CHRISTOPH BÜCHEL’S NOTICE OF APPEAL

Notice is hereby given that defendant Christoph Büchel appeals to the United States

Court of Appeals for the First Circuit from a final order and/or judgment (or alternatively, order

denying injunctive relief) announced from the bench on the 21st day of September, 2007 by the

Honorable Michael A. Ponsor (1) denying Büchel’s motion for summary judgment and request

for injunctive relief under the Visual Arts Right Act (“VARA”), 17 U.S.C. § 106A, and the

Copyright Act, 17 U.S.C. § 101 et seq., and (2) declaring, inter alia, that neither VARA nor the

Copyright Act applied to the work of visual art in question and granting plaintiff’s relief in its

entirety.
