and public affairs.
After repeated missteps since the 9/11 attacks, the U.S. government
embarked on a campaign of political warfare unmatched since the
height of the Cold War. From military psychological-operations teams
and CIA covert operatives to openly funded media and think tanks,
Washington is plowing tens of millions of dollars into a campaign to
inuence not only Muslim societies but Islam itself. The result has
been an extraordinary--and growing--effort to inuence what senior
policy makers describe as an Islamic reformation.
The White House approved a classied new strategy, dubbed Muslim
World Outreach, that for the rst time states that the United States
has a national security interest in inuencing what happens within
Islam. Because America is, as one ofcial put it, radioactive in the
Islamic world, the plan calls for working through third partiesso-

called moderate Muslim nations, foundations, and reform groups-to promote what they say is shared values of democracy.
In at least two dozen countries, Washington has quietly funded Islamic radio and TV shows, coursework in Muslim schools, Muslim
think tanks and political workshops.
According to a senior CIA ofcial, the agency is receiving an exponential increase in money, people, and assets to help it inuence
Muslim societies.
U.S. ofcials are working quietly through third parties to train madrasah teachers to add English language, math, science, civics,
and health to their curriculum, according to US News. In a bold
move to inuence the direction of Islam, Washington since 9/11 has
quietly funded a variety of projects that promote a so-called moderate interpretations of the Quran.
Ultimately, the programme aims to weed out what they say are
radical teachings from the Quran and the teachings of Prophet
Muhammad (peace be upon him) taught in madrassas. It is these
teachings which are blamed on the rising of extremism and fundamentalism among Muslims.
In May 2003, the Bush administration announced an education
initiative to focus on education in Islamic communities. Kenya was
one of the ve African countries selected to participate in the new
Islamic Education Initiative.

It was a nightmare from start to nish, she said, We cried the whole
time because we did not know what would happen. The whole thing
was very scary, she said recounting her ordeal.
She revisited her journey to Kenya where she dreamt of making it big
in the tea trade.
That dream however, turned into a nightmare when soon after she arrived in Malindi a contingent of 15 heavily armed anti-terrorism police
ofcers raided the Eden Rock hotel had her arrested together with
Gakuo and the two Omani businessmen.
They were taken to Mombasa before being driven to Nairobi where
they were held at Kileleshwa police station. Upon arrival, a police ofcer greeted them: Welcome, Al Qaeda.
She spoke of a ghastly attempt by the police to have them strip naked and have their photographs taken but the women atly refused
though the two men were forced to comply.
To regain their freedom, an ofcer who she identied as Kilonzo asked
for US$5,000 but she refused insisting that she were innocent.
On January 25, the two Omanis were released after it emerged that
they belonged to the Omani royal family. Two days later, Millie was
released and dumped near Ambassador Hotel in the city centre at
3am.
Early in the morning on the same day, three men escorted the 42year-old mother in a small jeep to the border town of Namanga where
they intended to deport her to Tanzania. But Tanzania authorities refused to take her insisting that though her passport indicated that she
was born in Zanzibar, Kamilya was a UAE citizen. She was later to
learn that Immigration minister Gideon Konchellah signed her deportation papers saying that she was a most dangerous person and
her presence in the country was a threat to national security. Despite
efforts, from the Kenyan National Human Rights Commission to rescind the ministers decision as she was innocent, the government
refused to relent on its position.
She was later taken to Jomo Kenyatta international Airport where she
met other detainees who included 22 women and more than 10 children all Muslims. I refused to get on that plane without my passport, and asked them where the plane was going to, she said. They
then kicked her legs out from under her and two of the men hit her
with nightsticks.
Like other detainees, she was handcuffed and hooded and own to
Somalia. Ethiopian authorities, who had taken control of Mogadishu,
placed the detainees in a makeshift holding cell, which had recently
been bombed. The only food and water given to them was macaroni
and a jerry can of water handed out in a bucket.
She spent ten days in Mogadishu before she was own to Ethiopia
on February 6 and immediately after her arrival she was subjected
to questioning by US intelligence personnel. On March 23 she was
released and two days later she ew back to Dubai to an ecstatic
welcome of her family who had spent more than two months in anx-

ious moments.
Writing to Kenyan authorities, her brother Sabri said not only have
her human rights been abused, she has been denied even the most
basic rights of any individual as a suspect. On March 27, a Swedish
detainee, 17-year-old Saa Benaouda, was also freed from Ethiopia.
She was among those deported by Kenyan authorities. She is exhausted, her face is yellow and shes lost about 10 kilograms, her
mother, Helena Benaouda, a 47-year-old Muslim convert who heads
the Swedish Muslim Council, wrote on a Web site she set up to help
secure her daughters release. She was beaten with a stick when
she demanded to go to the toilet.

