Judge Carmelo Laquidara ordered Spain to repay the committee $3,375 after finding that he
breached his fiduciary duty to the committee by improperly liquidating the party’s funds
leaving us with 45 cents. The judge clearly understood that Spain did this to cripple the
Democratic Party’s ability to finance its candidates.
“Jeff Spain and his brother, Councilman Al Spain, continue to function as tools of the
Republican Party in North Greenbush. Jeff Spain has even been appointed to the town payroll
(Planning Board) by the Republican controlled town board including Lou Desso where he will
be able to wreak havoc on the town planning process.
Ashley concluded that Spain’s lack of judgment was egregious and ignored his “duty of loyalty”
to the Democratic Committee as its then Chairman. He was found guilty under “three legal
theories of conversion, negligence and breach of a fiduciary duty”, according to the decision.
As such, he should immediately reimburse the committee, pay any legal fees it had to incur,
resign from the committee and scrap his plans to circulate a new petition to remain in this
committee seat in District 3 which includes the St. Jude’s parish area. Ashley urged Democrats
not to sign a petition for Jeff Spain as he has worked for Republicans, endorsed their
candidates in town and county elections in addition to improperly disbursing Democratic
funds.
