prosecution of the following cases:
* The statute of limitations has expired for the transactions dated 11-12-94 and 4-3-95.
+ Janice Schreckengaust did not work alone 6-14-95 or 8-7-95. Mary Moore did not
work alone 7-13-95. We cannot eliminate other potential suspects. 347

+ All of the witnesses for the Private Security Act violations, including the troopers and &
attomeys, are accomplices as a matter of law.
* Janice Schreckengaust was the only person on duty 5-21-95, To sustain a
prosecution, we must prove no one else had access to the TLETS machine when Jerry
Roberson’s name was checked. The report documented that communications
Personnel, right or wrong, routinely left TLETS on without signing on or signing off
contrary to DPS and NCIC regulations. Furthermore, one of your theories for 7-13-95
was that Janice Schreckengaust, while off duty, may have checked Jimmie
Wurtenberg's name when Mary Moore was not looking. We must eliminate other
potential suspects before filing charges. The statute of limitations expires 5-21-97.