American embassy where issues to do with furthering the American

recent meeting took place on February 27 this year where more than
30 members of the association led by Sheikh Abdallah Mbwana attended.
During the eight hour long visit, members were given an orientation
tour of the embassy, a preserve which is rarely given out in the heavily fortied and security sensitive diplomatic mission.
Among those who attended the meeting were embassy spokesperson Robert Kerr.
Ambassador Michael Reinneberger was expected but for unknown
reasons did not attend the meeting.
A pledge was made to involve Al-Wahda in the Ambassador Self Help
Project where the association will benet from grants to initiate development projects.
In one of the visits, questionnaires seeking information on the activities of madrassas were distributed by embassy staff to Al-Wahda
members.
These meetings come under a backdrop of harassment and vicitmisations of of Muslims especialy in the wake of the conict in Somalia
which led to the arrest by the government of more than 100 people
and their subsequent deportation to the war torn country in an operation the Americans were privy to.
Taken to task over the issue, Sheikh Abdallah Mbwana denied that
his party to the programme though he conrmed that some members of Al-Wahda were involved in the programme with the Americans. He referred The Friday Bulletin to the programme coordinator
Zaid Abdallah who we failed to reach.

Islamic Banking

Perspectives

The importance of banking institutions in any economy cannot be


over emphasized. Banks, both directly and indirectly, play a role in
the distribution of resources that can be devoted to adding to the real
capital of a nation. Banks, among other nancial institutions, play
an important role in mobilizing savings and investing them in specic
processes of capital formulation. (Siddiqqi,1997 p.12). Their being
Part of the nancial systems, makes them central to a signicant
amount of nancial transactions.
In Kenya, towards the end of the year 2000, these institutions came
under attack for being interested in short-term goals and not long-term
goals. They were accused of retarding economic growth through high
interest rates and restrictive lending and were blamed for the suffering that they have caused Kenyans. The Daily Nation of 27-11-2000
reported Attorney General, Amos Wako, joined the chorus condemnation against rates charged by the banks. The high interest rates
have retarded economic growth through restrictive lending Mr. Wako
said But he added, other means to deal with the problem should
be found instead of introducing interest rate controls. This was a
response to the Donde Bill which sought to peg interest rates to
the Treasury Bill, meaning the cost of borrowing is likely to halve from
around 30 per cent to 15 per cent (DN 24-11-2000 p2)
Kabete MP, Mr. Paul Muite, in his contribution to the debate on regulating the interest rates charged by banks is quoted as saying, Kenyans have suffered enough in the hands of the major banks. The
nancial institutions are only interested in short-term prots and not
long-term goals. (DN 29-11-2000 )
In all the discussions on the Donde Bill, no proposal was made towards abolition of the interest-based system nor was an alternative to
the system offered. This is so, because the world economic activities
are resting on a concept taken for granted that interest is inevitably
thebasis for the movement of capital. Interest for many in the world
today has occupied a central role in their economic well being. This
assumption has been central to the workings of interest based nancial institutions acting as nancial intermediaries.
The struggle for the establishment of interest-free banks in Kenya
has taken more than fteen years. On 15th June 2006, the Minister
of Finance, Hon. Amos Kimunya in his budget speech proposed to
amend the Banking Act to allow Islamic Banking.
The dealing in interest has been banned and prohibited by Islam in
the strongest and harshest words possible. Indeed not only Islam but
even Christianity and Judaism have prohibited the dealing in interest.
Nadhif Jama in his write-up on The Rise and Rise of Islamic Banking quotes Hanson D.G, in explaining that the dealing of interest was
considered unchristian. Throughout the middle ages in this country
(Britain), the lending of money at interest was considered unchristian
and was forbidden to the Englishmen, some of whom were hanged
for the offence. The taking of interest was stigmatized with the name
usury Nadhif further explains that Hanson conrms that the taking
of interest on loan was made legal in the U.K. by King Henry VIII in
the year 1545.
It was and is still assumed in certain quarters that the prohibition in
dealing in interest is no longer viable and that the establishment of
interest free banking systems is impracticable and unworkable.
To the contrary, to date, there are fully edged banks in the world operating on interest free basis and can be found on all continents with
London, Copenhagen, Bahrain, Kuala Lumpur, Istanbul and Geneva
being the leading countries for structured interest free based banking transactions. Three countries, Pakistan, Iran and Sudan, have
gone far with programmes of eliminating in total interest from their
nancial systems. Malaysia in March 1993 launched her interest free
banking scheme which is running parallel to the interest based banking scheme.
This exposition highlights the general working of interest free banks
as an alternative to conventional banking, which is interest based.
The discussion opens with a delineation of the substance of banking
institutions, interest free banking, interest and prot. This delineation

is followed by a discussion on the prohibition of dealing in interest by


the Qur,an, the Sunnah of the Prophet Muhammad (PBUH) and the
Bible.
With that as the background, the discussion moves on to the state of
play, reected through the operations of interest free banks, a brief
discussion of prot as an equitable alternative to interest, and the
legal structures of Kenya, specically the Banking Act and the Central
Banking Act.
This paper does not in any way make a claim of discussing all aspects
of interest-free banking. Emphasis is laid on those aspects of Interest free Banks operations that offer an alternative to interest based
operations of conventional banks.
Prohibition of dealing in Riba (Interest)
Riba as explained earlier is an Arabic word which literally means increase, addition, excess, rise, expansion or growth. In the Shariah,
Riba technically refers to the premium that must be paid by the borrower to the lender along with the principal amount as a condition for
the loan or for an extension of its maturity. In this sense, Riba has the
same meaning and import as interest in accordance with the consensus of all the fuqaha (jurists) without any exception.
It may be observed that the words Usury and Interest have been
adopted in some english translation of the Qur an, in translating the
Arabic word Riba. Some of the translators who adopted the word
Usury in translating the word Riba eventually to clarify in their commentary that Riba literally is usury and interest. Of late the word Riba
is maintained in the English translation of the Holy Qur an due to the
inability of the english words usury and interest to capture the full
meaning of the word Riba as used in the Shariah.
Types of Riba
The term Riba is, however, used in the Shariah in two senses. The
rst is Riba al-nasiah and the second is Riba al-fadl.
Riba al nasiah
The term nasiah comes from the root word nasaa which means to
defer, postpone or wait and refers to the time that is allowed for the
borrower to repay the loan in return for the addition or the premium.
Hence Riba al nasiah refers to the interest on loans. It is in this sense
that the term Riba has been used in the Quran in

This is also the Riba that the Prophet Muhammad (PBUH) referred to
when he said, There is no Riba except in nasiah (waiting) Narrated
by Usamah ibn Zayd and reported by Bukhari, Muslim and Ahmad
The prohibition of Riba al-nasiah essentially implies that xing in advance of a positive return on a loan as a reward for waiting is not
permitted by the Shariah . There is no difference of opinion among the
scholars of Islam on the prohibition of Riba al nasiah .
All eminent Muslim Scholars and jurists through out history have never differed on the fact that bank interest is a form of Riba which Islam
has banned. Efforts of some Pseudo- Jurists to distinguish between
Riba and bank interest and to legitimize the latter, claiming that it is
usury that has been prohibited, met with almost universal rejection
and contempt.

While President Mwai Kibaki after his recent trip to Saudi Arabia called for
Middle East businessmen to come and invest in Kenya, Mombasa politician Hassan Joho Hassan is advising Arabs not to visit the country citing
growing risk of harassment. Joho said in the present situation where many
Muslims were being hounded on terrorism allegations, it would be unwise
for Arabs to visit the country as their foreign nationality would generate more
suspicioun about their activities. I dont advise Arabs or Muslims to go to
Kenya, as these terror arrests have escalated since the start of the conict
in Somalia. Kenya is not a welcoming destination these days, he told a
weekly United Arab Emirates tabloid Xpress.
The politician pointed to a case last year where three Arab tourists from the
United Arab Emirates were hounded by the terror police on alleged links to
terrorism. It was only after his personal intervention that they were saved
from what would have been a gruesome ordeal.
The same sentiment were echoed by a Nairobi businesswoman Millie Muthoni Gakuo who was arrested in Malindi while in the company of three
Arab investors. Though Kenya has been good in the past, with the way its
treating people now, I would not advise anyone to come here and be mistreated and deported to a war-torn country like Somalia.

serious breach of their due process rights. For Kenyan citizens, such action
could effectively render them stateless, a serious violation of international
law, HRW pointed out.
Furthermore, it expressed concerns that the deportees faced a serious risk
of torture and other mistreatment at the hands of the Transitional Federal
Government of Somalia and the Ethiopian authorities.
The rights body urged the Kenyan government to call on Ethiopia and the
TFG to acknowledge the individuals detained in their respective countries
and permit international access to independent monitors. Additionally,
it called on the government to undertake immediate efforts to secure the
prompt return to Kenya of its nationals who were illegally deported as well
as the foreign nationals who were Kenyan residents.
Human Rights Watch insisted that the treatment of those arrested was in
violations of international protocols to which Kenya was a signatory. The
detainees who were alleged to include supporters of the Union of Islamic
Courts and Al Qaeda, were entitled under Kenyan and international law to
be protected from torture and other mistreatment under all circumstances
and at all times, it stressed.
Basing on eyewitness and rst-hand accounts, Human Rights Watch said
the police denied many detainees access to family members, legal counsel,
diplomatic representatives, and representatives of human rights groups, including members of the Kenyan National Human Rights Commission. On
a number of occasions, family members inquired at police stations where
they had reasonable grounds to believe their relatives were held, but police
ofcials deliberately misinformed them, and told them their relatives were
not held at that location.
Also, several credible witnesses were reported being questioned and sometimes threatened by members of US or other national intelligence services.

IMPORTANT ONGOING ACTIVITIES


1.YOUTH SECTION:Ummah Foundation Youth Development Programme is currently working on a number of activities and projects. Inspired
by the important role and position of the youth in the society; indeed the fact that youth constitute a critical segment
and continue to play pivotal roles in the society cannot be
denied and is best captured and enunciated by both the letter and spirit of the entire corpus of the Millennium Development Goals. Part eight (8) of the MDGs is succinct to develop
and implement strategies for decent and productive work for
the youth. Finding the means and generating the requisite
political will and the know-how to create a billion jobs over
the next ten years remains a principal objective and target
of the Millennium Development Goals. This in all measurements entails supporting young entrepreneurs especially in
the developing countries with education, nancial mentorship
and encouragement through supportive social and political
environment. Echoing this noble call, Ummah Foundation
Youth Development Programme-Income Generating Activities (IGAs) Project is designed ostensibly to pursue similar
aims and objectives. The following is a brief prole of the programme.
i). Youth Income Generating Activities:-This programme began
in earnest last year with the scouting for viable youth groups
for potential partnerships. Five youth groups were accordingly
identied for partnership in the IGAs project. The ve groups
include, Umoja Youth Daawa Group, Huruma Muslim Youth
Group, Dagoretti Ansaar Muslim Youth Group, Kenya Youth
Development Centre and Al-Taawon Islamic Youth Organization. In March 2007, a total of kshs.587000.00 (Five hundred
and eighty seven thousand shillings) was disbursed to the
groups. This was done upon submission of a simple project
proposal or simply put a simple business plan by each of the
ve youth groups. The proposals were studied, discussed
and evaluated. The requisite documents outlining the duties,
roles and responsibilities of the contracting parties were prepared, discussed and agreed upon. The monies involved was
then sourced from members and potential donors and then
later on disbursed upon execution of the agreements by the
contracting parties. Due to limitation of resources, only small
group projects qualify under this programme and money lent
or given out will be repayable over a period of twenty months
and will be guaranteed by the ofcials of the groups. This
will ensure the creation of a revolving fund that will cater for
the economic needs of the community by supporting a wider
base of deserving cases. Inshaallah, it is hoped that women
will also benet from the programmes but after successful
implementation of the ongoing pilot projects. It is imperative
to note that a community that invests in the youth is a conscious community and one that takes into cognizance, the
immense resources and endowments in the youth and hence

an empowered society and therefore a progressive, productive and peaceful society.

2. WOMEN SECTION:-In the past visits were made to Langata Womens Prison and Kenyatta National Hospital, Childrens
Cancer Ward. Similar activities will be organized on a continuous basis to various hospitals and prisons. This is scheduled to commence in the near future and all those interested
are asked to forward their email addresses, phone numbers
and any other relevant details to Ummah Foundation ofces.
Kindly indicate which days of the week or weekend are most
suitable for your participation in the proposed activities. This
will enable us to generate a schedule of activities agreeable
and convenient to the participating members. In case of further enquiries and/or information, kindly do not hesitate to call
on us at our ofces, 1st our, village plaza, Ngara-Nairobi. We
are also open to ideas and suggestions that will help us serve
the ummah better.
